Dear Mr. Nelson:
We offer the following comments regarding the plans submitted for these lots:
GENERAL INFORMATION AND COMMENTS
I. Each individual lot in the Merchants' Pointe Development %gill be required to obtain Board of Public
Works and Safety approval of Water and Sanitary Sewer Availability based upon the type of
establishment planned for their lot. Any submission to the/loamd requires prior final approval by the
Carmel-Clay Plan Commission and/or the Board al—Zoning Appeals and completion of project
review by the Technical Advisory Committee. All written requests to he placed on the Board's
agenda must include the date(or dates) of approval of the appropriate governing hods'curl include
docket numbers if applicable.
2. Will each lot be responsible for requesting Board of Works approval of their individual curb cut on
Merchant's Pointe Drive or will the developer obtain approval for all the curb cuts?
3. I want to reiterate the standard requirements to initiate the building permit process. No individual
building sewer permit. which is a requirement for a building permit. will be issued until:
• The sanitary sewers constructed and acceptable air/mandrel tests completed.
• Water mains constructed. pressure tested.chlorinated and satisfactory I'' and 2"1 day test results
obtained.
• Base and binder completed on interior streets.
• Storm drainage installed.
• (5) Sets of approved construction drawings.
• Recorded Seconder Plat
• Payment of Water and Sanitary Sewer Connection Fees. The Ayailabilit■ tacrcagc) Fees must be
paid prior to the approval of the Merchant's Pointe master plan.
4. • This department will approve the overall "master plan" for Merchants' Pointe. As individual lots and
construction plans are submitted for approval. the individual plans will he compared to the naasie
plan to determine if the conform to the plain. We will require justification I'ur dcyi;uauns from alit
"master plan'.
5. T.A.C. Review/Draw tip submitted for approval:
We request that all continents and comment letters generated h■ this office be answered in w ruing and
be accompanied by a drawing reflecting requested revisions. An additional revisions of suhstanlisC
nature made to the plans but not.requested by this office shall be called to our aneutiun. Final
drawings will not be approved for construction until all issue have been resolved. All Cannel Utilities

approval. This office will require live-sets of approved drawings after all issues have been resolved.

The drawings will be approved and signed by the City Engineer and by the Director.Carmel Utilities.
The Developer/Owner will receive one-set which must be maintained on the construction site until
work is complete. Carmel Utilities will receive two-sets. Out Public Works Inspector will receive
one-set and the final set will be retained in the Department of Engineering.
6. Please be advised that any installation of signs,walls, irrigation systems, street lights, etc. within •
dedicated easements will require a Consent to Encroach Agreement between the Owner and the City of
Carmel. The agreement requires Board approval. Similarly, installations within dedicated right of
way will be reviewed and will also require Board approval.
7. Carmel Utilities will provide a separate review of water and sanitary sewer issues for each lot.
LOT#5/BORDERS BOOKSTORE
8. Water and Sanitary Sewer Connection Fees
Based upon the building sire indicated on Sheet SP1 and the retail classification from the City of
Carmel Utility Ordinances,the.following would be applicable for this development:
Water—23.200 sq. ft. 0) 1.0 EDU/1,000 sq. ft.= 23.2 EDUs

9. It appears the sanitary sewer service line on Sheets C3/C4 does not.match the location of the line on
Sheet SP I. The master plan service line location matches Sheet SP I. The water main and service line
indicated on Sheet C4 does not match the master plan or Sheet SPI. Please clarify.
10. Each of the lots has a storm sewer service lateral from the main to the buildings. Is this line to
accommodate roof drains? It is our understanding that the storm sewer system (including these
laterals)will be private with the exception of storm sewers within dedicated right of way.
II. There is a note#5 on Sheet C2 identified as"taper curb to flush", yet this number does not appear on
the plan view on either lot 5 or lot 6. Please clarify.
LOT#6/GENERAL OFFICE BUILDING
12. Water and Sanitary Sewer Connection Fees:
Please provide the total square footage of the building. Without the building area. these fees cannot be
calculated. I could not find this area anywhere on the drawings. The calculation would be building .
area(4).0.5 EDUs/I.00(1 sq. ft. =total EDUs O.$2,105.00 Total Connection Fcc per EDU.
13. The water. sanitary and storm plan appears to be identical to the"master plan' submitted for the
development.
LOT#7 1RETAIL-SERVICE BUILDING
l4. Water and Sanitary Sewer Connection Fees:
Please provide the total square footage of the building. If separate usages arc planned. please provide
• the total square footage of each unit. i could not find the area on this drawing. It appears the building
on this lot could be developed into possibly four separate establishments. If the use is not determined
prior to payment of Connection Fees. we reserve the option to review the type of establishments,after
this building has been completed.and to require additional Connection Fccs if the use (a restaurant for
example)would result in greater water usage than the retail classification originally calculated.
15. The water. sanitary and storm plan appears to be identical to the-master plane submitted for the
development. The exception being the water and sanitary sewer extensions south to the golf course.

