FINDINGS OF FACT - DEVELOPMENT STANDARDS VARIANCE

The approval of this variance will not be injurious to the public health, safety, morals and general welfare of
the community because:
the proposed signs will be proportionate to the building and site, and will not interfere with the visionary field
of drivers in vehicles in public rights of way. Furthermore, the signs will improve the public health, safety
properly indentifing each brand location within the building, by reducing potential confusion.
The use and value of the area adjacent to the property included in the variance will not be affected in a
substantially adverse manner because:
the adjacent property to the east is a car dealership which shares common ownership with the
and the adjacent property to the west and north remains undeveloped. The proposed sign will not
interfere with visibility of any adjacent property.
3. The strict application of the terms of the Zoning Ordinance to the property will result in practical difficulties
in the use of the property because:
the building will be housing three (3) distinct brands, which is not contemplated by the sign ordinance,
there is a service department with two sided entry/exit, and the shape and location of the property
results in only one (1) street frontage, although access is gained from a secondary street frontage (Bauer Drive).
DECISION
IT IS THEREFORE the decision of the Carmel /Clay Board of Zoning Appeals that Development Standards
Variance Docket No. is granted, subject to any conditions stated in the minutes
of this Board, which are incorporated herein by reference and made a part hereof.
