RE: Request for Encroachments (fences in the easements) at 13440 and 13426 Lost Creek Lane, The Lakes at
Towne Road, Lots 41 and 42
Dear Board Members:
On February 3, 2010, the Board considered a request for a fence encroachment into a Drainage Easement and a
Landscaping Maintenance and Access Easement at 13440 Lost Creek Lane. A copy of the original packet of
information is included for your reference. The petitioner, Mr. Terry Kemp, did not attend the meeting on February
3, 2010.
The Board approved the encroachment into the Drainage Easement, but not the Landscaping Access and
Maintenance Easement. Engineering was to prepare the proper Consent -to- Encroach and present to the Board for
approval
After the meeting, Engineering became aware that the petitioner had not been notified that his request was being
considered at the February 3, 2010 meeting. Engineering has experienced a change in staff with the retirement of
Dick Hill and the staff now responsible for his duties was not aware that they needed to provide such notice to the
petitioner. Therefore, Mr. Kemp has requested that the Board consider his request further and that he be allowed to
address the Board (his request is attached with the original plot plan).
In addition to Mr. Kemp, the adjacent property owners, Dr. and Mrs. Blake and Michelle Wiseman, 13426 Lost
Creek Lane, are also requesting Board of Public Works and Safety approval for installing a wrought -iron fence into
the Drainage Easements and Landscape Maintenance and Access Easements located along their rear property lines.
A plot plan for the improvements to the Wiseman property is attached. The Department of Engineering has reviewed
the requests for Consents to Encroach and has informed the petitioners that an encroachment into the Drainage
Easements would be supported. However, upon review of these requests by the Department of Connnunity Services'
Urban Forester, it was determined that encroachments into the landscape easement would not be supported.
The Department recommends that the Board support the requested encroachments into the drainage easements but
deny their requests to encroach into the 10 -foot landscape easement.

To whom it may concern;
I am requesting an opportunity to address the board to reconsider their decision
not to grant a variance to install the proposed fence within the landscape easement on my
property. I was not notified of the time and place the board would consider my request.
My next -door neighbors Blake and Michele Wiseman would like to be present at
