THIS INDENTURE WITNESSETH THAT Janet C. VonFoerster, the surviving spouse of Forrest C.
VonFoerster, conveys and warrants to the City of Carmel, Indiana (the "Grantee"), for the sum of Twenty-four
Thousand Eight Hundred and 00/100 Dollars ($24,800.00) and other valuable consideration, the receipt and
sufficiency of which is hereby acknowledged, the following described real estate in Hamilton County, State of
Indiana:
See attached Exhibit A and Exhibit B, which are attached hereto and incorporated herein
subject to any and all easements, agreements, restrictions and other matters of record.
It is understood between the parties hereto, and their successors in title, and made a covenant herein which shall
run with the land, that all real estate herein described (excepting any parcels or portions thereof that are
specifically and expressly designated as easements or temporary rights of way) are conveyed in fee simple and
not merely for right of way purposes, and that no reversionary rights whatsoever are intended to remain in the
Grantor.

Janet C. VonFoerster, (the "Affiant'), being first duly sworn, deposes and says that:
I. Affiant is he surviving spouse of Forrest C. VonFoerster, (the "Decedent"), who died a
resident of O (ik\0.V\ County, Michigan, on Peri ?fp , 2008.
2. Affiant and Decedent acquired the following described real estate in Hamilton County,
State of Indiana, as husband and wife, on April 27, 1984 (Instrument No. 84-5644 in Book 342, Page
685):
Part of the Northwest Quarter of the Northwest Quarter of Section 7, Township 17 North,
Range 4 East in Hamilton County, Indiana, more particularly described as follows, to -
wit: Beginning at a point in the North line of said Quarter Quarter Section distant West
498.6 feet of the Northeast corner thereof; thence South, parallel to the East line of said
Quarter Quarter Section 341.76 feet: thence West, parallel to said North line 124.5 feet;
thence North, parallel to said East line 341.76 feet to a point in said North line; thence
East, in and along said North line 124.5 feet to the place of beginning.
And more commonly known as: 1829 East 106°' Street, Carmel, IN 46032
3. Affiant and the Decedent remained married continuously from the date they acquired title
to the above-described real estate until Decedent's date of death.
4. This affidavit is made for the purpose of establishing Affiant's ownership of said real
estate by virtue of surviving the Decedent.
