CARMEL, IN 46032 (317) 571-2417 CARMEL TECHNICAL ADVISORY COMMITTEE MEETING MINUTES Date: Wednesday, September 17, 2014 Place: Dept. of Community Services Conference Room, 3rd Floor, Carmel City Hall. Time: 9:00 a.m. 9:00 a.m. (UV) Hertz/Penske Car Rental, Park Place PUD. The applicant seeks the following use variance for a rental car business: Docket No. 14080006 UV PUD Z-521-08, Section 2 -- Permitted Primary Uses. The site is located at 1441 S. Guilford Rd. and is zoned Park Place PUD (Ordinance Z-521-08)/Planned Unit Development. Filed by Christopher Braun of Plews, Shadley, Racher & Braun on behalf of Shelley Johnston with Hertz/Penske Car Rental. Todd Relue with Plews, Shadley, Racher & Braun Law Firm presented the project on behalf of Penske Car Rental. Mr. Relue said Penske currently has a location at the northside Courtyard by Marriott on North Meridian St. Mr. Relue said the current location is being impacted by the construction work in the area, so they are looking at relocation. Penske would like to subdivide off 1,400 square feet at the new location, use as office space, and also rent the 1,000 square foot wash facility on the back of the building. Mr. Relue presented a traffic study that was completed by A & F Engineering which showed 8,200 cars per day along Guilford Road, and based on Penske’s operations of similar facilities, there would be about 121 trips per day added to this, or about a 1% increase. Greg Hoyes – Hamilton County Surveyor’s Office - Letter sent. No comments on the use variance. Joanie Clark – Vectren Energy - No comments. Ryan Hartman – Clay Township Regional Waste District - No comments on use variance. Mr. Hartman asked if this will be the same size as other facilities that Penske currently has, and if it’s possible to pull those records to see what the water usage will be. Mr. Relue said he anticipates the usage to be very similar, as the clientele is business travelers who rent cars consistently every week. Gary Duncan – City of Carmel Department of Engineering - Mr. Duncan said what the traffic study does not show is the current space would have been expected to generate a base amount of traffic had the space been used by any business. Mr. Duncan said the engineering department does not have any further issues. Nick Mishler – City of Carmel Building & Code Services - No comments. Angie Conn – City of Carmel Planning & Zoning - Ms. Conn said the Urban Forester has said there are no comments. Ms. Conn also said Alexia Lopez, the BZA representative, has indicated that the petitioners have committed to a maximum number of cars that will be parked in front of the business. Mr. Relue said there are eight spots reserved in front of the building, and there is also a screened area in the back off Guilford Road where additional cars can be parked. During the week, this area is estimated to house 2-5 cars, and during the weekend it could be as many as 20, but these will be out of sight. Page 2 of 5 WWW.CARMEL.IN.GOV ONE CIVIC SQ. CARMEL, IN 46032 (317) 571-2417 9:10 a.m. Docket No. 14080019 PP: Sunrise on the Monon Primary Plat. The applicant seeks primary plat approval for 149 lots on 80.135 acres, plus Common Areas and Block A. The site is currently pending a rezone from S-2/Residence to PUD/Planned Unit Development. The site is located at 9876 Westfield Blvd. and abuts the Monon Greenway. Filed by Trent Newport of Crossroad Engineers, PC on behalf of Sunrise on the Monon LLC. Matt Griffin and Andrew Greenwood with Old Town Design Group presented the project. Mr. Griffin said there is a regulated drain which will need to accommodate, and this is also a US waterway. Also, the developers have a capacity letter from Clay Regional Waste, but now that they have the plat, they would like to see the details on the lines coming into the site and their capacity and depth. Greg Hoyes – Hamilton County Surveyor’s Office - Letter sent. There is a meeting scheduled with the developer for September 29. Joanie Clark – Vectren Energy - Ms. Clark said since the developers would like to have gas service in this development, the easements may need to be adjusted. Ms. Clark said the utility easements are 10-feet, and Vectren typically requires 20-feet. Trent Godsey – Duke Energy - No comments. Ryan Hartman – Clay Township Regional Waste District - Mr. Hartman asked if Crossroads Engineering has determined if there is sufficient depth in the sewers in front. Mr. Greenwood said he thinks Crossroads has determined that this is enough depth, but will need to verify. Mr. Hartman said he did not see any sewers on the primary plat, but he wasn’t sure if this was because the developer didn’t know how they would be running sanitary sewers throughout the development. Mr. Hartman said on a side note, 9876 Westfield Boulevard is still being billed for sanitary sewer and the owner Tom Hinshaw would like to be disconnected. Mr. Griffin said this property will eventually be demolished. Mr. Hartman said someone would need to contact CTRWD to set up an inspection so this can be closed out. Gary Duncan – City of Carmel Department of Engineering - Mr. Duncan said because of the creek, the development will need to be studied to determine the flood protection grade. Mr. Duncan said this will not need to be a full FEMA IDNR analysis, but the department will still need to know the limits of the flood plain, especially since this will have bearing on where the easements