ORDINANCE D-2332-16
AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA,
AMENDING THE DEFINITION OF "FULL-TIME EMPLOYEE" AS THE SAME IS
CONTAINED IN CHAPTER 2, ARTICLE 3, DIVISION I, SECTION 2-39
OF THE CARMEL CITY CODE
Synopsis: This ordinance amends the definition of "full-time employee" in Chapter 2, Article 3,
Division I, Section 2-39 of the Carmel City Code to increase the required number of hours worked
by all non-exempt civilian City employees from thirty-seven and a half (37'/2 ) hours to forty (40)
hours per week or eighty (80) hours per two-week pay period, such change to become effective on
January 1, 2018.

Section 1. The foregoing Recitals are incorporated herein by this reference.
S ction 2. Th definit "full-time employee", as the same is contained in Chapter 2, Article 3
Divisio I, Section 2- of the azure City Code, should be and the same is hereby amended to read as
follow
"Fu -Time Em loyee shall, to and including December 31, 2017, mean an employee who is regularly
sellled to wo k at least 371/2 hours per week, or at least 75 hours per two-week pay period, on a year-
round ba ' and shall, on and after January 1, 2018, mean an employee who is regularly scheduled to
work at least ours per week, or at least 80 hours per two-week pay period, on a year round basis."
Section 3. The %gaining provisions of City Code Section 2-39 are not affected by this Ordinance
and shall remain in full force and effect.

Section 4. Should any provision or portion of this Ordinance be declared by a court of competent
jurisdiction to be invalid for any reason, the remaining provisions shall not be affected so long as they
can, without the invalid provision, be given the effect intended by the Common Council in adopting this
Ordinance. To this end, the provisions of this Ordinance are severable.
Section 5. All prior City ordinances or parts thereof that are inconsistent with any provision of
this Ordinance are hereby repealed as of the effective date of this Ordinance.
Section 6. This Ordinance shall be in full force and effect from and after the date of its
passage, execution by the Mayor, and publication as required by law.
