CARMEL, IN 46032 (317) 571-2417 CARMEL TECHNICAL ADVISORY COMMITTEE MEETING MINUTES Date: Wednesday, January 21, 2015 Place: Dept. of Community Services Conference Room, 3 rd Floor, Carmel City Hall. Time: 9:00 a.m. 9:00 a.m. Docket No. 14120013 DP/ADLS: Liberty Fund Headquarters. The applicant seeks site plan and design approval for a 63,101 sq. ft. headquarters office building, on 8.5 acres. The site is located at approximately 11301 N. Meridian St. It is zoned B-6/Business and lies within the US Highway 31 Corridor Overlay Zone. Filed by Joseph Scimia of Faegre Baker Daniels LLP, on behalf of Liberty Fund, Inc. Roger Kilmer and Joseph Scimia with Faegre Baker Daniels, David Huffman with Enverity Engineering, Tony Allen and Eric Rowland from Rowland Design, and Emilio Pacheco and Chris Talley with Liberty Fund presented the project. Mr. Scimia said the developers are looking for approval to develop a single building that would serve as the headquarters for Liberty Fund. Mr. Scimia said one of the unique features of this site is that it is very heavily wooded. The developers would like to retain as many of the trees as possible. He added that the primary entry to the property would be off of Pennsylvania Street. Greg Hoyes – Hamilton County Surveyor’s Office - Letter sent. The only major comment would be to limit allowable release rates, but this comment would tie into some of the Engineering Department’s comments. Mr. Huffman said the developers are trying to minimize the dry detention ponds as much as possible. Joanie Clark – Vectren Energy - Ms. Clark asked when the project would be starting. Mr. Allen said the bid would be coming in June or July of 2015, followed by site work in the fall. Ryan Hartman – Clay Township Regional Waste - Letter sent on January 2. Mr. Hartman said a sanitary sewer application would need to be sent. Chris Ellison – City of Carmel Fire Department - Mr. Ellison asked the type of construction and the square footage of the building. Mr. Allen said the building type would most likely be 2-B, and the building would be around 63,000 square feet. Mr. Ellison asked for an estimated distance from where the water main connects to the existing water main around 111 th Street, to the spot where the main starts to go west into the property. Mr. Huffman said the length would be around 400 feet. Mr. Ellison said the hydrants would need to be spaced every 500 feet along this line, so there will need to be one added along Pennsylvania Avenue. Also, Mr. Ellison said the Fire Department Connection on the plans is obstructed by two parking spaces. Mr. Huffman said they may decide to stripe out these spots, and Mr. Ellison said, this would work, but added that another solution would be to create a fire lane. Mr. Ellison said the department is working diligently this year to make sure developers provide adequate fire department vehicle access during construction. Mr. Huffman asked if this could be a separate binder that could be removed after construction. Mr. Ellison said this would be fine, as long as it provides proper access during construction. Gary Duncan – City of Carmel Department of Engineering - Comments sent. Mr. Duncan said the biggest comment that comes to mind is the right-of-way dedication. Mr. Duncan said although this is not a large addition of dedication but there are some areas where additional right-of-way is required to comply with the thoroughfare plan. Mr. Huffman said Liberty Fund has no intention of developing the wooded area on site and would like to see it remain as a wooded area. Page 2 of 5 WWW.CARMEL.IN.GOV ONE CIVIC SQ. CARMEL, IN 46032 (317) 571-2417 Alex Jordan – City of Carmel Department of Engineering - SWPPP comments sent on January 7. The department is awaiting a response. Mr. Huffman said the property has an under-drain system with mitigated soils. David Littlejohn – City of Carmel Alternative Transportation - Letter sent. No further comments at this time. Nick Mishler – City of Carmel Building & Code Services - No comments. Angie Conn – City of Carmel Planning & Zoning - Ms. Conn said Rachel Keesling will be sending a full set of comments in the next few days. Mr. Huffman asked if there were any major concerns. Ms. Conn said the architect would need to meet the design standards for the US-31 Overlay zone. Ms. Conn said there was a question regarding the cedar screens and columns and whether this was a permitted architectural element. 9:10 a.m. Docket No. 14120014 DP Amend/ADLS: Lake City Bank, Michigan Rd. The applicant seeks site plan and design approval for a 2,623 sq. ft. bank building with drive thru, on 0.92 acres within the Bill Estes development. The site is located at the northwest corner of Michigan Rd. and 96th St., at approximately 9640 N. Michigan Rd. It is zoned B-2/Business, in the Michigan Road Overlay Zone. Filed by Paul Reis with Krieg DeVault LLP on behalf of Lake City Bank. Todd Wallace with Schneider Corporation, Laurie North with CSO Architects, and Boyd Zoccola with Hokanson Construction presented the project. Mr. Zoccola said the site currently contains two structures. One structure would be demolished and one would remain as part of phase one. Mr. Zoccola said for the time being, the existing driveways are going to remain. Greg Hoyes – Hamilton County Surveyor’s Office - Letter sent. This project does not fall within the regulated drain water shed. Joanie Clark – Vectren Energy - Ms. Clark asked for