are created. Mr. Duncan said the plan will also need to show the northbound left turn lane in the median, and the department will also need to know the driveway lines up with the entrance to the Seasons of Carmel. Mr. Duncan asked why the path along Westfield Boulevard was not along the back edge of the right-of-way. Mr. Griffin said the developers would like to leave as much of the existing path as possible, and this is why it appears the way it does on the plans. Mr. Duncan said the City’s preference is typically to push this to the back edge of the right-of-way to remain long term, but he doesn’t feel that strongly about it if they would like to keep the existing path. Mr. Duncan said there is also a comment in the letter regarding the minimum tangent lengths along the roadways, mainly along the east-west roadway through the development. Mr. Duncan said this is probably fine, but Crossroads Engineering should be able to check this pretty quickly. Nick Mishler – City of Carmel Building & Code Services - No comments. Angie Conn – City of Carmel Planning & Zoning - Comment letter sent. Ms. Conn said the Urban Forester still needs a landscape plan with the bufferyard, but the final, more detailed landscape plan will be submitted with the secondary plat. 9:20 a.m. Docket No. 14080018 SP: Blackwell Park Phase II Secondary Plat. CARMEL, IN 46032 (317) 571-2417 The site is located generally at and around 240 5th Street NE, between 5th and 7th Streets NE, approximately 300-ft east of 2nd Ave NE. The site is zoned R-2/Residence and isn’t located in an overlay zone. Filed by Dustin Myers of Crossroad Engineers, PC, on behalf of Old Town Development, LLC. Matt Griffin and Andrew Greenwood with Old Town Design Group presented the project. Mr. Greenwood said the developers have received comments from just about everyone on this project, and the goal would be to get the project started this year. Greg Hoyes – Hamilton County Surveyor’s Office - No comments. Joanie Clark – Vectren Energy - Ms. Clark said there is a 2-inch gas main along Burnett Court that will need to be retired. Mr. Greenwood said this has already been called in and should everything along Burnett Coart should already either be moved, retired or the building demolished. Trent Godsey – Duke Energy - No comments. Ryan Hartman – Clay Township Regional Waste District - Project is not in CTRWD service area. Gary Duncan – City of Carmel Department of Engineering - Comments have not been generated yet, but the department is very familiar with the project. Mr. Duncan said there is offsite detention that will need to be worked on. Nick Mishler – City of Carmel Building & Code Services - No comments. Angie Conn – City of Carmel Planning & Zoning - Comments sent by both Planning & Zoning, as well as Urban Forestry. Both departments are waiting for responses. 9:30 a.m. Docket No. 14080016 SP: Tallyn's Ridge Secondary Plat. The applicant seeks secondary plat approval for 27 lots on 18.5 acres, along with construction plans approval. The site is located 3225 W. 146th St., east of Shelborne Rd. The site is zoned S-1/Residence. Filed by Brian Robinson of Stoeppelwerth & Associates, Inc., on behalf of Lombardo Homes of Indiana, LLC. Jeff Boland with Lombardo Homes of Indiana and Brian Robinson with Stoeppelwerth & Associates presented the project. Mr. Boland said the project has gone before the BZA to gain four variances to make lots smaller on one side, and to reduce a couple of the building setbacks. Greg Hoyes – Hamilton County Surveyor’s Office - Based on what has been reviewed so far, the plans showed two missing SSD laterals, but a complete letter will be sent soon. Joanie Clark – Vectren Energy - Ms. Clark said Vectren will be able to serve the developers from the subdivision to the south, Trails at Hayden Run, because the company does not have equipment along 146th Street. Trent Godsey – Duke Energy - No comments. Mr. Boland asked if the plan Shirley Hunter was working on is finished, or close to being finished. Mr. Godsey said he will check to see if this is complete and contact the developers. Ryan Hartman – Clay Township Regional Waste District - Comments have been sent. Mr. Hartman said he thought the location showed on the plans was where it needed to be, but he can look into this further. Mr. Robinson said the location CTRWD has requested for the manhole is in a bufferyard, which is supposed to be exclusive from all utilities. Mr. Hartman said he will need to look at this. Mr. Duncan said it is his opinion that where there is a bufferyard, the situation that should be avoided is when utilities run parallel to this area. He said when the utilities run perpendicular to this buffer area it can be acceptable. Mr. Duncan said he would also welcome the opinion of Daren Mindham with Urban Forestry. Gary Duncan – City of Carmel Department of Engineering - Comments have not been sent. Mr. Duncan said the department did a very detailed review at the primary plat stage and everything was satisfactory. Nick Mishler – City of Carmel Building & Code Services - No comments. Angie Conn – City of Carmel Planning & Zoning - Comments sent, and department is awaiting a response. Also, Ms. Conn said the Urban Forester has no further comments and the landscape plan is acceptable. Mr. Robinson said regarding the extension of the cul-de-sac/road to the east, it is the developer’s opinion that whoever develops this piece of