Per Section 2(D)of the Amended and Restated Plat Covenants for Saddle Creek: "Landscaping Easements,or L.S.E.'s are created and reserved for the use of the Developer and Homeowners Associations for the installation,maintenance,repair and replacement of mounds,landscaping and other plant material(including,without limitation, trees,shrubs,other plantings,walls and fences),street signs or directories,sculptures,works of art,fountains,entry ways, landscape irrigation systems,accent lighting systems,subdivision identification signs and other items;such Landscaping Easements shall constitute easements over,upon and across the lots affected thereby as shown on the within plat;except as installed and maintained by Developer and the Homeowners Association,no permanent or other structures,including fences or walls,or additional landscaping shall be erected or maintained on said Landscaping Easements,and the owners of said lots affected thereby shall not do or permit to be done anything which will obstruct or interfere with any installations made by the Developers or the Homeowners Association in said Landscaping Easements." The proposed placement of your pool deck and pool enters the Landscaping Easement and does not meet the requirements per the governing documents. After careful consideration of your project and a site visit of the Lot, the Board would like to grant a one-time variance regarding the placement of the pool and deck in the L.S.E. Please know that this variance applies only to the governance of the Saddle Creek Homeowners Association and does not imply acceptance of any requirements from the City of Carmel. All construction must commence within 120 days of this letter. If construction will not commence within the 120 days, such approval shall be deemed withdrawn unless homeowner applies for an extension. Once construction is commenced, all work shall be completed within 180 days of commencement. ARC approval of plans shall not constitute a representation, warranty,or guarantee that such plans and specifications comply with engineering design practices or zoning and building ordinances,or other governmental agency regulations or restrictions. The ARC shall not be responsible for reviewing,nor shall its approval of any plans or design,be deemed approved from the standpoint of structural safety or conformance with building or other codes. By approving such plans and specifications,neither the ARC,the Members thereof, the Association, any Member thereof, their Board of Directors, any Members thereof, or the Declarant assumes any liability or responsibility therefore or for any defect in the construction or improvement from such plans or specifications. As provided in the CC&R's neither the ARC, the Association, the Board of Directors or the Association or any Members thereof,not the Declarant or Developer shall be liable to any Member,Owner, Occupant,or other person or entity for any damage,loss or prejudice suffered or claimed on account of(1)the approval or disapproval of any plans,drawings, or specifications, whether or not defective,or(2)the construction or performance of any work whether or not pursuant to the approved plans,drawings,or specifications. In addition, the Board of Directors acknowledges the existence of a fence, irrigation system and play set within the L.S.E. They acknowledge and accept that these items were previously approved by the Developer and grandfathered in despite the encroachment in the L.S.E.
