BOX 171 CARMEL, INDIANA 46082 r au .r5\ ;ri �1. ; i c , w !I = cog 282014 .^:T_ it a October 26, 2014 ' / ��QQ ®1168 -' To the Zoning Board, City of Carmel On behalf of the board of directors of the Woodland Springs Neighborhood Association, I am writing to support the application by Mr. Chris Peck for a variance to accommodate the fence he erected on his property at 11605 Rolling Springs Drive. Mr. Peck's property is located in Woodland Springs, and his fence complies with the covenants of the neighborhood in which he lives. He obtained approval for the fence - before construction - from our Association's Architectural Review Committee, as our covenants require. Further, before building the fence, Mr. Peck performed other due diligence. He obtained a proper stake survey of the property to make sure the fence would be well within the utility easements. He also contacted the Carmel zoning board to obtain city fence regulations. The city directed him to read section 25.02.01, which contains no mention of the special requirements that - he later learned - may be construed to apply to the back yards of properties like his. Because Mr. Peck performed appropriate due diligence and acted in good faith based on the advice he received from the city and from our Association, and because his fence does not differ materially from a number of other fences already constructed in similar yards along the same stretch of 116th Street (both inside and outside the borders of our neighborhood), we respectfully urge you to grant Mr. Peck's application for a variance in this matter.
