ONE TIME BED BUG CANINE INSPECTION
Purpose. To detect the presence of bed bugs in the inspected areas utilizing trained and certified scent detection canines
which may or may not be evidenced by visual assessment.
Fee. Fee for inspection will be $159'00 and is due and payable upon completion of the initial canine inspection.
Limits of Inspection/Exclusions. Inspector does not remove floor and wall coverings or move furniture, open walls or
perform any type of destructive inspection. Certain structural areas are considered inaccessible and impractical to inspect including
but not limited to: areas for which there is no access without defacing or tearing out lumber, masonry, roofing or finished
workmanship; crawl spaces; portions of attic concealed or made inaccessible by insulation, belongings, equipment or ducting;
portions of the interior made inaccessible by furnishings; areas where locks prevent access; areas concealed by appliances, stored
materials or heavy vegetation. Note: Although there is no economically practical method to make these areas accessible, they may
be subject to bed bug infestation. NO OPINION IS RENDERED CONCERNING THE CONDITIONS IN THESE AFOREMENTIONED OR
OTHER INACCESSIBLE AREAS. Action Pest Control shall not be responsible or held liable for the following: 1.Expenses related to the
replacement of linen, upholstery, furniture, mattress, soiling or related costs; 2. Expenses related to medical evaluation or treatment
for bites associated with bed bugs; 3. Damages or expenses for any claim of personal injury related to an infestation of bed bugs; 4.
Loss of income claimed to be related to any bed bug bites or associated illnesses.
Arbitration. Any dispute concerning this agreement shall be resolved by binding, non-appeal able arbitration conducted in
accordance with the rules of the American Arbitration Association, except that the parties shall mutually agree upon an Arbitrator
who is familiar with the pest inspection industry.
Applicable Law.This Agreement shall be governed in accordance with laws of the State in which service is performed.
UNCONDITIONAL RELEASE AND LIMITATION OF LIABILITY. It is understood and agreed that Action Pest Control is not
an insurer and, that the inspection to be provided under this agreement shall not be construed as a guarantee or warranty of the
adequacy, performance or condition of any structure, item or system of the subject property. Customer does hereby release and
indemnify Action Pest Control and its respective agents and employees of and from all liability and responsibility for the cost of repair
or replacement of any unreported defect or deficiency and for any consequential damage, property damage or personal injury of any
nature. In the event that inspector or its respective agents or employees are found liable due to breach of contract, breach of
warranty, negligent misrepresentation, negligent hiring or any other theory of liability, then the cumulative aggregate total liability of
Action Pest Control and our respective agents and employees shall be limited to a sum equal to the amount of the fee paid by
customer for the inspection and annual warranty.
By signing below, Customer acknowledges that Customer has read, understood, and agrees to the terms and conditions of this
agreement, including (but not limited to) the limitation of liability, arbitration clause and limitation period, and agree to pay the fee
listed above. In addition, Customer acknowledges and agrees that the Inspector may notify any appropriate public agency, of any
condition(s)discovered that may pose a safety or health concern and which notification is required by statute or law.
