The undersigned, being the Township Trustee of Clay Township of Hamilton County, Indiana, and the Township Advisory Board of Clay Township of Hamilton -County, Indiana, respectfully show the Town Plan Commission of the Town of Carmel, Clay Township, Hamilton County, Indiana, that: 1. Hamilton County, Indiana, .is a county which does not have a county plan commission and does not have a zoning ordinance and a subdivision control ordinance within the meaning of Chapter 46 of the 1959 Acts of the General Assembly of the State of Indiana, being "An Act Concerning Planning and Zoning in Townships," (hereinafter referred to as 'The Act"). 2. The Town of Carmel, Clay Township, Hamilton County, Indiana, is an incorporated town and is included in the term 'city" within the provisions of The Act, (hereinafter referred to as the "Town of Carmel.") As you know, the Town of Carmel has an established Plan Commission and has adopted a Master Plan and ordinance including a zoning ordinance and a sub- division control ordinance. 3. Clay Township, Hamilton County, Indiana, (hereinafter referred to as "Clay Township"), is contiguous to both the town boundary of Carmel, Indiana, and an area over which the Town of Carmel, through your Plan Commission is exercising planning and zoning authority and jurisdiction. 4. There was filed with the Township Trustee of Clay Township of Hamilton County on December 8, 1959, a Petition in parts containing signatures of persons represented therein as freeholders in Clay Township, Hamilton County, Indiana, (not including the Town of Carmel) and stating therein that "Clay Township and the freeholders therein, desire to join the Town of Carmel for planning and zoning purposes," 5. The Township Trustee of Clay Township of Hamilton County, pursuant to The Act, caused notice of a hearing at the Carmel Grade School Building, Carmel, Indiana, at 6:30 o'clock p.m. (CST) on January 5, 1960, to be published in the Noblesville Daily Ledger and the Noblesville Morning Times.on December 11 and December 18, 1959, respectively. The publisher's proofs of such publications are attached hereto as Exhibit A and Exhibit B, respectively, 6. At the place and on the date and time set for such hearing, such hearing was held. The aforesaid Petition, which had been certified by the AuditorofHamilton County; Indiana to contain the signatures of at least Y of freeholders Clay Township, was presented to the hearing, Such Peti- tion with such certification attached thereto is attached hereto as Exhibit C. 7. There being no remonstrance filed by a majority of the freeholders of Clay Township residing outside the limits of the Town of Carmel, either prior to the date of such hearing, or during such hearing, the undersigned resolved to send the Petition forthwith to the Town Plan Commission of the Town of Carmel, requesting joinder of Clay Township to the Town of Carmel for planning and zoning purposes. WHEREFORE, the undersigned in their respective capacities set forth below, respectfully request that: A. The Town Plan Commission of the Town of Carmel take and initiate the necessary action required by The Act to effect the joinder of Clay Township of Hamilton County to the Town of Carmel for planning and zoning purposes; and • B. Clay Township of Hamilton County be joined to the Town of Carmel for planning and zoning purposes.
