HomeMy WebLinkAboutPacket Statement of Variance: We would like to keep our newly constructed, 6', shadowbox fence in tact. We were approved through our HOA for the construction of the fence. We were instructed to read Carmel/Clay Zoning Ordinance section 25.02 regarding fences. We had no knowledge that our side/back yard on our corner lot is zoned as a front yard. Statement of Support: We purchased our home knowing that we needed to build a fence for the privacy and safety of our children. We would not have purchased this property if we knew there were fence regulations for our corner lot. Our HOA quickly approved the construction of the fence because they knew we were a young family with a toddler. Everyone in our neighborhood has been extremely complimentary and positive in regards to our home improvements thus far. We feel that we truly followed all the guidelines correctly prior to building this fence. We had a proper stake survey to ensure that we were not encroaching on utility and building easements. Our HOA approved the construction. We read through the suggested zoning ordinance,which had no mention of the corner lot stipulation of having two front yards. Our fence sits below road grade, is approximately 15'within our property line (30'- 45' from the road, depending on where it's measured), and is not a sight obstruction to drivers. We have noticed numerous other fences along 116th street that are very similar to ours, many of which are much older and closer to the road. We bought this home to raise our family in. Not having full use of our backyard would really discount a main reason we moved here. We have already invested in the fence as well as many other projects on this property and we are hoping that you will see this as a positive improvement to our land. October 13, 2014 NOTICE OF PUBLIC HEARING BEFORE THE CARMEL/CLAY ADVISORY BOARD OF ZONING APPEALS This is a notice that the Carmel/Clay Board of Zoning Appeals meeting on October 28th, 2014 at 5:30 p.m. in the City Hall Caucus Room, 1 Civic Square, Carmel, Indiana 46032 will hold a Public Hearing upon a Development Standards Variance application to keep our newly constructed shadowbox fence at a height of 72 inches on the property being known at 11605 Rolling Springs Dr. Carmel, Indiana 46033. This application is identified as docket number: 14100001V The real estate affected by said application is described as follows: Woodland Springs, Sec. 8, Lot 325. All interested persons desiring to present their views on the above application, either in writing or verbally, will be given an opportunity to be heard at the above-mentioned time and place.
