The approval of this variance will not be injurious to the public health; safety, morals and general welfare of the community because: Pool installation will occur within an existing fence and will include an autocover to ensure the safety of the residents of the home as well as those in the neighborhood/using the walking path.Professional pool installation will ensure that the final grading is sufficient and all decking/pool structures are fully inspected and compliant.Drainage and utility easements will not he impacted by the proposed pool location.No trees to be removed. 2. The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner because: The installation of the pool will be well within our existing fence/property lines and will not encroach on adjoining or abutting lots. Installation of the pool and lush landscaping will improve the aesthetics of the currently bare landscape.The pool and new landscaping may likely increase the overall home values for adjoining lots and the proposed placement of the pool directly behind our home is ideal for both adjoining lots. 3. The strict application of the terms of the Zoning Ordinance to the property will result in practical difficulties in the use of the property because: Adding a pool to our property will significantly enhance our lives.We spend a groat deal of time at our home and love being outdoors.We considered alternate locations for the pool on our lot,but-the configurations severely limit the size of the pool and jeopardize the safety of the home residents because the pool would be ton close to the back of our home(not allowing enough space from doors to pool edge),and may still require decking to cross into the landscape easement. DECISION IT IS THEREFORE the decision of the Carmel/Clay Board of Zoning Appeals that Development Standards Variance Docket No. j'/090003 V is granted, subject to any conditions stated in the minutes of this Board, which are incorporated herein by reference and made a part hereof.
