ACCEPTANCE OF DEDICATION & DEED OF PUBLIC RIGHTS -OF -WAY
WHEREAS, the foregoing Grantor having filed with the City of Camtel, Indiana ("City"), its
Dedication and Deed of certain real property ( "Property ") to the City for the purpose of establishing
City rights -of -way, which Dedication and Deed is attached hereto and incorporated herein as
Exhibit "A & B" hercinabove set forth;
AND WHEREAS, the City believes that said fee simple conveyance of property is.desirable and
necessary and in the City's best interests;
NOW THEREFORE, the City, by and through its Board of Public Works and Safety, hereby
accepts said Dedication and Deed, and orders that the Instrument of Dedication and Deed described
herein be recorded in the Recorder's Office of the County of Hamilton, State of Indiana, and that
said described real property be, and the same hereby is, declared open and dedicated to the City.

THIS INDENTURE WITNESSETH:

(Jointly and individually the "Grantor "), the fee simple owner(s) of the following described real
property ( "Property ") described in attached Exhibits A & B, incorporated herein by this reference,
which Property is located in the City of Cannel, Hamilton County, State of Indiana, hereby grants,
conveys and warrants in fee simple and with no reversionary rights whatsoever retained, all of
Grantor's rights, title, and interest in the Property, to the City of Carmel, Indiana ( "Grantee "),
subject to all existing easements and rights -of -way of record, for the sum of One Dollar ($1.00) and
other good and valuable consideration, the receipt and sufficiency of which are hereby
acknowledged.
The person executing this Dedication & Deed of Public Rights -of -Way on behalf of a party hereto
represents that he /she has the authority to bind that party to the terns and conditions set forth herein
and that all necessary action therefore has been taken.
This conveyance of real estate is not subject to Indiana gross income tax.

Being a part of the Northeast Quarter of Section 35, Township 18 North, Range 3 East of the
Second Principal Meridian in Hamilton County, Indiana, being more particularly described as
follows:
Commencing at a Harrison monument marking the Southwest corner of the said Northeast
Quarter Section; thence North 00 degrees 10 minutes 1 I seconds East (assumed bearing and
basis) along the West line of the said Quarter Section a distance of 510.08 feet; thence North 89
degrees 06 minutes 53 seconds East for a distance of 1327.47 fret (1326.90' deed) to the East
line of the West half of the said Quarter Section; thence along said east line North 00 degrees
15 minutes 39 seconds East for a distance of 32.01 feet to the north right of way line of City

RE: RIGHT OF WAY DEDICATION — "POINT BLANK RANGE & GUN SHOP " — CITY CENTER DRIVE
Dear Board Members:
Mr. Thomas Willingham, Carmel Real Estate Holdings, LLC., has requested the Board sign the Dedication
of Public Right of Way documents as presented to the Board for approval.
These documents dedicate the right of way for City Center Drive on the south side of the Point Blank
Range and Gun Shop project, located in part of the N.E.'''/ of Section 36, Township 18 North, Range 3
East of Clay Township, Hamilton County, Indiana. Total acreage dedicated will be .026 acres (1150 S.F.)
On behalf of the City of Carmel, I would like to thank Mr. Willingham and Carmel Real Estate Holdings
for this Dedication of Right -of -Way. I recommend the Board accept and sign these documents for this
dedication.
