Development of the western outlot (at the southwest corner of the overall development) as a Maserati/Alfa Romeo dealership has been filed for DP/ADLS approval…Docket # 14120012 DP/ADLS was assigned on 12/23/14. We are presently reviewing these plans for the January TAC meeting. The status of the LOMR is unchanged…at the end of October, the technical aspects of the LOMR had been reviewed by FEMA and the only outstanding item was additional property notifications in Indianapolis (if the City required any additional notifications). I will obtain a status update. We still have the cashier’s check for $81,639 from Butler as surety for the completion of the mitigation area. We have not cashed the check as it is valid for seven years and we are not certain, if cashed, into which account we could place the money. We could confirm this with the Clerk-Treasurer if needed. Engineering does not have an account or line item established for such surety…we have always kept the check on file the same as performance bonds or other types of bonds/sureties. Please let me know if you have any questions. I dropped in this morning to discuss the Butler property along 96th Street at Randall Drive. Kevin and I, as well as several others on Council, have an interest in any and all developments. I don't know if the new FEMA map has been issued but would ask you to inform both me and Kevin of any requests, permits or new information that impacts this property. When last we met, we saw the check for $81,000 that Butler had submitted as a guarantee that the mitigation would be completed by a date specific. Question: Does Engineering have a trust or escrow fund for money of this sort? Where is it deposited? I did notice that the check had to be cashed by a certain date or it would become invalid and so assumed it would not just be held in the file. Thank you for your attention to this matter.
