ORDINANCE D-2192-14
AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA
ADDING CHAPTER 2, ARTICLE 4 , SECTION 143 TO THE CARMEL CITY CODE,
THEREBY ESTABLISHING THE CITY OF CARMEL
"STORMWATER MANAGEMENT FUND (#250)"
WHEREAS, the Common Council of the City of Carmel, Indiana is, pursuant to Indiana Code
36-4-6-18, authorized to pass ordinances and resolutions regarding the control of the City's finances and
the appropriation of money; and
WHEREAS, the Council adopted Ordinance D-2154-13 establishing the City of Cannel
Department of Storm Water Management, as well as a special taxing district, the Carmel Storm Water
District; and
WHEREAS, the City is entitled to collect Storm Water User Fees from the District to pay for the
Department of Storm Water Management's operations; and
WHEREAS, there currently exists no City fund earmarked exclusively for monies collected under
Ordinance D-2154-13; and
WHEREAS,the creation and operation of such a fund is in the public interest.

NOW, THEREFORE, BE IT ORDAINED by the Common Council of the°pity of Cannel,
Indiana, as follows:
Section 1: The foregoing Recitals are incorporated herein by this reference.
Section 2: That Chapter 2, Article 4, Section 143 is hereby added to the Cannel City Code and
shall read as follows:
"Sect. 2-143. Storm Water Management Fund (#250)
(a) There is established a City of Carmel "Storm Water Management Fund(#250)".
(b) All monies received in the form of Storm Water User Fees collec ted fr om the Carmel
Storm Water District shall be deposited into the Storm Water Management Fund #250,
which shall be a non-reverting fund.

(c) Monies in the Storm Water Management Fund shall not be transferred into the General •
Fund except as provided by applicable law.
(d) The Fund shall be administered by the Common Council.
Section 3. That the remaining provisions of Carmel City Code Chapter 2, Article 4, are not
affected by this Ordinance and remain in frill force and effect.
Section 4. This Fund shall be identified as fund(#250).
Section 5. If any portion of this Ordinance is for any reason declared to be unconstitutional or
invalid, such decision shall not affect the validity of the remaining portions of this Ordinance so long as
enforcement of same can be given the same effect.
Section 6. This Ordinance shall be in full force and effect from and after its passage and signing
by the Mayor and such publication as is required by law.
