' �,� C.' ` c Mr. Majid Rastegar Majestic Residence 97` Street and Augusta Drive Carmel, IN 46032 Re: Majestic Plaza P.1 /2 cal n .0 J ( , Suite z86 One J-fanrilton County Square .Noblesville, Indiana 4606o-223o The Hamilton County Surveyor's Office, along with representatives from the county highway department, conducted an inspection of Majestic Plaza Development on April 1, 2004. The investigation of the development revealed several discrepancies from the original plan submitted by Major Engineering. Since the Majestic Plaza Development is not a regulated development, but is within the Crooked Creek Regulated Drain Watershed, the following concerns must be addressed. 1. The development's underground detention system shall be certified by the development's engineer. The certification shall be in writing and state the installed system meets the required 0.25 cfs per acre release rate for the Crooked Creek Watershed. 2. The underground detention system shall be televised to ensure proper installation and construction methods of the manufacturer were followed during the installation of the system. Also, televising will tell us how clean the system is. 3. The Developer will need to remove mismatched sections of CMP and install the 30" RCP under North Augusta Drive per the original designed plan. 4. Improvements will be required to the tributary that drains this development to Crooked Creek. The improvements shall include removal of obstructions, erosion control, bank armorment, and rip rap protection at the confluence of the tributary and Crooked Creek. These improvements were stated in Kurt Wanninger's letter to Major Engineering on October 26, 2001. ,APR 12 '04 03 :39PM P.2 /2 5. Perimeter drainage along 97th Street and North Augusta Drive is non - existent. Improvements will need to be done to facilitate positive drainage thru the site. 6. Our normal procedure to reinstate a permit is to ask for a letter explaining the situation that has caused delay in building the structure within the normal period of time That time limit is two years. In most cases we are willing to be extend a permit based on the letter, a permit history of compliance and a determination that granting more time will not adversely affect the building or our ability to secure the requirements agreed to at TAC, the commission or board Majid has had multiple violations associated with inspection procedure, county drainage issues, zoning violations with the use of a house as a construction office, and general problems coexisting with the residential neighborhood around his buildings I am not inclined to give an extension on his permit before he gives us all agreed to site, architectural and landscape requirements There is also a pending building permit application that Majid has declared himself an associated silent partner We will require the articles of incorporation to be submitted for the listed builder and hold this permit if Majid shows up as a partner I guess I am asking that we all work together and develop a check list that Majid will have to complete before I extend the permit. If you do not have issues with this project there would be no reason to respond to this e -mail If, on the other hand, you have issues that need to be addressed, please let me know and I will pass them along or send Majid your way. He also spoke to Gayle for a bit, about his workers who are presently on site. Also, I asked him about the tenant finish permit we have in the office for Subway at Lot 4 of Hazel Dell Corner. He said that he is not the builder for M & R General Contractor, but that he is a silent partner in the company. If the necessary right of way is not present, Majestic Residence will need to purchase the right of way. 2. Please include all written specifications on the plan sheets. 3 Please show the Sub Surface drains under the curbs on the plan view. 4. Please note on the plans'that decorative signs, sprinkler systems, trees, landscaping mounds, light poles or other such amenities are not permitted in the right of way. 5. Do any of the existing utilities need to be relocated? Please show all existing utilities on the plan sheets. 6. Is there sufficient drainage at the intersection of Augusta Drive and 96th Street? Please include the necessary curb elevations on the radii to insure the water will reach the roadside ditches along 96th Street. 7. Has the Hamilton County Surveyors Office has a chance to review the reconstruction plans? Please forward a copy of the plans to their office. 8. The cross section should consist of the option to be used for the reconstruction. The option chosen should be one of those listed in a letter dated August 14, 2000. 4. The design speed should be shown on the cover sheet. 5. Sub Surface drains are needed under the curbs. 6. Plan and profile sheets are needed for the storm sewer as well as any other utilities to be installed or relocated. 7. Please label and dimension the existing right of way on both sides of Augusta Drive as well as 96'° Street. Include the record instrument numbers for the right of way. 8. Please note that decorative signs, sprinkler systems, trees, landscaping mounds, light poles or other such amenities are not permitted in the right of way. 9. Please provide a sheet titled Traffic Control_ Included on this sheet should be the placement of a stop sign, street name sign and 25 MPH sign. Also include the Hamilton County Highway Department standard plans S -1, S -2 and S-3. 14. Please note further comments may be needed after the revised plans have been submitted. While these plans were a vast improvement over the original landscape plans, they were still not sufficient. Today, at 3:20 pm, I received an amended set of landscape plans. The site is currently zoned S -1, a residential zoning. The plans submitted to this office were not adequate to receive the required review. A complete set of plans including existing structures and vegetation, as well as proposed structures, landscaping and irrigation. One of the intents of the 421 Overlay Ordinance is to "promote high quality, innovative site design... that will provide this district with a special sense of place that will increase property values, protect real estate investment, spur commercial activity, and attract new business... the special sense of place shall be encouraged by means of a coordinated set of design principle for buildings, planning, landscaping, and signage." The landscape and parking plan that was submitted does not seem to fulfill this design criteria. Some of the problems include: 1. There are only 20 trees proposed for the entire site. The are buffer planting requirements, as well as requirements for landscaping within parking lots that must be fulfilled. Existing trees should be preserved to the greatest extent possible. 2. Of the 20 trees proposed, all are `Bradford' Pears. This species has several weaknesses that cause problems in parking areas. An alternative species should be chosen. In order to promote plant diversity, no more the 15% of the trees on this site should be of a single species. A list of altemative trees can be sent to you.
