HomeMy WebLinkAboutD-398 Amend 2.12 Employee Fringe Benefit Program • • ORDINANCE Z-398 AN ORDINANCE AMENDING SECTION 2.12 EMPLOYEE FRINGE BENEFIT PROGRAM, OF THE CARMEL CITY CODE WHEREAS, it is in the best interest of the City of Carmel , Indiana, to amend the fringe benefit program of the City of Carmel , NOW THEREFORE, BE IT ORDAINED by the Common Council of the City of Carmel , Indiana that Section 2.12 of the Carmel City Code be amended as follows: (a) DEFINITIONS: For purposes of this ordinance, the following definitions shall be used: FULL TIME PERMANENT EMPLOYEE - Shall be an employee scheduled to work a minimum of 372hours a week on an unlimited time basis. PART TIME EMPLOYEE - Shall be an employee who works on a regular basis less than 37=-hours per week. TEMPORARY EMPLOYEE - Shall be persons employed for a limited term. PROBATIONARY EMPLOYEE - Shall be an employee hired into a position with a three-month probationary period. This probationary period is intended as an intregal part of the examination process and before hiring, the employee shall be advised of the probationary period and its use in the examination process. During this period of time the department head shall observe the employee's ability to perform the various duties and requirements of the position and shall make evaluation of his/her performance. Termination and/or transfer action may be taken at any point during this period without recourse to the grievance procedure. (b) HEALTH INSURANCE - The City will contribute 75% Of the premiums for single and family health insurance plans. All full time probationary, permanent and police and fire department employees shall be eligible for health insurance coverage after 30 days employment with the City. (c) LIFE INSURANCE - The City provides life insurance in the amount of $10,000.00 and $10,000.00 accidental death and dismemberment insurance for all full time employees. Employees other than probationary employees shall be eligible for said insurance after 30 days employment. Probationary employees shall be eligible for said insurance following their probationary period. The City shall provide life insurance in the amount of $15,000.00 and $15,000.00 accidental death and dismemberment insurance for all department heads, the Mayor and the Clerk-Treasurer. The City shall pay all but $1.00 of the annual premium cost. • That the following benefit programs shall apply to all departments and agencies except regular fire and police personnel who shall be governed by their respective rules and regulations. (d) VACATION - Each full time employee will earn one day of vacation for each month of employment per year for a total of 12 days per annum. For employees who have completed five years of service with the City, effective with the first month next following the 5th anniversary of employment, the employee will earn 11- days vacation per month or a total of 18 days per annum. Unused vacation as of December 31st each year beginning December 31, - 1984, may be carried forward and accumulated to a maximum of ten days. Unused vacation is eligible to be paid to the employee upon leaving employment. Accumulated vacation is transferable between any of the City's departments. An employee's termination date may hot be extended to include accrued and unused vacation time. The employee's termination date shall always be the last day worked. (e) SICK LEAVE - Full time permanent employees will earn sick leave at the rate of one day per calendar month beginning the first full month after employment date. Unused sick leave may be accumulated and carried over into the next year up to 30 days. Sick leave may be taken in not less than one-half day periods. A doctor's certificate may be required after extended illness or at any time at the discretion of the department head. Failure to furnish such certificate shall be evaluated to determine whether the employee is eligible for sick pay or not. Anyone proven to have taken a sick: day for purposes other than illness will be subject to disciplinary action and possible dismissal . Failure of any employee to notify his or her supervisor each day within two hours after the work shift starts shall cause the employee to be ineligible for sick pay. Unused sick leave will not be paid to employees upon leaving employment with the City. (f) VACATION AND SICK LEAVE CREDIT - Vacation and sick leave days shall be earned from the first of the month if hired by the 15th of the month. For employees hired after the 15th of the month, vacation is earned beginning with the first of the succeeding month. Vacation and sick days shall be credited at the end of each month and may not be taken in advance without written approval by the department head to the Clerk-Treasurer's office for the employee file. Probationary employees shall earn vacation and sick leave on the schedule as set out herein but shall not be entitled to use accumulated vacation or sick leave until permanent