HomeMy WebLinkAboutD-2207-15 Amend 8-38 Speed Humps Sponsor: Councilor Sharp ORDINANCE NO.D-2207-15 AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA,AMENDING CARMEL CITY CODE §8-38 WHEREAS, the City of Carmel, Indiana,has the authority to establish the requirements for installing a speed hump pursuant to Carmel City Code Chapter 8, Article 4, Section 8-38(b); and WHEREAS, the Common Council desires to amend Section 8-38(b) in order to eliminate the requirement that speed humps only be placed on a two-lane local or residential street; and WHEREAS, it is in the public interest Cannel to amend the City Code in this manner. NOW, THEREFORE, BE IT ORDAINED,by the Common Council of the City of Cannel, Indiana, as follows: Section 1. The foregoing Recitals are incorporated herein by this reference. Section 2. Carmel City Code Section 8-38(b) shall be amended as follows: (b) Speed Humps should only be installed in locations where all of the following conditions are met: (i) there is a demonstrated traffic or speeding problem and alternate measures have not sufficiently addressed the problem; (ii) it is not anticipated that the installation of the Speed Hump will cause the diversion of significant amounts of traffic to another local or residential street; (iii) the road slope and curvature allow for safe installation; (iv) the current posted speed limit on the street where the Speed Hump is to be placed is no greater than 30 m.p.h.; (v) the average daily traffic (ADT) on the street where the Speed Hump is to be placed is no greater than 3,000 vehicles per day(VPD) and no less than 200 VPD; and, (vi) the installation of the Speed Hump is deemed advisable by the City Engineer or his designee, based upon sound engineering judgment. When more than one Speed Hump is to be installed on a street, the Speed Humps should be spaced between 250 and 600 feet apart, and should not be placed on City blocks or cul-de-sac streets that are less than 500 feet in length. Section 3. All other current provisions of City Code Section 8-38 shall remain in full force and effect and are not affected by this Ordinance. If any portion of this Ordinance is for any reason declared to be unconstitutional or invalid, such decision shall not affect the validity of the remaining portions of this Ordinance so long as enforcement of same can be given the same effect. Section 5.
