D-2337-16 AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA, ADDING SECTION 8-42 TO CHAPTER 8, ARTICLE 4 OF THE CARMEL CITY CODE Synopsis: Allows the operator of a large vehicle to deviate from the lane in which the operator is driving to the extent necessary to approach and drive through a roundabout. WHEREAS, Indiana Code 9-21-1-2 allows a municipality to adopt by ordinance additional traffic regulations with respect to highways under the authority's jurisdiction; and WHEREAS, the Common Council has now determined that permitting the operator of a large vehicle to deviate from the lane in which the operator is driving to the extent necessary to approach and drive through a roundabout is in the public interest and in furtherance of public safety. NOW, THEREFORE, the Common Council ordains and states as follows: Section 1. The foregoing Recitals are fully incorporated herein by this reference. Section 2. Carmel City Code Chapter 8, Article 4, Section 8-42 is hereby added to the Carmel City Code and shall read as follows: "§ 8-42 Large Vehicles in Roundabouts (a) The operator of a vehicle with a length of not less than 40 feet or a width of not less than 'J may, with due regard for all other traffic, deviate from the lane in which the operator is driving to the extent necessary to approach and drive through a roundabout. (b) The operator of a vehicle shall yield the right-of-way to any vehicle with a length of not less than 40 feet or a width of not less than fttfeet when approaching or driving through a roundabout at approximately the sarl' time or so closely as to constitute a hazard of collision and, if necessary, shall reduce speed or stop in order to so yield." Section 3. If any portion of this Ordinance is for any reason declared to be unconstitutional or invalid, such decision shall not affect the validity of the remaining portions of this Ordinance so long as enforcement of same can be given the same effect. Section 4. This Ordinance shall be in full force and effect from and after its passage and signing by the Mayor and such publication as is required by law.
