FINDINGS OF FACT-DEVELOPMENT STANDARDS VARIANCE
Docket No.: 14100006 V and 14100007 V
Petitioner: DB Klain Construction, LLC
1. The approval of this variance will not be injurious to the public health, safety, morals and general welfare of the
community because:
We will be improving the area and enhancing the overall appearance of the surrounding area.
We will also be providing property tax revenue to the city, but due to the type of plans we are
building,we anticipate the occupants to be empty nesters so we won't be using the schools.
2. The use and value of the area adjacent to the property included in the variance will not be affected in a
substantially adverse manner because:
We plan on providing an abundant landscaping plan that will help provide a nice buffer between
our properties and the surrounding neighbors.
3. The strict application of the terms of the Zoning Ordinance to the property will result in practical difficulties in the
use of the property because:
Due to the east west dimensions of the land, we would not be able to provide a marketable
layout due to the depth, so the adjustment of the front building setback line allows these plans
to fit. Also in trying to keep the properties one story homes, we need to adjust the lot coverage to
the 45%.
DECISION
IT IS THEREFORE the decision of the Carmel/Clay Board of Zoning Appeals that Development Standards Variance
Docket No. 14100006 V and 14100007 V is granted, subject to any conditions stated in the minutes of this
Board, which are incorporated herein by reference and made a part hereof.
