The survey will also meet the minimumstandard requirements for an ALTA/ACSM Land Title Survey as well as the minimum standards of practice for landsurveys in Indiana per 865 IAC 12.1.Current owner of record:Central Christian Church of Carmel, IndianaQuitclaim Deed, Instrument No. 9353700 DESCRIPTIONPart of the Southeast Quarter of Section 23, Township 18 North, Range 3 East, located in Clay Township, HamiltonCounty, Indiana, being more specifically described as follows:Beginning at a point on the South line of the Southeast Quarter of Section 23, Township 18 North, Range 3 East,said point of beginning being North 88 degrees 55 minutes 42 seconds East (assumed bearing) 1000.85 feet fromthe Southwest corner of said Southeast Quarter; thence North 00 degrees 00 minutes 28 seconds East 791.89feet;** thence North 88 degrees 55 minutes 42 seconds East 330.11 feet to the East line of the Southwest Quarter ofsaid Southeast Quarter; thence South 00 degrees 00 minutes 28 seconds West 791.89 feet to the Southeast cornerof the Southwest Quarter of said Southeast Quarter; thence South 88 degrees 55 minutes 42 seconds West 330.11feet to the point of beginning.**The underlined course was omitted from the current deed. The omitted course is transcribed from the prior deed ofrecord, Justin A. Roberts to Board of Trustees of Central Christian Church, recorded June 19, 1978, in Deed Record305, page 26 in the office of the Recorder of Hamilton County, Indiana. SURVEYOR'S REPORTThe topographic data was gathered using survey grade GPS and standard radial surveying techniques with anelectronic instrument with data collector. Elevations on hard surfaces or structures are accurate to within 0.05 feet;elevations on natural surfaces are accurate to within 0.1 feet on the date on which the elevations were obtained;however, changes in elevations can occur due to soils swell and subsidence, freeze thaw cycles, and wind andwater erosion. The magnitude of these changes depends upon soils types, seasonal changes, and the frequencyand intensity of wind, rain, and snow events. It is recommended that if the topographic data is to be used for planningor design purposes that a check of elevations be performed prior to any construction activity. Contours are plottedbased upon interpolation of the spot elevations shown hereon and are generally accurate to within one-half of thecontour interval depicted. The following paragraphs are observations and opinions regarding the uncertainties in thelocations of monuments (found or set), record documents and the deed lines as established or reestablished by thissurvey, and as introduced by probable random errors in the measurements made due to the instrumentation andtechniques employed (relative positional accuracy). The survey may show differences between the deed (D) andmeasured (M) dimensions along the deed lines. There may be differences between lines of occupation (possession)and the deed lines as shown on this survey. MONUMENTSMonuments were set or found during the course of this survey, those set in the ground are 5/8" rebar with yellowplastic caps stamped "WEIHE ENGR 0012", unless otherwise noted. Monuments set in hard surfaced areas, such asasphalt, are as indicated on the drawing and have a washer stamped "WEIHE ENGR 0012" where possible. Theremay be 5/8" rebar with red plastic caps stamped "TRAVERSE", wooden stakes, or spike nails found on or near thesubject real estate. These are working points and should not be confused with monuments marking the boundariesof the subject property. Monuments found at or near the deed corners, or along the deed lines of the subject realestate are indicated on the drawing. Because the difference is deemed insignificant, monuments were not set inthose cases where a found monument was not in exact agreement with this survey, but within the tolerancesrequired for a certain Class of survey. The difference may be shown on the survey to accentuate the uncertainty ofthat monument. In those cases where the difference is greater than the relative positional accuracy or uncertainty incontrolling monuments, caution should be exercised before making any improvements along the lines affected.Those uncertainties considered to be significant are discussed below. The monuments established at the corners ofthe subject real estate are within the acceptable relative positional specifications for an Urban Survey, 0.07 feet + 50ppm as defined in 865 IAC 1-12-7.The subject real estate is described by metes and bounds. These types of descriptions make "calls", which arereferences to record, natural, or artificial monuments at the corners; and record, natural or cultural boundary lines.The most common method is to recite the direction and length of each line as one would walk around the perimeterof the property. The following paragraphs are observations relative to those controlling monuments and calls asreferenced in the description.The following are the monuments found or re-established marking the corners common to the Southeast Quarter ofSection 23, Township 18 North, Range 3 East. HCS refers to those monuments as perpetuated by the HamiltonCounty Surveyors office and accepted as controlling corners.Northwest Corner - This corner has not been perpetuated by the HCS. Rather than arrive at some mathematicalsolution for the corner, the decision was made to base the survey on the east line of the southwest quarter of saidsoutheast quarter.Northeast Corner - A brass plug was found at the surface of the road per HCS.Southeast Corner - A Harrison cast iron monument was found at the surface of the road per HCS.Southwest Corner - A Harrison cast iron monument was found at the surface of the road per HCS.Other Aliquot Corners - A Harrison cast iron monument