COUNCIL CHAMBERS/CITY HALL/ONE CIVIC SQUARE MEMBERS PRESENT: Mayor James Brainard, Council President Ronald E. Carter, Council Members Sue Finkam, Laura D. Campbell, H. Bruce Kimball, Kevin D. Rider, Jeff Worrell, Carol Schleif, Clerk -Treasurer Christine S. Pauley and Deputy Clerk Jacob Quinn. Mayor Brainard called the meeting to order at 6:00 p.m. INVOCATION: Rev. Rob Fuquay, St. Luke's United Methodist Church, pronounced the Invocation. Mayor Brainard led the Pledge of Allegiance. RECOGNITION OF CITY EMPLOYEES AND OUTSTANDING CITIZENS: There were none. APPROVAL OF MINUTES: Councilor Rider made a motion to approve minutes from the December 21, 2015 Regular Meeting. Councilor Finkam seconded. There was no Council discussion. Mayor Brainard called for the vote. Minutes were approved 5-0 (Councilors Worrell and Schleif abstained). RECOGNITION OF PERSONS WHO WISH TO ADDRESS THE COUNCIL: Tom Kendall addressed the Council regarding various road and sidewalk projects. COUNCIL, MAYORAL AND CLERK -TREASURER COMMENTS/OBSERVATIONS: Mayor Brainard addressed some of Mr. Kendall's concerns. Councilor Finkam made a motion to add two items to the agenda entitled Council Election of President and President Appointments and to reorder the agenda to immediately bring these two items before the Council and consider the First Reading of Ordinance D-2260-16. Councilor Schleif seconded. There was no Council discussion. Mayor Brainard called for a vote. The vote motion was approved 7-0. Mayor Brainard made a motion to reorder the agenda to deal with the First Reading of Ordinance D-2260-16 and then the Election of Council President. Council Finkam objected. Mayor Brainard withdrew his motion. Councilor Finkam made a motion to elect Councilor Carter to be Council President. Councilor Schleif seconded. Councilor Rider made a motion to close nominations. Councilor Worrell seconded. Mayor Brainard announced that Councilor Carter is now Council President. Councilor Rider made a motion to move the First Reading of Ordinance D-2260-16 into business. An Ordinance of the Common Council of the City of Carmel, Indiana, Adopting and Adding Chapter 1, Section 1-16 of the Carmel City Code. Councilor Schleif seconded. Mayor Brainard presented this item to the Council. There was brief Council discussion. Councilor Rider made a motion to suspend the rules in order to act on Ordinance D-2260-16. Councilor Finkam seconded. There was brief Council discussion. The motion was approved 7-0. Councilor Rider made a motion to approve ordinance D- 2260-16. Councilor Schleif seconded. Mayor Brainard called for a vote. Ordinance D-2260-16 was adopted 7-0. Mayor Brainard passed the gavel to Council President Carter. ACTION ON MAYORAL VETOES: There were none. CLAIMS: Councilor Finkam made a motion to approve payroll in the amount of $1,613,827.74. Councilor Rider seconded. There was no Council discussion. Council President Carter called for the vote. Payroll was approved 7-0. Councilor Finkam made a motion to approve claims in the amount of $1,139,994.16. Councilor Schleif seconded. There was no Council discussion. Council President Carter called for the vote. Claims were approved 7-0. ' Council President Carter announced that there would be a Special Claims Meeting of the Common Council on Monday, January 11, 2016 at 6 P.M. COMMITTEE REPORTS: Council President Carter announced that no committees have met. OTHER REPORTS: Tabled OLD BUSINESS Council President Carter announced the Second Reading of Ordinance D-2241-15; An Ordinance of the Common Council of the City of Carmel, Indiana, Amending Chapter 3, Article 1, Division II, Sections 3-27(a)(4) (Clerk of the Council) and 3-3l (a) (Agenda/Additions to Agenda/Public's Right to Address Council) of the Carmel City Code. Councilor Finkam made a motion to lift this from the table. Councilor Schleif seconded. There was no Council discussion. The motion was approved 7-0. Councilor Finkam made a motion to amend Ordinance D-2241-15 by substituting in whole ordinance D-2241-15 As Amended VERSION A. Councilor Worrell seconded. There was brief Council discussion. Additionally, he would appoint Councilor Rider to chair the Land Use and Special Studies Committee with Councilors Schleif and Kimball serving on the committee. There was brief Council discussion. 3 PUBLIC HEARINGS Council President Carter announced the First Reading of Ordinance D-2246-16; An Ordinance of the Common Council of the City of Carmel, Indiana, Authorizing the Issuance of General Obligation Bonds, Series 2016A, for the Purpose of Providing Funds to Pay for Certain Capital Improvements and Incidental Expenses in Connection Therewith and on Account of the Issuance and Sale of the 2016A Bonds and Appropriating the Proceeds Derived from the Sale of Such Bonds (Carey Road and 13e Street Roundabout). Councilor' Rider made a motion to move this item into business. Councilor Finkam seconded. Councilor Rider deferred to Bruce Donaldson, Barnes and Thornburg LLP, to address the Council on this item and the next 12 items of business. Councilor Finkam deferred to Mayor Brainard to address the Council. Mayor Brainard presented to the Council information comparing property taxes in Carmel to that of neighboring communities. Mayor Brainard referred to Bruce Donaldson for a series of questions. Councilor Rider deferred to Curt Coonrod, C.L. Coonrod & Co., to speak about General Obligation Bonds for this project and the next 12 items of business. Councilor Finkam deferred to Mayor Brainard to address some of the concerns from the community regarding these ordinances. Councilor Finkam referred to Loren Matthes, Umbaugh, to address the Council. Loren Matthes addressed the Council regarding interest rate trends. Councilor Finkam read a white paper from Tom Sharp, Carmel resident and former INDOT commissioner, providing information about Ordinance D-2267-16. Council President Carter called for a vote. The motion failed 5-2. (Councilors Schleif and Campbell opposed). Councilor Finkam made a motion to hold Ordinance D- 2267-16 until the next Council Meeting and not be sent to committee. Councilor Kimball seconded. Council President Carter called for a vote. The motion was approved 7-0. Council President Carter announced the First Reading of Ordinance D-2268-16; An Ordinance of the Common Council of the City of Carmel, Indiana, Amending Chapter 9, Article 2, Division IV, Section 9-55 and Restating the Schedule of Rates and Charges Collected by the Water Utility.
