Fred,
We dropped off the right of way permit for Peace Water Winery earlier today alongside the surety bond. We
were asked to provide a drawing representing how the site would be accessed. I have attached the drawing
illustrating the access point for construction deliveries through the south alley.
Please let Scott or I know if anything else is needed to complete the right of way permit.

Please advise on what we need here. Not sure what a "right of way" permit is. We assumed it had to do with needing to
block public spaces like sidewalks so didn't apply.

Thank you for your input. We actually just replaced the entire sewer line from the building to the main about a month
ago. It actually runs right down the westerly property line now so that will be just outside the structure. As for water or
other lines, they did not find any other lines under the proposed structure when they did the locates in preparation for
the sewer line excavation.
Happy to meet here to discuss in detail. I can be here most any day from 11 - 3. Let me know if and when you’d like to
meet.

This building and the adjacent building have both water and sanitary sewer behind the building. It
appears that the patio will be built over the top of these lines which could be problematic for you and us
if there is an issue that requires access to the line or an excavation of the line. I suggest we meet on-site

Plum Creek Golf Course is applying for a variance through the BPW from our fill in the floodplain prohibition. He needs
to rewrite the letter to the Board, but his 1:1 cut and fill mitigation plan (so he does not cause floodplain loss) is
acceptable. I have no issue if he proceeds at his own risk until the variance is approved.

I have attached the commercial submittal sheet for reference, but first you would need to get an email or some sort of documentation
from the state that they will not require a plan submittal. Dave and Bonnie at the State of Indiana would need to see your plans, and
their addresses can be found highlighted on this sheet.
Once you receive the response from them you can submit your plans to us. We will need 3 sets of building plans and a completed
application. In the meantime, I can send these plans out to other departments such as engineering, utilities, etc and make sure
everyone is OK with it. Once we have everything submitted, including all approvals, our review time is typically one week.
If you have any questions, give me a call.

Good morning, Nick –
The Planning/Zoning Dept. has administratively approved the outdoor patio project ( excluding the sign design ), and we
will update plan commission file docket no. 14020018 ADLS Amend.
The proposed parking lot facing sign needs sign permit approval, and also needs to comply with the Sign Ordinance
standards for a multi-tenant building and multi-tenant building complex. (He will need to remove the current parking lot
facing sign, too, as part of this approval for the new sign which is to hang from the wood truss area.) As proposed, the
100% logo sign does not comply. The sign needs to incorporate text, too, so that the logo makes up 25% of the sign area
or less. Scott can work with Cat S. in our office to get the signage reviewed and approved, via the sign permit process.

Per survey drawing it looks as if the gas service line to the building was located as well as the gas main line in the alley.
Vectren should not have any issues with the patio addition as it doesn’t appear to be in conflict with our natural gas lines
or meter settings.
But before that first shovel touches the ground 811 will need to be called to verify all utilities in the project area.

Thank you Angie. We will get to work on your comments and revisions. However, before we do that it seems
one item you identified could nullify the entire project. I want to be sure we address that first.
Specifically, #11 below where you cite “No rear entrances are allowed except for residential or office uses,
emergency exits, employees, loading and trash removal.” The plan we submitted and that was approved last year included a
rear customer entrance. In fact, every single business in our block of our Main St. has rear customer entrances. That entrance is very
important to our business for parking area access and we certainly do not want to lose that.
Please let me know if the comments indicate we will no longer be allowed to use that rear entrance for
customers if we proceed with a patio.

What is the intended use for this area? It is beginning to take the shape of an assembly area. Originally when this project was filed
last year I believe it was listed as a M (mercantile) occupancy. Nick can you Look at the original plans and verify that? This new
proposal appears to be developing into more than just a patio area, is getting close to an enclosed building?

the existing vinyl fence planks to match the wood fence we are using to enclose patio. We have also noted the floor as stained concrete
although as mentioned that may be natural concrete.

Thanks for the feedback and we had actually talked about perhaps
adding another exit for that reason. We have revised the plans
accordingly and attached to this email.
The emergency exit we just added will be 42” wide. As for the
unobstructed exit from the rear of the building, we have it designed
as a 5’ wide direct, unobstructed path that runs straight from the
back door to the rear patio exit. The rear patio exit will be 5’ wide
as well. (Note: the back door of the building is 36” wide)

By the way, the parking area shown in our patio design has not
changed whatsoever from the original plans that were submitted
and approved last year. We simply have used the area previously
designated as “open yard space” as the new patio. In other words,
we are not changing anything with regard to parking. Just pointing
that out since Nick mentioned something about parking, ROW and
Engineering. Please advise if we need to be contacting someone
with respect to that.