property will make that connection. Ms. Conn said as long as this is in writing, the department can consider this. Mr. Duncan with Carmel Engineering asked if the right-of-way will be platted for the connection. Mr. Robinson said the right-of-way will be platted and dedicated, but the developer would prefer to not extend this street themselves. Mr. Duncan said it is his opinion that the right-of-way would need to be platted for sure, but with covenants and restrictions that indicate that no one will remonstrate against an extension when it is proposed from the east. Mr. Duncan said he would like the plans to acknowledge that this area is reserved for a future connection. Mr. Boland asked if it is possible for Lombardo Homes to build a statement into their sales contract that people will sign at purchase, stating that the buyer is aware that there may eventually be a through street where this common area is located. 9:40 a.m. Docket No. 14080017 Z: 96th and Randall PUD Rezone. The applicant seeks approval to rezone 18.43 acres from B-3/Business to PUD/Planned Unit Development, for multi-family dwellings, a clubhouse, and commercial land uses, including the Butler Hyundai site and its outlots. The site partially lies within the Floodplain & Floodway Districts. It is located at 4200 E. 96th St., west of Randall Dr. Filed by Timothy Ochs of Ice Miller, LLP, on behalf of 4148 96th St, LLC. Jim Adams with 96th Street Partners and Alan Fetahagic with American Structurepoint presented the project. Mr. Adams said the front 10 acres of the property are currently under construction with the Butler Hyundai dealership. Mr. Adams said the developer has lined up Randall Drive with the light adjacent to H.H. Gregg, and called this street Randall Bypass. Greg Hoyes – Hamilton County Surveyor’s Office - No comments. Joanie Clark – Vectren Energy - No comments. Trent Godsey – Duke Energy - No comments. Ryan Hartman – Clay Township Regional Waste District - This project is outside of CTRWD service area. No comments. Gary Duncan – City of Carmel Department of Engineering - Comments have been issued. Mr. Duncan said regarding the right-of-way along 96th Street, the exhibit included with the PUD did not show this to be dedicated. CARMEL, IN 46032 (317) 571-2417 Nick Mishler – City of Carmel Building & Code Services - Mr. Mishler said regarding the flood plain, the Building Commissioner Jim Blanchard is currently the flood plain administrator, and asked Mr. Duncan if the engineering department would be taking this over in November. Mr. Duncan said this is staying in Building & Code, although the engineering department will assist in some aspects of flood administration. Mr. Duncan asked if the LOMR has been approved at this time. Mr. Fetahagic said the letter has not been approved, and may take a long time since this affects properties as far south as I-465. Mr. Duncan said he understands this is a long process, but still the letter will be required and as it stands, there is building occurring in the floodway. Angie Conn – City of Carmel Planning & Zoning - Review is almost complete. Ms. Conn said the Urban Forester will need some sort of landscape plan. 9:50 a.m. Docket No. 14080015 DP/ADLS: Shoppes at The Bridges (aka Bridges II). The applicant seeks site plan and design approval for a multi-tenant commercial/retail building and outparcel development on 3.86 acres, totaling about 45,636 sq. ft. of floor area. The site is located at approximately 11505 N. Spring Mill Rd. It is zoned PUD/The Bridges Planned Unit Development. Filed by Charlie Frankenberger of Nelson & Frankenberger, PC, on behalf of The Bridges II, LLC. Jon Dobosiewicz and Jim Shinaver with Nelson & Frankenberger and Buzz Weisiger with Gershman Partners presented the project. Mr. Dobosiewicz said after the meeting, he will work individually with each department to address any outstanding items. Mr. Dobosiewicz said the developers will appear in front of the Plan Commission in October, and then go in front of committees, so the earliest the plans could be approved would be mid-November. Greg Hoyes – Hamilton County Surveyor’s Office - Letter sent. Mr. Hoyes said this project complies with the master drainage plan and the developer would just need an outlet permit. Joanie Clark – Vectren Energy - Ms. Clark said the developers will need to contact Randy Crutchfield for gas service. Trent Godsey – Duke Energy - This project is IP&L service territory. Ryan Hartman – Clay Township Regional Waste District - Comments sent. Mr. Hartman is waiting on revised plans to be sent back. Gary Duncan – City of Carmel Department of Engineering - Mr. Duncan said the developer will need to speak with Jeremy Kashman regarding the widening of Spring Mill Road to the south. Mr. Duncan said one of the comments was regarding access to the site. There are four parking spaces that will not have a positive effect on traffic flow. Mr. Shinaver said these spaces have been taken out of the plan. Mr. Duncan said he would prefer a “no left” at the entrance to the property. Nick Mishler – City of Carmel Building & Code Services - Mr. Mishler said these projects are typically permitted as a shell permit up front, and then each tenant will pull their own tenant finish permits when they are ready. Also, Mr. Mishler said the developer will need to work with the Building & Code office when it is time to assign suite numbers to the individual suites.
