HomeMy WebLinkAboutFW Hyundai Building.msgAll, We received this response from the City Engineer on Sunday and waited to meet with him and his staff on Monday before sending the information. As you can see, despite being asked to keep Kevin and me in the loop, Engineering asked Permitting to issue a “temporary” C of O and we wanted the meeting to understand why this happened. Although you will see the reasons set out below…..I am unable to grasp why the City Engineer did not contact us about what was happening, as he knew we had an interest. Summary: 1. Butler came in on Friday and paid the $1,500 in back fees that were owed. 2. The CO is temporary and Butler must construct the compensatory mitigation storage. 3. Butler has until July 1, 2015 to build that on or off site. 4. If Butler does not…..then the $81,639 dollar check they gave to Engineering will be used to construct it. So it will be done one way or another 5. This mitigation is ONLY for the Hyundai building 6. Butler also must install agreed upon plantings by May 17th. If he does not do so, the fine can be $1,600/day. There is still no new FEMA map and we had told the Butler team and Engineering, that until the drainage plan is in place for the entire piece of land, we do not expect to see another request to build…either single buildings or a new PUD. From our standpoint the development has met all requirements with the exception of constructing the compensatory storage on the northern portion of the property. The main reason for this is the underlying uncertainty of how that piece of property will be developed. As a condition of the CO, we had the developer issue a certified check in the amount of $85,000 after we reviewed an estimate of how much it would cost to construct compensatory storage. This is in place so that if the developer has not constructed the storage area either on or offsite, we can take a project out to bid to build the storage area as shown on the development plan. We have placed a deadline of July 1, 2015 and have held the right for further penalties. The cashiers check is better for the City in my opinion because we have it on hand and will not need to work through a bonding company. If you have any further questions feel free to let me know. The consensus was that the drainage on this property was the underlying problem. Additionally, it appears that while the Hyundai building was allowed to be built, the owner did not fulfill his obligation to provide temporary mitigation. Therefore, I would hope that until that has been built and inspected, the Certificate of Occupancy would be on hold. Let me and Councilor Rider know if there is a problem with this.
