D-1969-09 Exhibit A SPONSORS: Councilors: Snyder Seidensticker • Carter ORDINANCE D-2177-14 AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL,INDIANA,APPROVING AN AMENDMENT TO EXHIBIT A OF ORDINANCE D-1969-09,AS AMENDED WHEREAS, on December 8, 2009, the Carmel Common Council unanimously passed Ordinance D-1969-09, as amended, which granted the City of Carmel, Indiana, (the "City") use of proceeds from the sale of county income tax lease rental revenue bonds (the "Bonds") to finance specific projects described in Exhibit A of City Ordinance D-1969-09, as amended, which is attached and incorporated herein; and WHEREAS, the recent need to expedite certain road construction projects has necessitated an amendment to Exhibit A to reflect a different order of priority and financial commitment of the Bonds proceeds from the City; and WHEREAS, the City believes it is in the best interests of its citizens to amend Exhibit A to reflect the renewed current priority and financial commitment of essential road construction projects. NOW, THEREFORE, BE IT ORDAINED, by the Common Council of the City of Carmel, Indiana, as follows: Section 1. The foregoing Recitals are incorporated herein by this reference. Section 2. Exhibit A of Ordinance D-1969-09, as amended, should be and the same is hereby amended to add a new subsection number seven (7), which shall read as follows: "7. Improvements to Main Street between Illinois Street and Guilford Road. ESTIMATED COST:$600,000." Section 3. The remaining provisions of Ordinance D-1969-09, as amended, as well as Exhibit A as attached thereto, shall remain in full force and effect and are not affected by this Ordinance. All prior ordinances or parts thereof inconsistent with any provision of this Ordinance are hereby repealed, to the extent of such inconsistency only, as of the effective date of this Ordinance. However, the repeal or amendment by this Ordinance of any other ordinance does not affect any rights or liabilities accrued, penalties incurred or proceedings begun prior to the effective date of this Ordinance. Those rights, liabilities and proceedings are continued and penalties shall be imposed and enforced under such repealed or amended ordinance as if this Ordinance had not been adopted. l :t :,i; i +,? If any portion of this Ordinance is for any reason declared to be unconstitutional or invalid, such decision shall not affect the validity of the remaining portions of this Ordinance so long as enforcement of same can be given the same effect. Section 6. This Ordinance shall be in full force and effect from and after the date of its passage, execution by the Mayor, and publication as required by law. -1.4` _fin. The acquisition of Brookshire Golf Course by the direct retirement of outstanding bond anticipation notes of the Carmel Redevelopment District. ESTIMATED COST: $3,000,000 2. Improvements to the intersection of Keystone Avenue and 13 l't Street consisting of construction, inspection, utility relocation and land acquisition costs. ESTIMATED COST: S 11,000,000 3. Drainage projects in the Village of Mt. Carmel and Chesterton. ESTIMATED COST: $2,000,000 4. Drainage projects in the Southwest Clay Township neighborhoods of Larkspur, Walnut Creek, Kings Mill, Bridleborne, Windemere, Crooked Stick and Crooked Stick West, to satisfy obligations under annexation agreement. ESTIMATED COST: $1,000.000 5. Multi-use path along 106t1i Street from Ditch Road to Michigan Road. ESTIMATED COST: $1,500,000 6. Intersection improvements consisting of roundabouts at 106th/ Street and Ditch Road, 96i1' Street and Towne Road, and 106th Street and Shelbourne. ESTIMATED COST: $1,500,000 VERSION A- 12/07/09 7
