Dear Kelli:
I appreciate receiving a copy of your letter to Barbara Eden dated February 21, 2001,
regarding Merchants' Pointe Signage,as presented under Docket No. 198-00 ADLS. I have been
asked to respond to your letter and submit the following.
The project identification sign will not be constructed for over one(1)year. Therefore,we
have decided,and it is our desire,to eliminate and minimize the number of variance requests. To that
end, we confirm that the complex identification signs,both at 116th Street and Keystone Ave., and
at 116th Street and AAA Way,will be relocated so as to be not less than ten(10)feet from the right-
of-way, thus eliminating a variance request. As of this date, we are uncertain as to the number of
tenants within the office building to be relocated on Lot 6, and until we have a better feel for the
number,we will withdraw our request for signage on Lot 6.
I do think it important that we present to the Plan Commission the signage for architectural
review. I do acknowledge that the complex identification sign at 116t Street and AAA Way, if it
were to also include the name of the anchor tenant,will require a variance, as you suggested. With
your approval, we intend to proceed ahead with the ADLS portion of the request to the Plan
Commission, understanding that we must meet the ordinance, and to the extent that we do not,

This letter is to indicate any areas in which the Merchants' Pointe signs (198-00 ADLS)do not meet the
Sign Ordinance. Please either make the required changes or submit the necessary variance applications.
Complex Identification Sign (116th Street/Keystone)
• ZO 25.7.02-11(e): sign must be a minimum of ten feet from the street right-of-way
Complex Identification Sign (116t Street/AAA Way)
• ZO 25.7.02-11(e): sign must be a minimum of ten feet from the street right-of-way
• ZO 25.7.02-11(b): allows a center identification ground sign and a multi-tenant building complex
directory sign. The sign you requested does not fit the definition of either of these signs. In order to
allow the submitted sign,you would need to seek a variance of this part of the Ordinance to allow the
center identification ground sign to include the anchor tenant's name.

• ZO 25.7.02-10(d): maximum height of a directory sign is five feet
• ZO 25.7.02-10(c): maximum sign area of a directory sign is twenty square feet

198-00 ADLS, Signage
• The filing fee for the ADLS is $1190.00.
• Please show details of landscaping to be done around the signs..
• Please provide illustrations showing the distance the signs will be placed from the
right-of-way and the exact locations of the signs.
• Three signs were submitted with the ADLS application yet only two signs are
indicated on the site plan and application. Please clarify.
• The multi-tenant directory sign exceeds the maximum height allowed (5 feet) and
the maximum sign area allowed (20 feet).
199-00 ADLS, Lot 5
• The filing fee for the ADLS is $791.00.
• The most recent communication received by this Department (dated December
19, 2000) from the City of Carmel Fire Department indicates various requests.
Please address these.
• The most recent correspondence received by this Department (dated December
12, 2000)from the Hamilton County Soil & Water Conservation District indicates
that their minimum requirements have not been met. If you are in possession of
more current information, please forward it to this office.