status has been attained. -2- • • (g) NATIONAL GUARD AND RESERVE DUTY - Any City employee who is a member of the National Guard or Reserves on active duty or training may be excused from his work assignment for up to 15 days annually without loss of pay. (The City may elect to pay the difference between active duty pay and the regular salary or wage. ) The time away 'from the job shall not be charged against the employee's vacation allowance. (h) SPECIAL LEAVE - Up to three days personal leave may be granted annually for a death in the immediate family or a major illness of a member of the immediate family. The employee's supervisor may request evidence from a physician to support the major illness. Immediate family includes mother, father, brother, sister, spouse, children and grandparents. This leave cannot be accumulated or carried forward to the next year. (i) JURY DUTY - Any employee who may be required to serve on a petit or grand jury shall be reimbursed for the difference between jury pay and the employee's daily rate. (j) LEAVES OF ABSENCES - Leaves of absences for pregnancy may be requested by full time permanent employees. No pregnancy leave shall be fora period longer than 90 calendar days. . Full time permanent employees may receive leave of absences for other purposes subject to the approval of the respective elected official , Board of Public Works or other administrative body. Upon approval , the employee shall be eligible to be reinstated in the same or comparable position upon returning to work. Vacation and sick leave allowance will not be earned while the employee is on leave. However, employment records will not reflect a break in continuous service. Accordingly, eligibility for benefits that require continuous service will not be affected during the period that an employee is on an approved leave. Upon approval of the Board of Public Works, group insurance benefits may continue while the employee is on leave, however, employees will be billed by the City and will be responsible for timely payment of those insurance premiums. (k) RETIREMENT - All full time permanent employees who work or expect to work 600 hours or more per year must join the Public Employees Retirement Fund (PERF) after completion of one year employment. Any employee may join immideately upon completion of the probationary period. Three percent of the gross wages is deducted from the salary as the employee's share. Employee contributions may be refunded upon termination of employment and application to PERF. • (1 ) HOLIDAYS - Each year the Mayor shall declare a holiday schedule which shall determine the paid holidays of the City employees. The Mayor may declare the City to be closed for general business purposes on other specific days due to weather, special events or for the general health and welfare of the City employees. All permanent full time employees shall receive their regular daily salary or wage for the declared holidays, -3- . • • �• 0 or if required to work on declared holiday, shall be entitled to a compensatory day off. To be eligible for holiday pay an employee must work their regularly scheduled day before and after the holiday unless officially excused. Holidays which occur during vacation shall not be charged against accrued vacation time. (m) OVERTIME - All employees except department heads shall be paid time and one-half for hours worked over 40 hours in the work week, or one and one-half hours compensatory time off for each overtime hour worked in the same work week. Compensatory time earned shall be used at the discretion of the department head. Overtime shall be worked on an emergency basis and must have prior approval of the department head. All overtime must be within the budgetary limitations. The department head shall determine whether compensatory time off or paid overtime shall apply. ' (n) LONGEVITY - An employee must have been in the full employ of the City a minimum of six months during a year to receive a year's credit on longevity remuneration which shall be computed as of the end of the year for the entire ensuing year. Longevity pay shall be added to the employee's annual salary on an individual basis at a rate of $150.00 per year not to exceed twenty (20) years. (o) WORKMEN'S COMPENSATION - All employees are covered by the provisions of the state's workmen's compensation laws. The City may, by vote of the Board of Public Works on an individual basis, supplement the workmen 's compensation payments to permit the employee to receive his normal "take home" pay. IT IS FURTHER ORDAINED by the Common Council of the City of Carmel that Y Y the official records of the employees affected by this Ordinance shall be kept in the office of the Clerk-Treasurer and that the Board of Public Works and Safety may adjust any personnel policy not specifically set by law or ordinance at any time with adequate notice to those employees affected, and to the Common Council of the City of Carmel .
