THE CONSULT NT will utilize the services of CrossRoad Engineers, P.C. as needed to complete portions of the work outlined in this scope of services. Items not anticipated to be included in this sc•pe of services include landscape design and plan production, and construction inspection and ma agement. TASK 7—RIGH I OF WAY ENGINEERING AND ACQUISITION SERVICES CONSULTANT s all provide a location control route survey plat in accordance with 865 IAC Rule 12. CONSULTANT s all provide right-of-way engineering and services for the project. Right-of- way engineering s all include title abstracting,right-of-way plats,legal descriptions,appraisal problem analysis, .nd right-of-way engineering management. Right-of-way engineering shall be performed in acco •ance with the current version on the INDOT Right-of-Way Engineering Manual. Right-of- ay services shall include appraisal,negotiations,relocation,right-of-way staking,document i.reparation,title review,recording,mortgage release and right-of-way management. App aising shall be in accordance with the current version of the INDOT Real Estate Appraisal anual. Negotations shall be in accordance with the current version of the INDOT Real Estate Buyer Manual. Relocations shall be in accordance with the current version of the INDOT Rea Estate Relocation Program Manual. Other activities shall be in accordance with the current ve sion of the INDOT Real Estate Property Management Manual. Deliverables shall include all do uments necessary for Right-of-Way Certification in accordance with the current version of the INDOT Local Public Agency Guidance Document for Local Federal-Aid Projects. Work is in association with the proposed foot bridge crossing of Williams Creek. Relocation of the main is required to avoid the bridge footings. The lane restriction is the eastbound lane of 106th Street at Williams Creek, approximately 720'west of the Spring Mill Road intersection. Work is scheduled to begin October 26 and is expected to take one week for completion. Lane restriction is proposed to remain in place during the entire work period. There is no open pavement cut anticipated. The Department of Engineering recommends that the Board approve the requested open cut and lane restriction contingent upon satisfaction of the following requirements: • The project's contractor shall comply with the provisions of Carmel City Code 6-227(a)(1), 6- 227(a)(8) and 6-227(b)(1). • Any damage to the existing improvements within the right-of-way shall be restored to the satisfaction of the City when the work is complete. • The petitioner agrees to meet with the Department of Engineering to develop a traffic control plan. Such plan shall conform to the requirements of the Indian department of Transportation Work Zone Safety Manual. Approval from the Department of Engineering of the traffic control plan shall be obtained prior to commencing the work. • Signage for the approved traffic control plan shall be placed in advance of the work as directed by the Department of Engineering. • Construction in dedicated Right-of-Way shall comply with all city codes and standards. If needed, any street cut shall be restored per City of Carmel Street Cut Repair Detail Standard 10- 20. • The petitioner understands that approval is granted for the lane restriction request only. • Work shall endeavor to restrict traffic and not fully close the roadway. NF Engineers, is requesting approval for lane restrictions of 96th Street in association with the proposed Penske Chevrolet project to be located at 3202 East 96th Street. Two (2) lane restrictions will be required for the project. The first restriction (aka phase) will be to close the northernmost westbound lane of East 96th Street. The closure is necessary to facilitate the removal of two existing drive approaches and the installation of one new exist only, right turn only drive approach onto East 96th Street. The second lane restriction will be to close the southernmost westbound left turn lane of East 96th Street and the northernmost eastbound lane of East 96th Street. Left turn onto southbound Keystone Parkway will be maintained via the second existing left turn lane from East 96th Street. This closure will be necessary to facilitate the installation of the required center median on East 96th Street. Both lane restrictions will be completed over weekends. The closures will be implemented beginning Friday evening at 9:00 and removed once construction has completed on Sunday. Actual closure dates have yet to be determined and may vary on weather conditions. Construction is scheduled to begin at the end of October or early November. The proposed open pavement cut will be south of the pavement line of West 121st Street and .1 mile west of the center line of Shelborne Road. The walk path will be closed for 1 to 2 days for an in order to provide gas service. (Exhibits attached) Work is required to access the existing gas main at the location and tie in a new main for service to the home. The pavement cut will be 3'x 5'. Work is expected to take one to two days for completion. Temporary repair to the pavement cut will be conducted by Case Construction and will be completed by asphalt contractors when prior to December 1st, 2015.. Estimated date of work is scheduled for October 30, 2015. The Department of Engineering recommends that the Board approve the requested open cut and lane restriction contingent upon satisfaction of the following requirements: • The project's contractor shall comply with the provisions of Carmel City Code 6- 227(a)(1), 6-227(a)(8) and 6-227(b). • Traffic in both directions of Shelborne Road shall be maintained at all times. • The petitioner agrees to meet with the Department of Engineering to develop and obtain approval of a Maintenance of Traffic Plan. The proposed drive will serve as a construction entrance during the construction period. The proposed curb cut will be located on the west side of West Road.There are no existing or future alignment issues with the proposed curb cut. Construction activities are to begin upon approval by the Board. Heine, 5885 Lost Oaks Drive, Cannel, Hamilton County, Indiana 46033, (individually and collectively, "Owner"), and the City of Carmel, Hamilton County, Indiana, by and through its Board of Public Works and Safety("City"). WITNESS ETH: WHEREAS, Owner owns in fee simple Lot Ill ("Lot") in Lost Oaks at Haverstick, Section 2B which is located within the corporate limits of the City of Cannel, Indiana ("Subdivision"), which real estate is more particularly described in Exhibit A, attached hereto and incorporated herein by this reference;and WHEREAS, the official plat of the Subdivision was recorded in Plat Cabinet 2, Slide 332,Instrument Number 199909958104 in the Office of the Hamilton County Recorder on October 5, 1999,as Lost Oaks at Haverstick, Section 2B (the"Plat"); and WHEREAS, the current Owner has an existing deck on the Lot(the"Site Improvement"); and WHEREAS, Owner has given the City a sketch ("Sketch") depicting the location of the Site Improvement on the Lot, a copy of which is attached hereto and incorporated herein by this reference as Exhibit B; and WHEREAS, the Site Improvement will be constructed on portions of the Lot designated as Drainage Easement, identified as "30'Drainage Easement"on Exhibit B (the"Easement"); and WHEREAS, the Easement is beneficial to the City and its residents; and WHEREAS, as indicated on the Sketch, the Site Improvement will encroach (the"Encroachment") upon the Easement, which Encroachment is crosshatched on Exhibit B; and WHEREAS, City of Carmel Board of Public Works and Safety approved the Owner's request for a variance from Carmel City Code Section 6-227(4)on Oc-lu1per 2.01C; and WHEREAS,Owner and City acknowledge the location of the Encroachment;and WHEREAS, Owner acknowledges that this Agreement does not imply any approval of existing or future improvements not indicated by Owner on Exhibit B; and WHEREAS, the location of the Site Improvement as indicated by the Owner on Exhibit B should not materially interfere with the City's use of the Easement. This Agreement shall be effective as of the date on which it is last executed by a party hereto. 12.
