Present for the Petitioner: Jason McNiel, Ice Miller • The location is Zoned 135 and is in the US 31 Overlay • With construction of US 31 and 103`d street the property is not out of compliance with zoning • Construction of US31 affected the 30ft greenbelt • Construction of 103'd affected the minimum buffer yard requirement • The parcel coverage ratio has gone from 65% to 72% due to the reduction of the land • It has had the same use for 20 years, • They have been affected by the takings of the City and State, there is no change in the use of the property Department Report: Angie Conn • They just need to come into compliance due to the road projects encroachments.
