Section 1. Cross Reference. These Commitments are made in connection with the approval by the Board of the Use Variance under docket number 15060008 UV (the “Use Variance”) with respect to the Real Estate. Section 2. Definitions. The definitions (i) of the capitalized terms set forth below in this Section 2, as they appear throughout these Commitments, shall have the meanings set forth below in this Section 2 and (ii) of all other capitalized terms included in these Commitments and not defined below in this Section 2, shall be the same as set forth in the Zoning Ordinance (defined below). A. Architectural Design: The architecture, design, exterior lighting, landscaping and signage associated with the Convenience Store and Gas Sales illustrated on the drawing attached hereto and incorporated herein by reference as Exhibit C. B. City: “City” shall mean and refer to the City of Carmel, Indiana. C. Convenience Store and Gas Sales: “Convenience Store and Gas Sales” shall mean Convenience Store and Gas Sales as defined in the Zoning Ordinance. D. Director: “Director” shall mean and refer to the Director of Community Services for the City. E. Minor Alteration: “Minor Alteration” shall mean Minor Alteration as defined in the Zoning Ordinance. F. Open Space Area: “Open Space Area” shall mean the area of the Real Estate identified as “Area 1” on is attached hereto and incorporated herein by reference as Exhibit D. G. Site Plan: “Site Plan” shall mean and refer to the drawing which is attached hereto and incorporated herein by reference as Exhibit B. H. Substantial Alteration: “Substantial Alteration” shall mean Substantial Alteration as defined in the Zoning Ordinance. I. Usable Area: “Usable Area” shall mean the area of the Real Estate identified as “Area 2” on what is attached hereto and incorporated herein by reference as Exhibit D. J. Zoning Ordinance: The Zoning Ordinance, Ordinance Z-289, of the City of Carmel, Hamilton County, Indiana, as amended. Section 3. Commitment Concerning Use. Indiana Equity, as owner of the Real Estate, for itself and for its successors, assigns, grantees and successors in title to the Real Estate, makes the following commitments concerning the use and development of the Real Estate: A. Permitted Uses on Real Estate - A Convenience Store with Gas Sales shall be the only permitted use on the Real Estate. B. Site Plan - The Real Estate shall be developed in substantial compliance with the Site Plan. If there is a Substantial Alteration in the approved Site Plan, review and approval of the amended Site Plan shall be made by the Special Studies Committee of the Plan Commission pursuant to the ADLS amendment provisions of Chapter 24 of the Zoning Ordinance. Minor Alterations may be approved by the Director. C. Architectural Design - The Convenience Store with Gas Sales shall be developed in substantial compliance with the Architectural Design. If there is a Substantial Alteration in the Architectural Design, review and approval of the amended Architectural Design shall be made by the Special Studies Committee of the Plan Commission pursuant to the ADLS amendment provisions of Chapter 24 of the Zoning Ordinance. Minor Alterations may be approved by the Director. D. Open Space Area – Use of the Open Space Area shall be regulated as identified below in this Section 3(D): 1. Buildings, driveways, pumps, canopies, parking areas, other improvements and so on are permitted in the Useable Area but are not permitted in the Open Space Area. 2. The following activities shall be prohibited in the Open Space Area: a. Removal of living vegetation except as otherwise permitted below in this Section 3(D)(3). b. Mowing any portion of existing, naturally vegetated areas, except along trails, points of access or gathering points. c. Seeding, including grass seed, prairie mix seed, unless approved by the City's Urban Forester. 3. The following activities shall be permitted: a. Removal of invasive species (e.g. bush honeysuckle) through cutting or the use of herbicides. b. Removal of (i) leaves, (ii) dead, dying or fallen trees and/or (iii) trees that create a risk of personal injury or property damage. c. Removal of vines. d. Planting of native trees pursuant to the Indiana Native Tree List provided by the city's Urban Forester. e. Removal of exotic and invasive vegetation pursuant to the Indiana Exotic and Invasive Plant List provided by the City's Urban Forester. f. Removal of trees directed to be removed by municipal, county, state or federal agencies or departments or by a public utility. g. Removal of trees and other vegetation as necessary for the installation of utilities and drainage improvements. Section 4. Effective Date. The Commitments contained herein shall be effective upon the occurrence of all of the following events: A. Approval by the Board of Indiana Equity’s requested Use Variance application, subject to the Commitments, under Docket Number 15060008 UV (hereinafter referred to as the “Zoning Approval”); and, B. The commencement of the development of the Real Estate pursuant to the Zoning Approval as evidenced by the issuance of an Improvement Location Permit. Section 5. Binding on Successors and Modifications. These Commitments are binding upon (i) Indiana Equity during the time of Indiana Equity’s ownership and (ii) upon each successor, assign and grantee acquiring an interest in the Real Estate during such successor’s, assign’s and grantee’s ownership, unless modified or terminated by the Board after a public hearing wherein notice is provided by the rules of the Board. The provisions of this Section 5 notwithstanding, these