The most recent discussion you and I have had on the matter was on August 23, 1985, at which time you told me the matter was with Steve Andrews, and for me not to take any action until further notice. I have not. On January 14th or 15th, I had a conversation with Don Silvey in which he wanted to know how the project was coming along. My reply was that the last instruction I had was that the ball was in Andrew's court. I asked Silvey who he thought was responsible for getting the project done. His reply was, "I thought you were". The project steps are: 1. Purchase the meters 2. Get easement descriptions to attorney 3. Attorney to draw up easement and get signed 4. Draw up specifications 5. Get quotes for project I have already done steps 111 and 112. So far as I know, I have NOT received any signed easements from Andrews - Step 113. Step 114 I have gone over with Don Silvey in concept. Don tells me that he would recommend that I work directly with the contractors concerning the specifications. If you want me to continue this project, please let me know. The first thing I will require are the easements which, so far as I know, are still with Andrews. Let me know whether or not you want me to deal with Andrews on the easements. Carmel Sewer Meter Dear Steve: Attached are: 1. A letter from Dennis Grumpp of Schneider Engineering approving the preparation of an easement on land owned by Tom Schutz. 2. A copy of a legal description for the easement. This should be all you need to prepare an easement for the City. I suppose Mr. Schutz will have to sign it; or something. It might be quickest if you dealt directly with Mr. Schutz in getting the document executed; whatever you think. BE SURE TO INCLUDE working in the easement that specifically allows a hard surface road (black -top or concrete), AND above and below ground appurtenances (structures) to be built in the easement. February 6, 1985 Re: The Two Metering Points For Hamilton Western Utilities Dear Steve: As I stated yesterday, I had a meeting scheduled for today's date with Mr. Wilfong's engineer. This meeting discussed the metering point at 146th Street and Cool Creek. Attached you will find a copy of the synopsis of that meeting. The metering point at Mt. Carmel was further discussed today with Mr. Tom Welch. He informed me that he had been in contact with the engineer for Schutz & Thompson. That engineer has agreed to prepare final documents for your approval for issuance of a required easement for installing the meter on the Mt. Carmel interceptor. DOUGHERTY V11E111E1 MANAGER February 6, 1985 Attention: Mr. Robert Curry Re: Meter Installation For Hamilton Western Utilities at 146th Street Dear Mr. Curry: The following is an synopsis of the meeting held in my office today pursuant to the installation of a sewer meter in the vicinity of 146th Street and Cool Creek. The meeting was attended by yourself, Don Silvey of H.N.T.B., and myself. At this meeting you presented a drawing indicating a schematic of your proposal for interconnection of Hamilton Western's sewage lift station, holding tank, and sewer interceptor to be metered through the metering vault to be installed by Carmel. Earlier today we understand that you had presented the same proposal to Mr. Ralph Wilfong, who currentlyhas the proposal under consideration. We understand that you anticipate Mr. Wilfong's agreement or revisions within the next two to three weeks. It is further my understanding that you have solicited Carmel's agreement or revisions within that same time period or sooner if possible. The following is a list of ideas that were either discussed and/or agreed upon: 1. Mr. Curry will immediately request his aerial photo sub -contractor, (LOBO), to prepare detailed site plans of existing facilities, property lines, easements, and right-aways. Also an overlay to this site plan that would indicate the proposed facilities as discussed today. 2. Carmel will address Mr. Curry a letter agreeing, or revising, the proposal as presented today. Page -2- To: Mr. Robert Curry February 6, 1985 3. Mr. Curry will notify Carmel as to Mr. Wilfong's agreement of re- visions to the proposal as soon as they are made. 4. Once 171, 2, and 3 above are complete, Mr. Curry will send Carmel NEW set of "sepia" prints so we can super -impose our metering structure on those prints. 5. Hamilton Western Utilities, per prior agreement, will obtain and prepare all required easement, land, permits, permanent access road- way for the metering vault. 6. I believe Mr. Silvey was to check on any effects a 100 -year flood might have on the metering facility. 7. Mr. Silvey is also to prepare drawings showing dimensions, piping, location, and other pertinent engineering data as he shall seem appropriate to Jim Dougherty within the next few days. It was a pleasure meeting you, and I appreciate the opportunity for us to work together. Easement for meter to be installed on the Mount Carmel interceptor at the eastern edge of Mount Carmel is currently in the hands of Tom Welch. I had given Mr. Welch a copy of legal description that I had Weihe Engineers prepare. I sent you a copy of the same docu— ment on December 14, 1984. Since that time Mr. Welch has been in contact with Mr. Schutz of Schutz and Thompson to discuss their getting Carmel an easement for the meter. The land described in the legal description is currently owned and proposed for development by Schutz and Thompson. I have been in contact with Mr. Welch pursuant to progress of this easement almost weekly. Perhaps it would be useful if you could contact Tom and encourage having a more rapid culmination of the proceedings. b. Meter location just North of 146th Street is also the same place where Westfield will have their meter located. I have met with representative from Westfield and have an appointment for tomorrow at 10:00 with Mr. Curry, who is an engineer for Hamilton Western Utilities. Since Hamilton Western owns the land where both Westfield and Hamilton Western will have their meters, I am working through Mr. Curry in order to affect a mutually satisfactory meter install— ation location that will satisfy the need of all three entities. According to my notes, the easements have been obtained and recorded and there should be nothing to prevent (absence this beautiful weather we are having) the connection. If there is a problem, please advise. I do have some concerns inasmuch as Wilfong is in the midst of hot, heavy and ferocious negotiations with Westfield and I feel we need to get our meters in the ground, and the connections made to avoid further hassles should things blow up with the Westfield/Hamilton-Western nego- tiations. Lon Silvey stated that Hamilton G.@stern Utilities was responsible for obtaining and supplying to the City of Carel all necessary easements for the construe= tion and operation of the meters. Mr. Silvey further suggested that you would be the appropriate City contact with Mr. Willis Kunz, attorney for Hamilton Western. Pursuant to your request, the attached Hunters Creek Plat is marked for the location of the needed road. It is important to understand that what we need,in addition to an access easement, is an agreement from the land • owners to construct and maintain a permanent roal.ay to the rear of Lot 57 on Hunters Creek South. Also, there will be a permanent building approx- imately 10' by 10' square located above ground over a below -ground meter vault. Easements probably should be obtained as follows: }calf from,Mt. Carmel, Section 9 and half from Hunters Cra.ek South, Lot 57: Each easement should be approximately 10 ft. by 145 ft. Mr. Kunz should he able to take care of the half supplied by Mt. Carrel himself. He would have to contact and negotiate with Schutz and Thompson Inc. for that portion located on Hunters Creek South Lot 57; and also for agceerrents with Schutz E Thompson for the construction of the permanent road and building. We have just received complete shipment of the new metering equipment for installation at this site and will be able to proceed with installation immediately upon acquisition of these agreements. Specifically I am referring to an easement for the location at the "Mt. Carmel" meter. I do have a copy of the easement for the "146th St. Metering System". That is the one where Hamilton Western and Westfield connect to the North South Interceptor.
