D-2303-16 AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA, AMENDING CHAPTER 8, ARTICLE 5, SECTION 8-48(n) AND ADDING SUBSECTION (o) THERETO Synopsis: This ordinance creates temporary "No -Parking" and "Tow -Away" zones for the PGA BMW Golf Championship WHEREAS, pursuant to Indiana Code 9-21-1-3(a)(1), the City of Carmel Indiana (the "City"), within the reasonable exercise of its police power may, by ordinance, regulate vehicular parking; and WHEREAS, the City currently regulates vehicular parking within its corporate limits, such regulations being codified, in part, within Carmel City Code § 8-48; and WHEREAS, from time to time, the City sponsors and/or hosts large-scale events, such as the PGA BMW Championship held at the Crooked Stick Golf Course (the "Event"), that create an increase in traffic for certain surrounding residential areas; and WHEREAS, during the Event, the vehicular traffic within and around the neighborhoods adjacent to the Event (hereinafter, the "Neighborhoods") will drastically increase, causing a public safety situation that requires temporary, specific, and localized parking enforcement and regulation; and WHEREAS, in order to address the special traffic and parking concerns that will occur in the Neighborhoods, during and as a result of the Event, the Common Council of the City of Carmel, Indiana, now finds it in the public interest to create temporary "No- Parking "restrictions and "Tow -away" zones within the City's corporate limits. NOW, THEREFORE, BE IT ORDAINED, by the Common Council of the City of Carmel, Indiana, as follows: Section 1. The foregoing Recitals are fully incorporated herein by this reference. Section 2. Chapter 8, Article 5, Section 8-48, subsection (n), shall be amended, and subsection (o) shall be added to, the City Code, and the same shall now read as follows: Ordinance D - Page One of Four Pages This Ordinance was prepared by Ashley M. C:\Users\jquinn\AppData\Local\Microsoft\Windows\Temporary Internet Files\Content.Outlook\ZG7CRSHI\Ordinance D-2303-16- Temporary No Parking and Tow Away Zones for BMW Championship clean.docx7/18/2016 5:19:24 PM SPONSOR(S): Councilor Carter Councilor Rider "(n) No vehicle shall be parked on either side of the following streets at any time between 6:00 a.m. and 6:00 p.m. on any date on which the PGA BMW Championship is being held at the Crooked Stick Golf Course, located within the City's corporate limits: 1) Prestwick Lane; 2) Prestwick Circle; 3) Torrey Pine Circle; 4) St. Andrews Lane; 5) St. Andrews Circle; 6) Mansfield Place; 7) Braemar Court; 8) Belmont Court; 9) Sutton Avenue; 10) Sutton Place Drive East; 11) Sutton Place Drive South; 12) Sutton Place Drive West 13) Royal Place; 14) Royal Court; 15) Royal Circle; 16) Royal Blvd; 17) Greystone Court; 18) Newbridge Court; 19) Westbury Place Drive; 20) Chatham Court; 21) Bishop Circle; 22) Windmere Blvd; 23) Hyde Park (o) The Carmel Street Department shall post appropriate signs or markings setting forth the above parking limitations and indicating that the above locations are "Tow -Away" zones." Section 3. The remaining provisions of Carmel City Code Sections 8-48 are not affected by this Ordinance and shall remain in full force and effect. All prior ordinances or parts thereof inconsistent with any provision of this Ordinance are hereby repealed, to the extent of such inconsistency only, as of the effective date of this Ordinance, such repeal to have prospective effect only. However, the repeal or amendment by this Ordinance of any other ordinance does not affect any rights or liabilities accrued, penalties incurred or proceedings begun prior to the effective date of this Ordinance. Those rights, liabilities and proceedings are continued and penalties shall be imposed and enforced under such repealed or amended ordinance as if this Ordnance had not been adopted. Section 5. If any portion of this Ordinance is for any reason declared to be invalid by a court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance so long as enforcement of same can be given the same effect. Section 6. This Ordinance shall be in full .force and effect from and after the date of its passage and signing by the Mayor and such publication as required by law. Section 7. The Carmel Street Department is directed to promptly add the appropriate signage to fulfill the mandates contained in this Ordinance upon its passage.
