A Review, Update and Preview The United States Supreme Court regularly addresses search and seizure issues that are critically important to judges and other stakeholders handling traffic related cases. This discussion oriented presentation will consist of an overview of the seminal Fourth Amendment decisions relating to impaired driving/traffic law enforcement as well as detailed consideration of the most recent and significant Supreme_Court cases,including Missouri v.McNeely in 2013,Navarette v. California in 2014,and others. Considerable attention also will be given to the"Exclusionary Rule"and how exceptions based on good faith and mistakes continue to evolve. Finally,there will be a preview of traffic related Supreme Court cases that will be forthcoming in the near future,such as Heien v. North Carolina(reasonable mistakes of law)and Rodriguez v. Where alcohol was once responsible for the overwhelming majority of DWI arrests, illicit and prescription medications now make up a large percentage of those cases. With the move towards the legalization of marijuana drug-related DWI cases will only increase. It will focus on the ten guiding principles of DWI Courts and the tools these courts use to achieve a successful outcome for the offenders who participate. 9:30 am—10:45 am Hon.Phyllis McMillen,6`h Circuit Court,Oakland County,MI,ABA/NHTSA Judicial Outreach Liaison Impaired Driving Risk Assessment.Reducing Recidivism This session will provide an overview of risk factors and characteristics that have been identified as potential indicators of repeat impaired driving. Risk assessment survey tools that are currently available will be reviewed as will the use of screening and assessment to determine appropriate treatment referrals. 11:00 am—12:15 pm Hon.Laura Weiser, Hon. Phyllis McMillen Enhancing Community Safety. Sentencing in Traffic Cases Persons who drive while impaired or districted,drive on a suspended license,and/or speed or drive recklessly all pose a serious threat to the safety of a community. This session will look at sanctions and interventions that can be included in a sentence to attempt to reduce the threat of these high risk drivers.