an approximate timeframe of when this project will start. Mr. Zoccola said the goal would be to break ground in the spring, with construction lasting 5 ½ or 6 months. Ms. North said the building would be occupied by September. Alexia Lopez – City of Carmel Planning & Zoning - Ms. Lopez said she has received the packets for the BZA meeting. No further comments. Ryan Hartman – Clay Township Regional Waste - Comments sent. Mr. Hartman said the department will also need a sanitary sewer application form filled out. Mr. Zoccola said there are two laterals shown on the site plan, and asked if Mr. Hartman would prefer they use the south man hole. Mr. Hartman said the south lateral is the one that makes the most sense. Mr. Zoccola added that the north lateral would be able to be used for a future building in this location. Chris Ellison – City of Carmel Fire Department - No comments. Gary Duncan – City of Carmel Department of Engineering - Comments sent. Mr. Duncan said for the drainage, approval from INDOT would be required. Also, Mr. Duncan said regarding the detention pond being adjacent to the right-of-way, some sort of barrier would be needed since it is not fifty feet away. Mr. Duncan said he would also like to have a meeting to discuss the long term access for the site and how it will be phased. Mr. Wallace said regarding the barrier to the detention pond, as it is drawn now, the north half of the detention pond is considerably higher than the road. Mr. Wallace asked about Mr. Duncan’s comment that Board of Public Works approval will be needed if modifying the curb. Mr. Duncan said whenever there is a change of use on the site, approval will be required. This site will be going from a dealership to a bank building. Mr. Duncan said the current thoroughfare plan calls for 60-feet, so that is what the department will require. Mr. Wallace said finally, there was a comment regarding the INDOT right-of-way extending across the 96 th Street frontage. Mr. Duncan said this also relates to the previous comment about the right-of-way width, and knowing exactly how far back the City does not control. Mr. Wallace asked about the multi-use path and bike lane together. Mr. Duncan said in order to widen the road for the bike lane, the curb would need to be moved. City Councilman Kevin Rider said if this gets to Special Studies Committee, the project would require a bike lane or a multi-use path, but the Committee will no longer discuss both a bike lane and a path together. Mr. Rider said if departments are asking for both a bike lane and path together during TAC, they need to stop. Mr. Duncan said the department is basing this requirement on the Comprehensive Plan. Mr. Rider said the departments need to use common sense, and the Comprehensive Plan needs to be changed. Mr. Rider added that the Committee hates bike lanes, and they should only be done if there is no other option. David Littlejohn – City of Carmel Alternative Transportation - Letter sent. No further comments. Mr. Wallace asked if the path can connect at the corner of the property instead of two separate accesses into the site. Mr. Littlejohn said this could be acceptable, and added that although the department generally prefers direct access to the front door, this could be acceptable because of the direct access to bike parking. Nick Mishler – City of Carmel Building & Code Services - No comments. Angie Conn – City of Carmel Planning & Zoning - Comments were sent on January 8. The department is awaiting an official response. 9:20 a.m. Docket No. 14120011 DP Amend/ADLS Amend: Tom Wood Management, Parking Lot Expansion. The applicant seeks site plan and design approval for a 102-space parking lot addition, landscaping, and detention pond. The site is located at 9820 Association Ct., on 3.83 acres. It is zoned B-3/Business. Filed by Paul Reis of Krieg DeVault LLP, on behalf of Tom Wood, Inc. Roger Ward with Roger Ward Engineering presented the project. Mr. Ward said Tom Wood’s intent would be to move the corporate headquarters into this building. Mr. Ward said this project would add 102 parking spots for a total of 166 parking spots on this site. Greg Hoyes – Hamilton County Surveyor’s Office - Letter sent. This is not in a regulated drain water shed. Joanie Clark – Vectren Energy - No comments. Alexia Lopez – City of Carmel Planning & Zoning - No comments. Chris Ellison – City of Carmel Fire Department - No comments. Gary Duncan – City of Carmel Department of Engineering - Comments sent. One question is whether the northern area on the plan is actually a detention area. Mr. Ward said this area is only a flat ditch. Mr. Duncan said in terms of drainage, he cannot imagine this area would be an issue. Mr. Ward said the plan intentionally stayed away from this area. Mr. Duncan asked if the site drains to the southeast, to which Mr. Ward replied that it does. Alex Jordan – City of Carmel Department of Engineering - SWPPP comments were issued on January 15. Nick Mishler – City of Carmel Building & Code Services - No comments. Angie Conn – City of Carmel Planning & Zoning - Comments sent. Department is awaiting an official response. 