However, at this time we cannot make any commitments as to the timing of installation of the path network. As you are most likely aware, the funds to complete the improvements within Simplicity Park are included within the approved improvements for the Legacy TIF district. Funding of the TIF will be provided in phases as additional tax producing uses are developed and bonds are sold on the open market. The first phase has already been funded covering costs related to River Road, Community Drive and Cherry Creek Blvd. We anticipate there will be 2 or 3 more phases to complete the funding, but there is no timeline. One last thing the Department needs is a letter/email from Platinum Properties (Tim Walter or other rep) explaining the situation about the path build-out into the ‘stormwater park’ and committing to the extension on the path west of this subject parcel by a certain committed to ‘build by’ date.
