My name is Richard Feldt. I have been a resident of Brookshire for 40+ years.
I write this to express my opposition to the granting of a variance for a stockade
fence located at the corner of 116th St and Rolling Springs Drive. This request for
variance is on your Oct 28' agenda and appears to pertain to its height, which
currently exceeds 42 in.
This property is approximately 40 years old. I have no doubt that the current
owner was fully aware of the relationship between 116th St and his property at
the time he purchased the property. I am also certain that the value of the
property reflected this relationship. Nothing has changed which would justify
granting a variance for this fence.
The issue of non-conforming fences along Carmel streets seems to be increasing.
In particular, properties which are located on corner lots, must conform to fence
requirements between the building lines and the streets (both plurals). The fact
that one of the streets is a major arterial does not change the need to conform to
city code requirements. In fact, the code requires upgraded fence material and
design (Section 25.02.01 Of the Carmel Zoning Ordinance).
If this request for variance is granted, it will be very difficult to enforce a code
which was originally intended to protect the appearance of Carmel properties and
streets.
