A Review, Update and Preview The United States Supreme Court regularly addresses search and seizure issues that are critically important to judges and other stakeholders handling traffic related cases. This discussion oriented presentation will consist of an overview of the seminal Fourth Amendment decisions relating to impaired driving/traffic law enforcement as well as detailed consideration of the most recent and significant Supreme_Court cases,including Missouri v.McNeely in 2013,Navarette v. California in 2014,and others. Considerable attention also will be given to the"Exclusionary Rule"and how exceptions based on good faith and mistakes continue to evolve. Finally,there will be a preview of traffic related Supreme Court cases that will be forthcoming in the near future,such as Heien v. North Carolina(reasonable mistakes of law)and Rodriguez v. U.S. (duration of traffic stops/de minimis doctrine). 9:45 am -11:OOam Hon. Pamila Brown Immigration 101 As the United States becomes more culturally diverse it is important that those handling traffic court cases understand all issues involved in adjudication of these complex cases. This session will look at immigration issues,including increased availability of driver's permits by those in the country illegally, language issues, use of T and U visas,employment issues,and collateral consequences. A discussion of Padilla v Kentucky will be included. 11:15 am—12:30 pm Hon.Karl Grube,State of Florida,Senior Trial Courts Judge Resolving Ethics Issues in the Adjudication, Prosecution, and Defense of Traffic Violations Ethics issues that arise in traffic court cases can impact judges, prosecutors,and defense attorneys. These issues are no less serious than those in other courts,but they are sometimes overlooked due to the fast pace and heavy caseloads typical of traffic courts. Thursday,March 5 8:00am-9:15 am Mr.David Teater,Senior Director, National Safety Council Cell Phone Distracted Driving—A National Public Health and Safety Epidemic This presentation will cover the history and rapid adoption of mobile communications technology and its impact on traffic safety,the science of driver distraction,and how mobile device use while driving degrades driver performance,common misperceptions about cell phone driving distraction,employer response and the need for policies prohibiting employee cell phone use while-driving, public opinion of cell phone driving,and potential technology solutions. 9:30 am—10:45 am Hon.Steve Smith,361"District Court(TX) Dealing with the Media: Right, Wrong and Otherwise During this lively and humorous presentation,judges will learn how the media cover the courts and how to properly respond to media inquiries within the bounds of the Code of Judicial Conduct. 11:00 am—12:15 pm Robert Johnson, Ph.D., F-ABFT,Tarrant County(TX)Medical Examiner's Office Drugs,Alcohol,and Driving: A Shift from Alcohol to Drug-Impaired Drivers Toxicological results from DWI cases have changed over the last few years. Where alcohol was once responsible for the overwhelming majority of DWI arrests, illicit and prescription medications now make up a large percentage of those cases. With the move towards the legalization of marijuana drug-related DWI cases will only increase. The challenges of drug-related DWI cases will be discussed and contrasted with the classical alcohol-only DWI arrest. 1:45 pm—3:00 pm Hon.Neil Edward Axel,District Court of Maryland(retired) Impaired Driving Cases: The Impact of Drugs and the Legalization of Marijuana Recent changes in marijuana laws and the continued use of other drugs have a significant impact on highway safety and the handling of impaired driving cases in the courtroom. This presentation will highlight some of the issues presented in drugged driving cases. 3:15 pm—4:30 pm Mr. Warren Diepraam, First Assistant,Waller County(TX) District Attorney's Office Prosecuting the Drugged Driver This presentation will highlight a growing trend of drugged driving cases and the problems they present to local government agencies. In addition,there will be a focus on Drug Recognition Expert(DRE)cases and the law as well as legal hurdles faced in admitting evidence. Lastly, unique problems related to marijuana legalization will be discussed. b r Friday,March 6 5:00 am—9:15 am Hon.Laura A.Weiser,Judicial Resource Liaison,Texas Center for the Judiciary DWI Courts—The Promise and the Practice This course will focus on the creation and sue of DWI Courts to reduce the number of repeat DWI offenders. It will focus on the ten guiding principles of DWI Courts and the tools these courts use to achieve a successful outcome for the offenders who participate. 9:30 am—10:45 am Hon.Phyllis McMillen,6`h Circuit Court,Oakland County,MI,ABA/NHTSA Judicial Outreach Liaison Impaired Driving Risk Assessment.Reducing Recidivism This session will provide an overview of risk factors and characteristics that have been identified as potential indicators of repeat impaired driving. Risk assessment survey tools that are currently available will be reviewed as will the use of screening and assessment to determine appropriate treatment referrals. 11:00 am—12:15 pm Hon.Laura Weiser, Hon. Phyllis McMillen Enhancing Community Safety. Sentencing in Traffic Cases Persons who drive while impaired or districted,drive on a suspended license,and/or speed or drive recklessly all pose a serious threat to the safety of a community. This session will look at sanctions and interventions that can be included in a sentence to attempt to reduce the threat of these high risk drivers.