Commitments shall terminate as to any part or parts of the Real Estate hereafter (i) reclassified (rezoned) on the City’s Official Zone Map or (ii) acquired by or dedicated to the City of Carmel, Indiana or Hamilton County, Indiana for the purpose of road improvements. Section 6. Recording. The undersigned shall record these Commitments with the Recorder of Hamilton County, Indiana. Section 7. Enforcement. These Commitments may be enforced by the Board. The grant of this variance will not be contrary to the public interest, due to the existence of special condition(s) such that enforcement of the zoning ordinance will result in unnecessary hardship because: The proposal is consistent with the policies and objectives of the Comprehensive Plan, as set forth below in these findings. The site has lengthy frontage on 146th, a heavily travelled, cross county corridor. Over time the character of this area has changed with the development of commercial and business uses. Examples of commercial development are two nearby businesses on the south side of 146th Street, in City of Carmel, that have been allowed by use variances. The desire to provide a buffer, to save trees and to avoid the floodplain pushes any development of the subject site to the edge of 146th Street. These conditions make infeasible the development of this site under its current S-1 Residential zoning classification. 2. The grant of this variance will not be injurious to the public health, safety, morals and general welfare of the community because: The proposal is designed to provide appropriate transition to residential areas through significant buffering, open space, landscaping and tree preservation. This proposal is consistent with the Comprehensive Plan. Further, the proposal (i) has been carefully reviewed by the Technical Advisory Committee, the Department of Community Services, the Department of Engineering and the Department of Utilities and (ii) complies with all applicable federal and state regulations. 3. The use or value of the area adjacent to the subject property will not be substantially affected in any adverse manner because: The proposal is consistent with the Comprehensive Plan and provides certainty, regarding the future of the site, with a development that uses only a portion of the site and achieves appropriate transition to residential areas through significant buffering, open space, landscaping and tree preservation. 4. The need for the variance arises from a natural condition peculiar to the subject property because: A large portion of the site is occupied by floodplain and large, wooded areas. The desire to preserve large wooded areas and to avoid the floodplain pushes development of the site to the edge of 146th Street. 146th Street is a major, heavily traveled, cross county corridor. Over time, the character of the area surrounding the site has become increasingly commercial in nature. Any development of the site, to be feasible, must respond to these conditions. The proposal has been designed (i) to be compatible with other the uses at and around intersection of 146th Street and Gray Road and along 146th Street and (ii) to provide appropriate transition to the residential areas through significant buffering, open space, landscaping and tree preservation. 5. The granting of this variance does not substantially interfere with the Carmel/Clay Comprehensive Plan because: The Comprehensive Plan classifies as “Suburban Residential” the properties to the west, south and east of the subject site. The Comprehensive Plan also classifies as “Areas of Special Study” the subject site and parcels on 146th Street over to The Legacy PUD. A fuel station with a convenience store would provide services that are similar to and compatible with a “Neighborhood Service Node”, which, in turn, is considered to be appropriate where, as here, the more intense use is installed with sensitivity to the adjacent land classification of lesser intensity. Further, the convenience store aspect of this proposal, which provides daily goods, has characteristics found in “Neighborhood Support Centers”, which, in turn, are considered to be a “Best Fit” next to Suburban Residential areas. The Comprehensive Plan also discusses the “East Carmel Policies and Objectives”, which include (i) allowing “Neighborhood Service Nodes” adjacent to residential areas with appropriate buffering, tree preservation and landscaping and, (ii) allowing transitions from 146th Street to single family residential areas. The Comprehensive Plan further contains City wide policies and objectives, such as (i) attracting additional businesses to Carmel, which in this case could be achieved by encouraging a well-designed proposal that has characteristics in common with a Neighborhood Service Node and a Neighborhood Support Center, (iii) promoting appropriate transitions between uses and (iv) protecting natural areas and features through buffering, open space, tree preservation and landscaping. The proposal, as evidenced in the plans and commitments, provides appropriate transition to the residential uses through significant buffering, abundant tree preservation, open space and well-designed and ample landscaping so that the development of the site will be sensitive to residential areas while being compatible with the changed character of nearby development on 146th Street. DECISION IT IS THEREFORE the decision of the Carmel/Clay Board of Zoning Appeals that the Use Variance Docket No. 15060008 UV is granted, subject to any conditions stated in the minutes of this Board, which are incorporated herein by reference and made a part hereof.
