HomeMy WebLinkAboutPublic NoticeNOTICE OF PUBLIC HEARING BEFORE THE CARMEL/CLAY ACVISORY BOARD OF ZONING APPEALS DOCKET NO. 14100002 Notice is hereby given that the Carmel/Clay Board of Zoning Appeals meeting on the 24th day of November, 2014 at 5:30 pm in the City Hall Caucus Rooms, 1 Civic Square, Carmel, IN 46032 will hold Public Hearing upon a Development Standards Variance application to: Vernon and Fonda Poland (Petitioners) are seeking a Development Standards Variance for the property located at: 1087 Arrowwood Drive, Carmel, IN 46033 The variance requested applies to a recently installed a traditional spear- pointed metal picket fence manufactured by the Ameristar Company and installed by Glidden Fence Company of Westfield, IN. The fence was contracted and installation begun before the Petitioners became aware that their fence was in violation of zoning ordinance chapter 25.02.01 is the section that requires a 42 inch maximum fence height in the front yard. While the fence was installed on the property’s back yard, because the Copperwood Lot 75 is a corner lot, under city zoning ordinance section 26.02.02 the part of the property adjacent to the cul- de-sac must be treated like a second front yard. Because fences do not require a building permit in advance of installation, the Petitioners were unaware of the noted ordinances until the installation of said fence had been initiated, hence, the request for variance. The fence in question, is an ornamental traditional spear-pointed metal picket fence. It was installed for the purpose of providing a safe and secure area for children and pets to play in, while keeping unwanted animals out. The fence has a height of 5 feet and does not obscure sight lines into, out of, or across the enclosed portion of this property. The installation of this fence is not precedent setting, as there are several other similar fences in type and/or stature located throughout Carmel. This fence has been approved for installation by the Copperwood Home Owners Association.