was found at the surface of the road per HCS andreferenced as the southeast corner of the west half of the said southeast quarter, but not used for this survey. Thenortheast corner of the southwest quarter of said southeast quarter has not been perpetuated. See Theory ofLocation for disposition of the east line of said quarter quarter section. THEORY OF LOCATIONThe record description dictates that the north and south lines of the surveyed property run either along or parallelwith the south line of the quarter section. The east and west lines of the property are to run either along or parallelwith the east line of the southwest quarter of said southeast quarter. The common practice for dividing a quartersection into quarters would be to connect lines between the four corners of the quarter section (quarter section lines),then divide the quarter into equal parts by projecting lines between the midpoints of opposite quarter section lines,unless some other controlling circumstance is present. The northwest corner of the southwest quarter has not beenperpetuated; however, the surveyed property is surrounded by long standing residential subdivisions, on the east bythe "Village of Mount Carmel" platted in 1975, and on the west and north by "Thistlewood" Sections 1, 2 and 3, allplatted between 1984 and 1987. After examining both plats, I determined that both had used the midpoint of thesouth line of the quarter section (same bearing and distances within 0.1 foot). The midpoint of the south line is 0.10foot north and 0.25 feet west of the Harrison monument found as referenced by the HCS. The Harrison was not setuntil 2007. In order to preserve the harmony of the area, I established the quarter quarter corner at the midpoint ofthe south line. Both plats give the same bearing and distance for the east line of the southwest quarter of thesoutheast quarter section and I elected to observe the same angular difference between that line and the south lineof the quarter section. I found several monuments marking lot corners within both subdivisions and found that theywere within reasonable agreement with my decision regarding the east line of the southwest quarter of saidsoutheast quarter. In regards to the lead in call difference of 1000.85 feet deed versus 1001.14 feet measured, thesubject deed calls for the width of the property to be 330.11 feet, the adjoining west properties' descriptions makecalls to a point 330.11 feet west of the southeast corner of the quarter quarter section. In my opinion, the intent increating the subject property was to make a 6.00 acre parcel using the dimensions of 330.11 feet wide by 791.89feet long. Incidentally, 330.11 feet would not agree with another aliquot subdivision of the quarter quarter section(e.g. east half of the southwest quarter of the southeast quarter) using any of the available dimensions, neither deednor measured. COMMON TITLE LINESInformation regarding the ownership of the subject real estate or adjoining parcels is that as shown in localgovernment records, or as furnished by others. A comparison was made between the deed calls of the subject realestate and those adjoining parcels with common lines with the surveyed parcel and no discrepancies were found. OCCUPATION ALONG DEED LINESOccupation means some observable improvement either man made or a natural barrier manipulated by man todelineate the property line. It should be noted that not all fences are erected to define property lines and caution iswarranted before accepting this type of barrier as such. One should also be aware that when these types ofoccupation are not in agreement with deed lines certain unwritten rights may develop over the land between themover a certain length of time. Those parties relying on the survey should assume that the uncertainty of ownership ofthese areas where occupation lines and deed lines are not in coincidence is, at least, equal to the magnitude of thedifference. Attention is called to the following:South line - 136th Street, a public thoroughfare, runs along the line within the right of way grant dedicated for itsexistence. A gas line and buried telephone cable run across the south end of the property without easements. Theright of way grant was for the expansion of the street and inclusion of a sidewalk.West line - A six feet tall wood privacy fence erected around Thistlewood, Section One was found to meander alongthe west line from 3.9 feet west of to 2.4 feet east of line. A six feet tall wood privacy fence was found along the eastline of Lot 41 in Thistlewood, near the northwest corner of the surveyed property running from 5.0 feet west of tonearly on the deed line. A cable TV riser is 4.8 feet east of line at Lot 42 in Thistlewood, no easement.North line - No visible improvements were noted; however, 5/8-inch rebar were found 0.36 foot south and 0.20 footwest of the southwest corner and 1.22 feet south and 0.47 foot west of the southeast corner of Lot 35 in ThistlewoodSubdivision. Both rebar were bent and had obviously been disturbed, but could still be accepted by the neighbor asbeing true.East line - At the northeast corner of the surveyed property a wood fence for Lot 380 in the "Village" was found to be1.1 feet west of line; and an old farm type fence ran from 1.8 feet east to as much as 1.0 foot west of the west line ofLot 379. This old farm fence is intermittent along the entire east deed line of the subject real estate and has beenpushed east and west along the line by the growth of trees, bushes and the acts of mankind. The owners of Lots 377and 378 have pushed their landscaped areas onto the surveyed property by as much as 19 feet. The old farm fenceis found again running from 1.0 to 1.8 feet east of the west line of Lot 374.