Dear Mr. Warrenburg:
We apologize for the delay in responding to your drawing revisions and letter of October 17. 210/0. We
have reviewed the subject drawing and revisions. It appears the majority of the issues outlined in our
September X. 2010 review letter have been addressed. We offer the following additional continents:
Items 1 through I 1 —No comments were offered. We assume there arc no questions regarding these items
and die approvals and requirements are understood. I am including 2001 Board of Public Works;Ind
Safety meeting dates and agenda deadline schedule. Please adhere to the Engineering Department
deadlines for all submissions to the Board. Please share this schedule with all appropriate parties.
Item IS—Regarding the sanitary sewer service laterals terminating in a structure. the stubs from the mains
are to be constructed with the mains. correct? In regard to the easements. I believe it would be beneficial to
indicate the easements on Sheet C5.
Item 16—in regard to the ponds. please forward our continents/concerns to the Woodland G.C. engineer
and ask that he address our concerns in writing. Please indicate storm pipe material on Sheet C5 in
addition to the plan and profiles.
Item 20—The decision regarding concrete sidewalks/asphalt paths has not been made. I ant enclosing a
copy of our specification for multi-use paths. Please substitute this specification for the bituminous
pathway specification indicated on Sheet C2.
Item 21 —In your October 17 letter. you indicated additional street light information would be
forthcoming. I don't believe we have received any additional information.
Item 24—Open cuts may be allowed on 1 1611 Street. This depends upon the timing of the road project and
the Merchants' Pointe project. If the delay between the two is significant. directional bores may be
required. If open cuts are allowed. approval will he required through the Board of Public Works and
Safety. Maintenance of 116"'Sweet traffic will be a requirement. We will expect :Illy open cols Cep:iircd to
adhere to our specifications and meet our satisfaction.
Other Items
• We request solid curb castings be installed rather than lie adjustable castings t/(JU Ito) utilized in the
Merchants' Square renovation. We have experienced considerable problems with the adjustable
castings. The casting position does not hold when they are run over b■ vehicles. (Jul Inspector asked
for these castings to be welded in place once the curbs were installed. I htttever. Ii drew were welded.
the welds were either in the wrong place or they did not hold. 'Phis problem remains to date.
• We request the elimination of the west curb cut for lot 47. We believe this curb cut would be a s:ile ■

• In preliminary reviews of the plans submitted for Lots 5.6 and 7. it appears the individual plans vary
from what is indicated on the overall plan in regard to water and sanitary sewers and their respective
service lines. Why would this be the case? From our point of view and procedure,we will be
approving the overall plan for the development. As individual lot plans are submitted, they will be
compared to the approved "master plan"to see if they conform. Please address this issue. •
I will take this opportunity to reiterate Board of Public Works and Safety submittals required for the
approval of the master plan for Merchant's Pointe and to review the requirements for obtaining individual
building permits for each lot.
Board of Public Works and Safety •
Assuming that each individual lot/building will be required to obtain commercial curb cut approval, the
master plan will not require Board Commercial Curb Cut approval. The curb cuts required for the
intersections of Merchant's Pointe Drive and Merchants Point Way with 116''' Street will be approved with
the approval of the plat. Also. since each individual building/lot will be required to obtain Water and
Sanitary Sewer Availability approval from the Board. based upon their planned utilisation. the master plan
will not require Water and Sanitary Sewer Availability approval from the Board. However. if you have not
already done so, please submit copies of the Notice of-Intent to Construct a Water Main Extension and
the Capacity Certification/Allocation Letter for sanitary sewers. Remaining Board of Public Works and
Safety submissions arc:
• Dedication of 116' Street Right of Way and Acceptance of applicable).
• Secondary Plat Approval.
• Open Pavement cuts in dedicated streets/right of way.
• Temporary Construction Entrances.
• Any improvement installed within dedicated right of way and/or any improvement installed within
dedicated casements. If an irrigation system is planned and the system is installed within dedicated
easements.a Consent to Encroach Agreement will be required.
Sewer Permits
Each individual lot/building must satisfy the following requirements prior to a Sewer Permit being issued.
Issuance of a Sewer Permit will allow the commencement of the building permit review process:
• Sanitary sewers constructed and acceptable air/mandrel tests completed.
• Water mains constructed. pressure tested. chlorinated and satisfactory I" and 2"'clay results obtained.
• Base and binder completed on interior streets.
• Storm drainage installed.
• (5)Sets of approved construction drawings.
• Recorded Secondary Plat.
• Payment of Water and Sanitary Sewer Connection Fees. The Availability (acreage) Fees must be paid

I will be coming back early from a meeting at Brown County State Park on the 17th. I do not think I will make it to the
TAC meeting before 11AM. Therefore I wanted to provide you with my questions on the various projects.
Hazel Dell Corner Lot 5 I saw no problems with this project. It looks like they will use an entrance from Hazel Dell
Parkway of lot 6, and any path issues are by others. I would only make sure that they agree to restore the path should
they cause damage.
Merchants' Pointe Lot 5,6,7.. No problems with these projects, but just make sure that the path will be 10'wide and
asphalt.
Woodland Shoppes Telecommunications Facility I did not received any plans on this project and therefore would like to
get a copy of the plans. Concerns would be a path if their property borders 116th, along 116th Street. Otherwise I see
no problems with it effecting a Parks property.
Carmel United Methodist Church-No problems with this project unless they need to address sidewalk or a path along
126th Street.

I filed with the Carmel Plan Commission the Application for ADLS Approval for The Linder
Company pertaining to the first three buildings in Merchants' Pointe;Namely, Borders, The Office
Building, and the small retail/office building. The plans for Borders.Books are undergoing review
by the management of Borders and as of this date,final approval has not yet been received. I would
anticipate that there could be some revisions to the plans. At the time of filing I requested that we
be placed on the December TAC agenda and the January Plan Commission agenda. In order to avoid
confusion. I believe it would be best if our schedule were amended to provide for a TAC in January
and the Plan Commission in February. 1 hope that this does not inconvenience you in any way and
