HomeMy WebLinkAboutD-2277-16 Carmel Redvelopment AuthoritySPONSOR(S): Councilor Carter Councilor Finkam Councilor Kimball ORDINANCE D-2277-16 AS AMENDED AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA, AMENDING CHAPTER 2, ARTICLE 1. DIVISION H, SECTION 2-8.1 AND CHAPTER 3, DIVISION II, SECTION 3-30 OF THE CARMEL CITY CODE WHEREAS, pursuant to Indiana Code 36-7-11-4, the Common Council of the City of Carmel, Indiana (the "Council"), has established various commissions and boards and assigned them certain duties and responsibilities; and WHEREAS, under Ordinance D-2198-14 (As Amended), enacted on June 12, 2015, the Council required that various commissions and boards report their activities to the Council throughout the year; and WHEREAS, the Council has now determined the Redevelopment Authority was subject to this requirement in error; and WHEREAS, the Council now desires to amend Carmel City Code Sections 2-8.1 and 3-30 to reflect the same. NOW, THEREFORE, BE IT, ORDAINED by the Common Council of the City of Carmel, Indiana, as follows: Section 1. The foregoing Recitals are incorporated herein by reference. Section 2. Chapter 2, Article 1, Section 2-8.1 of the Carmel City Code should -be and the same is hereby amended to read as follows: "Pursuant to I. C., 36-7-14.5-7, the City Redevelopment Authority (the "Redevelopment Authority"), is hereby created as a separate body corporate and politic and as an instrumentality of the City for the purposes and to exercise the powers set forth in the Act or otherwise granted by law. The Redevelopment Authority shall be governed by a board of directors consisting of three members, each of whom shall be appointed by the Mayor of the City. Chapter 3, Division 11, Section 3-30 of the Carmel City Code should be and the same is hereby amended to read as follows: "§'3-30 Order of Business. The Common Council shall conduct its order, of business as follows: (a) Invocation. (b) Pledge of Allegiance. (c) Recognition of City Employees and Outstanding Citizens. (d) Approval of Minutes. (e) Recognition of Persons Who Wish to Address the Council. (f) Council, Mayoral and Clerk -Treasurer Comments/Observations. (g) Action on Mayoral Vetoes. (h) Claims. (i) Committee Reports: (1) Finance, Administration and Rules Committee; (2) Land Use, Annexation and Economic Development Committee; (3) Parks, Recreation and Arts Committee; (4) Utilities, Transportation and Public Safety Committee; (5) All reports designated by the Chair to qualify for placement under .this category. 0) Other Reports: (1) Carmel Redevelopment Commission (Monthly); (2) Economic Development Commission (Quarterly — February, May, August, November); (3) Carmel Historic Preservation Commission (Quarterly — January, April; July, October); (4) Carmel Cable and Telecommunications Commission (Bi -annual — April, October); (5) Ethics Board (Annual — February); (6) Library Board (Annual — February); (7) All reports designated by the Chair to qualify for placement under this category. (k) Old Business. (1) Public Hearings. (m) New Business. (n) Other Business. (o) Announcements. (p) Execution of Documents. (q) Adjournment." Section 3. All prior ordinances or parts thereof inconsistent with any provision of this Ordinance are hereby repealed as of the effective date of this Ordinance. Section 4. If any portion of this Ordinance is for any reason declared to be unconstitutional or invalid, such decision shall not affect the validity of the remaining portions of this Ordinance so long as enforcement of same can be given the same effect.
