HomeMy WebLinkAboutLetter #8 Dan ColeFrom:Dan Cole To:Crediford, Maggie Cc:dcole2@indy.rr.com Subject:BZA variance request for farm animals Date:Wednesday, November 11, 2015 7:42:43 AM Dear Maggie, I wanted to provide written documentation of my opposition to the requested Zoning Ordinance Variance being sought to allow farm animals on less than 3 acres of residential property in Carmel, Briar Creek Section 1 of the Woodlands neighborhood. The formal agenda docket number 1510008 v miniature goats, Briar Creek. My property sits directly south of the property owners' requesting the variance and within earshot and visibility of the farm animals. My decision to oppose the variance starts with the fact that there is already a law stating that owning farm animals on less than 3 acres in the City Limits is not legal. Additionally, our neighborhood HOA discussed the issue and passed motion to deny the variance request as well. A concern I have in allowing this variance is would it provide an opening for other farm animals to be allowed on property less than 3 acres inside the city limits. There is also a concern about potential environmental issues with run off into Carmel Creek which runs alongside of where the animals are kept. Will there be foul odors and a degradation of the property and surrounding property values? These are a few of the questions we don't have the answers to at this time, but should a variance be allowed and there be a negative impact, it will be more difficult to overturn and correct the issue in the future. It seems easier to ask for forgiveness instead of permission. I wish due diligence was done before the purchase of the farm animals, but ignorance of the law is no excuse.
