NOTICE TO TAXPAYERS
CARMEL,INDIANA
NOTICE OF ADOPTION OF
AN AMENDMENT TO THE CARMEL/CLAY
ZONING MAP
Notice is hereby given to the taxpayers of the City of Cannel and Clay Township, Hamilton County,
Indiana, that the proper legal officers of the City of Cannel met at their regular meeting place, Council Chambers,
Carmel City Hall, One Civic Square, Cannel, IN 46032, at 7:00 p.m. on Monday, the 4th day of March, 2002, and
adopted the following:
Ordinance No. Z-368-02,rezoning 10.02±acres of Tax Parcel I.D. No. 16-09-26-00-00-001.000 generally
located northwest of the intersection of West 1315` Street and U.S. Highway 31 from the S-2/Residence
District Classification within the U.S. Highway 31 Corridor Overlay Zone to the B-5/Business District
Classification within the U.S.Highway 31 Corridor Overlay Zone.
Ordinance No. Z-368-02 affects only the aforementioned Tax Parcel.
Ordinance No. Z-368-02 does not amend any provision of the CarmeUClay Zoning Ordinance regarding
penalties or forfeiture prescribed for a violation of the ordinance.

LEGAL DESCRIPTION FOR RIGHT-OF-WAY
D'EPAUW UNIVERSITY
A part of the Northwest Quarter of Section 26, Township 18 North, Range 3 East,
Hamilton County, Indiana, being described as follows:
Commencing at the northeast corner of said Quarter; thence South 00 degrees 22 minutes
50 seconds East (assumed bearing) along the east line of said Quarter a distance of 1223.88 feet
to a point on the southeasterly right-of-way line of Meridian Corners Boulevard as per the plats
recorded as The Parks at Springmill, Section 4 in Plat Cabinet 1, Slide 652, and The Parks at
Springmill, Section 3 in Plat Cabinet 1, Slide 488 in the Office of the Recorder, of Hamilton
County, Indiana, said point also being the Point of Beginning (the following three courses are
along said right-of-way line); (1)thence South 66 degrees 06 minutes 14 seconds West a distance
of 830.21 feet to the point of curvature of a curve to the left having a radius of 455.00 feet, the
radius point of which bears South 23 degrees 53 minutes 46 seconds East; (2) thence
southwesterly along said curve an arc distance of 142.30 feet to a point which bears North 41
degrees 48 minutes 54 seconds West from said radius point; (3)thence South 48 degrees 11
minutes 06 seconds West a distance of 127.60 feet to the southeasterly line of a tract of land
described in Instrument #94-13389 and a point on a non-tangent curve to the left having a radius
of 3036.83 feet, the radius point of which bears South 57 degrees 16 minutes 30 seconds East;
thence southwesterly along said curve an arc distance of 47.42 feet to a point which bears North
58 degrees 10 minutes 10 seconds West from said radius point, said point being on a non-tangent
curve to the left having a radius of 560.00 feet, the radius point of which bears North 36 degrees
58 minutes 00 seconds West; thence northeasterly along said curve an arc distance of 47.39 feet
to a point which bears South 41 degrees 48 minutes 54 seconds East from said radius point;
thence North 48 degrees 11 minutes 06 seconds East a distance of 125.88 feet to a point on a
tangent curve to the right having a radius of 440.00 feet, the radius point of which bears South 41
degrees 48 minutes 54 seconds East; thence northeasterly along said curve an arc distance of
137.61 feet to a point which bears North 23 degrees 53 minutes 46 seconds West from said
radius point; thence North 66 degrees 06 minutes 14 seconds East a distance of 823.69 feet to the
east line of said Quarter; thence North 00 degrees 22 minutes 50 seconds West along the east line
of said Quarter a distance of 16.36 feet to the Point of Beginning, containing 0.39 acres (16,777
square feet), more or less.
