Legal Drain easement and he has agreed to allow the 15' easement shown to serve this
function. He did require that the easement be called out as R. D. & U. E. (Regulated
Drain and Utility Easement) as we have now changed.
1 believe that all items of your letter dated 29 June 2001 have now been addressed.

Our office has reviewed the Secondary Plat application filed for Dixie Highway, Lot 7. The
following are comments that need to be addressed and plans updated_ accordingly:
• The Hamilton County Auditor is now Robin Mills. Please make this change on the
Commissioners' Certificate.
• The length of the iron pins set needs to be indicated on the legend. See Section 8.2 of the
Subdivision Regulations for the required length.
• In a letter to Weihe dated January 22, 2001, the Surveyor's Office requested that the Legal Drain
easement on this property be indicated on the plat. Please add this information.
• The Department is in receipt of the signed Commitments for this Replat. The original will be
returned to you for recording with the Secondary Plat.
Once these changes have been made, please produce a mylar copy for signature by this Department. Two
paper copies of the plat must be filed with the mylar prior to recording; and one mylar and three paper
copies must be returned to the Department following recording.

Per your request, I have followed up on this project and have the following comments.
1. It appears that the proposed replat splits parcels 17- 13- 02- 04 -08- 010.000 (lot 7) into
two lots (lots 7a & 7b).
2. This project is located within the watershed of the Vernon Asher Regulated Drain. In
fact storm pipes are located along both Broadway and College Avenue, SSD is
located along Broadway.
3. What is proposed for this site?
4. Depending upon what is proposed, permits (Outlet Permit, Crossing, Non-
enforcement, etc.) may be required.
5. Please show the Regulated Drain Easement on the secondary plat.

The plat you dropped off this morning still doesn't account for the additional right -of -way being dedicated long both
Broadway and North College Avenue. There is a dedication five feet in width (going from a 20 -foot to a 25 -foot half) along
Broadway and a dedication twenty feet in width (going from a 25 -foot half to a 45 -foot half) along North College Avenue
that, while included in the rights -of -way illustrated, are not accounted for as new dedications.
Aside from that omission, it appears that all other comments were addressed.

2. At such time as plans are adopted by the City of Carmel or Hamilton County that call for

3. At such time as either the City of Carmel/Clay Township Plan Commission or the Director

4. Said sidewalk system and /or curbs & gutters shall be designed to meet the requirements

5. The Applicant understands that the representations made above will survive the ownership