Dear Mr. \Warenburg:
We apologize for the delay in responding to your drawing revisions and letter of October 17. 2000. We
have reviewed the subject drawing and revisions. It appears the majority of the issues outlined in our
September 18. 200(1 review letter have been addressed. We offer the following additional comments:
Items 1 through 11 —No comments were offered. We assume there are no questions regarding these items
and the approvals and requirements are understood. I am including 20(11 Board of Public Works and
Safety meeting dales and agenda deadline schedule. Please adhere to the Engineering Department
deadlines for all submissions to the Board. Please share this schedule with all appropriate parties.
Item IS—Regarding the sanitary sewer service laterals terminating in a structure. the stubs from the mains
are to be constructed with the trains. correct'? In regard to the easements. I believe it would be beneficial to
indicate the casements on Sheet CS.
Item 16— In regard to the ponds. please forward our continents/concerns to the Woodland G.C. engineer
and ask that he address our concerns in writing. Please indicate storm pipe material on Sheet CS in
addition to the plan and profiles.
Item 20 —The decision regarding concrete sidewalks/asphalt paths has not been made. I ant enclosing a
copy of our specification for multi-use paths. Please substitute this specification for the bituminous
pathway specification indicated on Sheet C2.
Item 21 —In your October 17 letter. you indicated additional street light information Ntould be
forthcoming. I don't believe we have received any additional information.
Item 24—Open cuts may be allowed on 1 16'1'Street. This depends upon the timing of the road project and
the Merchants' Pointe project. lithe delay between the two is significant. directional bores may be
required. If open cuts are allowed. approval will he required through the Board of Public Works and
Safety. Maintenance of 1 161x'Street traffic will be a requirement. We will expect any open cuts repaired to
adhere to our specifications and meet our satisfaction.
Other Items
• We request solid curb castings be installed rather than the adjustable.castings(il. 0I()) utilized in the
Merchants' Square renovation. We have experienced considerable problems with the adjustable
castings. The casting position does not hold when they are ruts over b‘ vehicles. Our Inspector asked
for these castings to be welded in place once the curbs were installed. However. Jr(hey were welded.
the welds were either in the wrong place or they did not hold. This problem remains to date.
• We request the elimination of Ilie west curb cut for lot 47. We believe this curb cut would be a s,ilet■
issue clue to its' proxintitN. to die intersection of 11(, Street. and Ilie tendency of motorists to Ilse tt as a
"short cute out of the parking lot.

• In preliminary reviews of the plans submitted for Lots 5.6 and 7. it appears the individual plans vary
from what is indicated on the overall plan in regard to water and sanitary sewers and their respective
service lines. Why would this be the case? From our point of view and procedure,we will be
approving the overall plan for the development. As individual lot plans are submitted, they,will be
compared to the approved "master plan"to see if they conform. Please address this issue.
I will take this opportunity to reiterate Board of Public Works and Safety submittals required for the
approval of the master plan for Merchant's Pointe and to review the requirements for obtaining individual
building permits for each lot.
Board of Public Works and Safety •
Assuming that each individual lot/building will be required to obtain commercial curb cut approval, the
master plan will not require Board Commercial Curb Cut approval. The curb cuts required for the
intersections of Merchant's Pointe Drive and Merchant's Point Way with 1 1611' Street \yill be.approved with
the approval of the plat. Also, since each individual building/lot xvill be required to obtain Water and
Sanitary Sewer Availability approval from the Board. based upon their planned utilization. the master plan
will not require Water and Sanitary Sewer Availability approval from the Board. However. if you have not
already done so, please submit copies of the Notice of Intent to Construct a Water Main Extension and
the Capacity Certification/Allocation Letter for sanitary sewers. Remaining Board of Public Works and
Safety submissions arc:
• Dedication of 116"Street Right of Way and Acceptance(if applicable).
• Secondary Plat Approval.
• Open Pavement cuts in dedicated streets/right of way.
• Temporary Construction Entrances.
• Any improvement installed within dedicated right of way and/or any improvement installed within
dedicated easements. If an irrigation system is planned and the system is installed within dedicated
casements.a Consent to Encroach Agreement will be required.
Sewer Permits
Each individual lot/building must satisfy the following requirements prior to a Sewer Permit being issued.
Issuance of a Sewer Permit will allow the commencement of the building permit review process:
• Sanitary sewers constructed and acceptable air/mandrel tests completed.
• Water mains constructed. pressure tested. chlorinated and satisfactory 1'' and ri day results obtained.
• Base and binder completed on interior streets.
• Storm drainage installed.
• (5) Sets of approved construction drawings.
• Recorded Secondary Plat.
• Payment of Water and Sanitary Sewer Connection Fccs. The Availability (acreage) Fees must be paid
• prior to the approval of the Merchants Pointe master plan.
