The approval of this variance will not be injurious to the public health, safety, morals and general welfare of the community because: the variance would improve the pedestrian experience. 2. The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner because: the improvement to the pedestrian experience substantially increases both the use and value of adjacent properties. 3. The strict application of the terms of the Zoning Ordinance to the property will result in practical difficulties in the use of the property because: the desires of the developer, planning department and engineers to improve the pedestrian experience within the project would not be able to be obtained. Page 12 - filename: development standards variance 2016 v.2.doCxrev. 6/30116 Statement of Variance Old Town Development L.L.C. is proposing the approval of a development standards variance for the property located at 526 S. Rangeline Road, Carmel, IN 46032. The site is zoned PUD/Planned Unit Development and is not within any overlay zone. The application is identified with Docket Number: 16120020 V. Old Town Development L.L.C. has filed this request on behalf of the owner, Midtown East Block 3 L.L.C., for approval of the following Development Standards Variance: • PUD CH 10.02. C: Finished I" Floor elevation between 2-6 feet above sidewalk allowed; 7 feet requested. The variance we are seeking is to increase the first floor elevation by an additional foot in order to accommodate flat sidewalks adjacent to Motion Boulevard per the request of the Carmel Plan Commission due to the proposed grading plan by the Carmel Engineering Department. Included with this request for approval of the Variance are the (i) Statement of Support, (ii) Area Location Map, (iii) