Engelking Director August 15, 2000 MEMORANDUM TO: Carmel/Clay Plan Commission Members FROM: Steve Engelking, Director, DOGS RE: Council Resolution Number 08-07-00-03 Attached herewith is a Resolution from the Carmel City Council. It requires that the Carmel/Clay Plan Commission review and make a recommendation to the Council on the adoption of Exhibits A and B to the Resolution as amendments to the Zoning Ordinance, and Comprehensive Plan. It should be noted that Filing Fees were last changed in 1995, and Building Permit Fees were last changed in 1988. The increase approximates 40% across the board. The only item that varies from that increase is in the category of Structural Modification: (paragraph 10 (b)), wherein the fee for modifications of Commercial, Industrial and Institutional structures would increase significantly. The current Fee of$25.00 was inadvertently understated in 1988, and allowed to remain since that time. Generally speaking, Fees for these type facilities are greater in cost than Residential Structures, so this correction brings this item in line with the others. This will be a Public Hearing item at the September 19, 2000 Plan Commission Meeting. It is hoped that by providing this information to the members in advance of that meeting, there may be the possibility of support of a Suspension of the Rules and a vote to return this to the Council with a Favorable Recommendation on that same evening. ONE CIVIC SQUARE CARMEL, INDIANA 46032 317/571-2417 Resolution No. CC-08-07-00-03 A RESOLUTION REQUIRING THE CARMEL/CLAY PLAN COMMISSION TO PREPARE CERTAIN AMENDMENTS TO THE ZONING ORDINANCE, AS AMENDED. WHEREAS, pursuant to the Advisory Planning Law of the State of Indiana (contained in IC 36-7-4), each unit of local government that wishes to adopt land use and zoning ordinances must first approve by resolution a comprehensive plan for the geographic area over which it has jurisdiction, and WHEREAS,the 2020 Vision Comprehensive Plan (the "Comprehensive Plan") was approved and recommended by the Carmel Clay Plan Commission on August 20, 1996 and duly approved by resolution of the Common Council on September 24, 1996, and is therefore the official Comprehensive Plan of the City of Carmel and Clay Township; and WHEREAS,the Comprehensive Plan envisions that the Department of Community Services should be substantially financed not by the taxpayers of the community but by the revenue generated by reasonable filing fees charged to landowners and developers who wish to make zoning changes and/or construct structures on their property; NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Carmel, Indiana, that, pursuant to IC 36-7-4-602(b)(1), it hereby adopts this Resolution to require the Carmel Clay Plan Commission to prepare an amendment to the Carmel Clay Zoning Ordinance that substantially includes increases in the filing fee schedule as set forth in Exhibit A(containing Section 29.6 of the Zoning Ordinance, "Filing Fees"), and to promptly forward such amendment to the Council with its recommendation thereon, all in accordance with IC 36-7-4-607 and other applicable laws The amendment should also include a provision authorizing the Director of the Department of Community Services to annually adjust the filing fee schedule to reflect future increases that may occur in the Consumer Price Index published by Federal agencies. IN ADDITION, the Thoroughfare Plan of the Comprehensive Plan shall be amended by including the addition of the proposed freeway interchange at 131st Street and U.S. 31 depicted in Exhibit B, and requiring the rights—of-way to be reserved in any development plans forthcoming. After its adoption, this Resolution shall be filed in the office of the Clerk- Treasurer of the City of Carmel, who shall also forward one (1)copy of this Resolution to the secretary of the Carmel Clay Plan Commission, all in accordance with IC 36-7-4-602 (b)(1) and other applicable laws. 4 CARMEL/CLAY ZONING ORDINANCE EXHIBIT A CHAPTER 29: ADMINISTRATION 29.6 Filing Fees Applications and petitions filed pursuant to the provisions of this Ordinance shall be accompanied by the filmg fees hereinafter specified, and shall be paid to the City of Carmel and collected by the Department of Community Services: 29.6.1 Filing Fees (as amended per Z-305) 1.