9:30 a.m. Docket No. 14120012 DP/ADLS: Butler Maserati, Alfa Romeo, Fiat. The applicant seeks site plan and design approval for a new 21,967 sq. ft. auto dealership building with inventory parking and landscaping, on 1.43 acres. The site is located at 4200 E. 96th Street, west of Randall Drive. It is zoned B-3/Business. Filed by Joe Calderon of Bose McKinney & Evans LLP, on behalf of 4198 96th Street LLC. Joe Calderon with Bose, McKinney & Evans, Buzz Weisiger with CWC Inc, Andrew Taylor and Gene Beiermann with American Structurepoint, and architect Michael Belay presented the project. Mr. Calderon said this site is just west of the Hyundai dealership, and will feature three brands, each with their own showroom. Mr. Calderon said the public hearing for this project will be held on February 17, and official notices to adjacent property owners will be sent out this week. Greg Hoyes – Hamilton County Surveyor’s Office - Letter sent. This project is not in a regulated drain water shed. Joanie Clark – Vectren Energy - Ms. Clark asked when the project would be starting. Mr. Wiesiger said the project would probably start when final approval is received from everyone, with a goal of April. Ms. Clark said an AutoCAD file would be required, as well as load information. Alexia Lopez – City of Carmel Planning & Zoning - No comments. Chris Ellison – City of Carmel Fire Department - Mr. Ellison said since the building is protected by a sprinkler system, the fire department connection (FDC) would need to be identified on the plans. Gary Duncan – City of Carmel Department of Engineering - Comments sent. Mr. Duncan said the mitigation will need to be discussed, and he views it the same as detention. Mr. Duncan said if there was no detention shown on the site, the department would not allow development on the site until this was added. As it stands, there is no mitigation on the site, and it will need to be addressed. Mr. Wiesiger said there is a bond in place for this work to be done. Mr. Duncan said he understands there is a bond, but the work has been allowed to continue to this point with the mitigation not in place, and this is now an entirely new project on the site with the mitigation still not complete. Mr. Wiesiger said the agreement was for the mitigation to be completed by July. Mr. Duncan said this agreement was for the Butler Hyundai project, but this is a new project, and if it is to be approved, the mitigation would need to be done earlier than July. City Councilman Kevin Rider said when this project reaches Special Studies Committee or Plan Commission, if the total plan is not done and scheduled for construction, this project will not be discussed, and will be tabled. Mr. Rider said the fact that the Certificate of Occupancy was issued for the Hyundai dealership on a temporary basis without a set plan, drove the Committee nuts. Mr. Rider added that nothing else will happen on this site until everything is done and in writing. Mr. Wiesiger said the developers would be building what is on the plans, based on the bonding in place. Mr. Rider said he will not accept bonding, and the project will only proceed when the mitigation is in the process of being built, if not completed. Ms. Conn said there may be some variances required for signage. 9:40 a.m. (SU) Mercy Road Church, Merchants’ Pointe . The applicant seeks the following BZA special use approval for a place of worship in an existing building in a business district: Docket No. 14120010 SU (ZO Chptr 19.02) Special Use: Place of Worship in B-8 District. The site is located at 2381 Pointe Parkway (in the former Border Books site), and is zoned B-8/ Business within the Keystone Pkwy Overlay Zone. Filed by Josh Husmann with Mercy Road Church. Nick Sefton and Josh Husmann with Mercy Road Church, Dennis Whitaker with Handymans, and Scott Moore with Moore2 Architecture presented the project. Greg Hoyes – Hamilton County Surveyor’s Office - No comments on the use variance. Joanie Clark – Vectren Energy - There is already gas service on the site, and since there is no additional load, nothing will be required. Alexia Lopez – City of Carmel Planning & Zoning - No comments. Chris Ellison – City of Carmel Fire Department - Mr. Ellison said this involves a change of use from a “Mercantile” occupancy to “Assembly” occupancy, so the developers will need to meet the Indiana Building Code for change of use. Mr. Ellison said this probably will mainly affect exiting requirements, and added that when building plans are submitted to the state and to the City for building permits, they will need to show a detailed life safety plan. Mr. Ellison said there is an existing fire alarm system as well as a sprinkler system. These would be subject to testing, and any deficiencies would need to be corrected. Gary Duncan – City of Carmel Department of Engineering - Mr. Duncan asked if there would be exterior site work done in the future. Mr. Moore said this would all be interior work, with the only exterior changes being signage related. Alex Jordan – City of Carmel Department of Engineering - No comments. David Littlejohn – City of Carmel Alternative Transportation - Only concern was regarding bike parking. Mr. Moore said this parking is in the plans now. Nick Mishler – City of Carmel Building & Code Services - Mr. Mishler said relating to Mr. Ellison’s comments, the state release will need to be obtained before the developers can apply for building permits. Angie Conn – City of Carmel Planning & Zoning - Ms. Conn said regarding the signage that was mentioned earlier, the developers will need to work with Alexia Lopez to gain approvals. Mr. Sefton said the signs will most likely be the same size as the sign Borders previously used at this location.
