ORDINANCE D-2198-14
AS AMENDED
AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL,INDIANA,
ADDING CHAPTER 2,ARTICLE 1, SECTIONS 2-5(i) AND 2-8.1, CHAPTER 2,ARTICLE 2,
SECTION 2-21(c), CHAPTER 2,ARTICLE 5,SECTIONS 2-184(2)(c) and 2-188(b)(9),AND
CHAPTER 3-42(d) TO THE CARMEL CITY CODE
WHEREAS, pursuant to Indiana Code 36-7-11-4, the Common Council of the City of Carmel,
Indiana ("Council"), has established various commissions and boards and assigned them certain duties
and responsibilities; and
WHEREAS, the Council now finds that it is in the public interest, in furtherance of open and
transparent government, and necessary in order for the Council to maintain proper oversight, for the
various commissions and boards to report to the Council on their activities and to answer questions
regarding those activities.
NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of Carmel,
Indiana, as follows:
Section 1. The foregoing Recitals are incorporated herein by reference.
Section 2. Chapter 2, Article 1, Section 2-5(j) of the Carmel City Code should be and the same is
hereby added to the Carmel City Code and shall read as follows:
"(j) Quarterly Report to Council. The Economic Development Commission shall present to the
Council a quarterly written report that provides a detailed and full accounting of the Commission's actions
and activities during the immediately preceding 90 day period. This report shall be presented to the
Council at its second meeting in February, May, August and November, by placing a copy of the same in
each Councilor's individual Council packet and by having a Commission member present at each such
Council meeting to orally present the report and to answer any questions raised about the report and/or the
activities of the Commission. Minutes of each meeting shall be provided to each council member via
email and shall be placed on the City website."

Section 3. Chapter 2, Article 1, Section 2-8.1 of the Carmel City Code should be and the same is
hereby added to the Carmel City Code and shall read as follows:
"Pursuant to I. C., 36-7-14.5-7, the City Redevelopment Authority (the "Redevelopment
Authority"), is hereby created as a separate body corporate and politic and as an instrumentality of the City
for the purposes and to exercise the powers set forth in the Act or otherwise granted by law. The
Redevelopment Authority shall be governed by a board of directors consisting of three members, each of
whom shall be appointed by the Mayor of the City. The Redevelopment Authority shall present to the
Council a bi-annual written report that provides a detailed and full accounting of the Redevelopment
Authority's actions and activities during the immediately preceding 180 day period. This report shall be
presented to the Council at its second meeting in January and July, by placing a copy of the same in each
Councilor's individual Council packet and by having a Redevelopment Authority member present at each
such Council meeting to orally present the report and to answer any questions raised about the report
and/or the activities of the Redevelopment Authority. Minutes of each meeting shall be provided to each
council member via email and shall be placed on the City website."
Section 4. Chapter 2, Article 2, Section 2-21(c) of the Carmel City Code should be and the same
is hereby added to the Carmel City Code and shall read as follows:
"(c) Bi-annual Report to Council. The Carmel Cable and Telecommunications Commission shall
present to the Council a bi-annual written report that provides a detailed and full accounting of the
Commission's actions and activities during the immediately preceding 180 day period. This report shall
be presented to the Council at its second meeting in April and October, by placing a copy of the same in
each Councilor's individual Council packet and by having a Commission member present at each such
Council meeting to orally present the report and to answer any questions raised about the report and/or the
activities of the Commission. Minutes of each meeting shall be provided to each council member via
email and shall be placed on the City website."

Section 5. Chapter 2, Article 5, Section 2-184(2)(c) of the Carmel City Code should be and the
same is hereby amended and shall read as follows:
"(2)(c) Annual Report to Council. The Ethics Board shall present to the Council an annual written
report that provides a detailed and full accounting of the Boards' actions and activities during the previous
year. This report shall be presented to the Council at its second meeting in February, by placing a copy of
the same in each Councilor's individual Council packet and by having a Board representative present at
each such Council meeting to orally present the report and to answer any questions raised about the report
and/or the activities of the Board. Minutes of each meeting shall be provided to each council member via
email and shall be placed on the City website."
Section 6. Chapter 2, Article 5, Section 2-188(b)(9) of the Carmel City Code should be and the
same is hereby added to the Carmel City Code and shall read as follows:
"(9) Quarterly Report to Council. The Historic Preservation Commission shall present to the
Council a quarterly written report that provides a detailed and full accounting of the Commission's actions
and activities during the immediately preceding 90 day period. This report shall be presented to the
Council at its second meeting in January, April, July and October, by placing a copy of the same in each
Councilor's individual Council packet and by having a Commission member or staff member present at
each such Council meeting to orally present the report and to answer any questions raised about the report
and/or the activities of the Commission. Minutes of each meeting shall be provided to each council
member via email and shall be placed on the City website."
Section 7. Chapter 3, Section 3-42(d) of the Carmel City Code should be and the same is hereby
amended and shall read as follows:

"(d) Annual Report to Council. With respect to the appointment made under Section 3-42(d), the
Library Board appointee shall present to the Council an annual written report that provides a detailed and
full accounting of the Boards' actions and activities during the previous year. This report shall be
presented to the Council at its second meeting in February, by placing a copy of the same in each
Councilor's individual Council packet and by having a Board representative present at each such Council
meeting to orally present the report and to answer any questions raised about the report and/or the
activities of the Board. Minutes of each meeting shall be provided to each council member via email and
shall be placed on the City website. "
Section 8. All prior City ordinances or parts thereof that are inconsistent with any provision of
this Ordinance are hereby repealed as of the effective date of this Ordinance.
Section 9. If any portion of this Ordinance is declared unconstitutional, invalid or
unenforceable by the valid judgment or decree of a court of competent jurisdiction, such
unconstitutionality, invalidity or unenforceability shall not affect any of the remaining portions of same.
Section 10. This Ordinance shall be in full force and effect from and after the date of its passage,
execution by the Mayor and such publication as is required by law.
