D-2311-16 AN ORDINANCE -OF THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA, AMENDING CITY CODE CHAPTER 8, ARTICLE 3, SECTION 8-21 Synopsis: Amends speed limit zones on certain City streets. WHEREAS, the City of Carmel, Indiana, has the authority to establish motor vehicle speed limits pursuant to Indiana Code § 9-21-5-6 and City Code Section 8-15; and WHEREAS, the Common Council now finds it necessary to establish certain speed limits on certain City streets. NOW, THEREFORE, BE IT ORDAINED, by the Common Council of the City of Carmel, Indiana, as follows: Section 1. The foregoing Recitals are fully incorporated herein by this reference. Section 2. Carmel City Code Section 8-21(a) should be and the same is hereby amended to read as follows: (a) No person shall drive a motor vehicle in excess of 30 miles per hour on the following streets: (1) Carmel Drive from Pennsylvania Street to Keystone Parkway. (2) Dorset Boulevard from Illinois Street to Spring Mill Road. (3) Gray Road from 106th Street to 146th Street. (4) Pennsylvania Street from Main Street to Carmel Drive. (5) 103rd Street from Meridian Street to Illinois Street. (6) 126th Street from Rangeline Road to River Road. (7) Pennsylvania Parkway, from College to 103rd Street. (8) Rangeline Road from Clay Terrace Boulevard to 1161h Street. (9) 106th Street from Keystone Parkway to Gray Road. (10) 116th Street from Springmill Road to US Highway 31. (11) Main Street from 4th Avenue NE/ 4th Avenue SE to River Road. (12) West Road from 121st Street to 141st Street. (13) Mayflower Park Drive. (14) Six Points Road from Main Street to 136th Street. (15) Oak Ridge Road from 136th Street to 146th Street. (16) Rohrer Road from Englin Drive/136th Street to 146th Street. (17) 111th Street from Pennsylvania Street to Illinois Street. (18) 136th Street from Old Meridian Street to Gray Road. (19) Main Street from 4th Avenue S.W. to Old Meridian Street. (20) 3rd Avenue S.W. from Carmel Drive to 2nd Street S.W. The Carmel Street Department is directed to promptly add the appropriate signage to fulfill the mandates contained in this Ordinance upon its passage. Section 4. The remaining provisions of Carmel City Code Sections 8-21 are not affected by this Ordinance and shall remain in full force and effect. Section 5. All prior ordinances or parts thereof inconsistent with any provision of this Ordinance are hereby repealed, to the extent of such inconsistency only, as of the effective date of this Ordinance. However, the repeal or amendment by this Ordinance of any other ordinance does not affect any rights or liabilities accrued, penalties incurred or proceedings begun. prior to the effective date of this Ordinance. Those rights, liabilities and proceedings are continued and penalties shall be imposed and enforced under such repealed or amended ordinance as if this Ordinance had not been adopted. Section 6. If any portion of this Ordinance is for any reason declared to be unconstitutional or invalid, such decision shall not affect the validity of the remaining portions of this Ordinance so long as enforcement of same can be given the same effect.. Section 7.
