3 DIRECTORS OF THE DEPARTMENT OF STORM WATER
4 MANAGEMENT OF THE CITY OF CARMEL, INDIANA
5 WHEREAS, pursuant to IC 8-1.5-5, the Board of Directors (the "Board") of the
6 Department of Storm Water Management (the "Department") of the Storm Water District of the
7 City of Carmel, Indiana (the "District") has caused an investigation to be made of certain areas
8 within the District and finds that it is necessary to acquire, construct, rebuild, repair, extend and
9 improve the storm water system and equipment and preliminarily finds that it is necessary for the
10 public health -and welfare and will be of public utility and benefit to construct certain storm water
11 improvements as described in Exhibit A attached hereto and incorporated herein by reference,
12 together with necessary appurtenances, related improvements and equipment, to serve the
13 District (collectively, the "Project"); and
14 WHEREAS, the Board has caused to be prepared plans, maps, specifications, drawings,
15 details, descriptions and estimates for the Project.
16 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE
17 DEPARTMENT OF STORM WATER MANAGEMENT OF THE CITY OF CARMEL, as
18 follows:
19 Section 1. The Board hereby finds, determines and declares that it is reasonable and
20 necessary for the protection of the public health and welfare of the inhabitants of the District and
21 the safeguarding of the property within the District, and will be of public utility and benefit, to
22 construct the Project. The Board hereby adopts the plans, maps, specifications, drawings,
23 details, descriptions and estimates prepared for the Project.
24 Section 2. The estimated cost of the Project, including incidental expenses in
25 connection with the Project and the financing therefore, is an amount not to exceed Forty -Four
26 Million Five Hundred Thousand Dollars ($44,500,000).
27 Section 3. The officers and representatives of the District are hereby directed to
28 provide notice of the adoption of this Resolution, the fact that plans, maps, specifications,
29 drawings, details, descriptions and estimates have been prepared and are available for inspection,
30 and that a public hearing shall be called when the Board will receive or hear remonstrances, in
31 accordance with IC 8-1.5-5-17.
32 Section 4. The officers and representatives of the District and any member of the
33 Board are hereby authorized, empowered and directed, on behalf of the District, to take any other
34 action as such individual deems necessary or desirable to effectuate the foregoing resolutions,
35 and any actions heretofore made or taken be, and hereby are, ratified and approved.
36 Section 5. This resolution shall be in full force and effect from and after its adoption.
37 PASSED by the Board of Directors of the Department of Storm Water Management of
38 the City of Carmel, Indiana, this `qday of , 2016, by a vote of _ ayes and

The Project consists of all or any portion of (a) certain improvements to the storm water
system of the District, including, without limitation, the design, inspection, construction,
renovation, replacement, improvement and/or equipping of certain storm water sewers, drainage
improvements, culverts, structures, detention swales and ponds in the District, together with any
sidewalk, drainage, streetscaping, landscaping and/or other improvements related thereto; (b) the
acquisition of any land or right-of-way necessary therefor; and (c) all utility relocation,
acquisition, design, inspection, construction, demolition, renovation, remediation, improvement,
excavation, site work preparation and/or equipping projects related to the projects described in
clauses (a) and (b) and any and all costs related thereto (clauses (a) through and including (c),
collectively, the "Project"). The estimated costs of the Project are set forth below:
