This reduction would be based on the actual percentage of sidewalks completed in the section to date. The City of Carmel Subdivision Control Ordinance does not address this option. However, there have been not instances in the past when the Board sthas approved urrentoeconomic climate of the housing and f nancial object to Platinum Properties request, given markets and the reduction in Building Permit requests being experienced. My approval recommendation would be contingent upon the Developer adhering to the following conditions: • This approval shall apply to Performance Guarantee posted for the construction of Internal Sidewalks in Long Ridge Estates Section 1 only. • The Developer provides written certification from the design engineer regarding the completion percentage for the reduction requested. • The Performance Guarantee amount cannot be reduced to an amount lower than 10% of the original Performance amount. This is the requirement for 3 -year Maintenance Guarantees. The total bond amount for Internal Sidewalks in Long Ridge Estates Section 1 is $99,200.00. • The Developer will assure that bond reduction riders are submitted by the Surety of the bond. This rider shall be for no less than $9,920.00. Upon 100% completion of the builder's internal sidewalks in Long Ridge Section 1, the Developer may request release of the subject Performance Guarantee. However, the 3 -year Maintenance Guarantee amount must be calculated on 10% of the original Performance Guarantee amount, not the reduced amount. A copy of the original packet of information is included for your reference. The petitioner, Mr. Terry Kemp, did not attend the meeting on February 3, 2010. The Board approved the encroachment into the Drainage Easement, but not the Landscaping Access and Maintenance Easement. Engineering was to prepare the proper Consent -to- Encroach and present to the Board for approval After the meeting, Engineering became aware that the petitioner had not been notified that his request was being considered at the February 3, 2010 meeting. Engineering has experienced a change in staff with the retirement of Dick Hill and the staff now responsible for his duties was not aware that they needed to provide such notice to the petitioner. Therefore, Mr. Kemp has requested that the Board consider his request further and that he be allowed to address the Board (leis request is attached with the original plot plan). In addition to Mr. Kemp, the adjacent property owners, Dr. and Mrs. Blake and Michelle Wiseman, 13426 Lost Creek Lane, are also requesting Board of Public Works and Safety approval for installing a wrought -iron fence into the Drainage Easements and Landscape Maintenance and Access Easements located along their rear property lines. A plot plan for the improvements to the Wiseman property is attached. The Department of Engineering has reviewed the requests for Consents to Encroach and has informed the petitioners that an encroachment into the Drainage Easements would be supported. However, upon review of these requests by the Department of Conmiunity Services' Urban Forester, it was determined that encroachments into the landscape easement would not be supported. The Department recommends that the Board support the requested encroachments into the drainage easements but deny their requests to encroach into the 10 -foot landscape easement.
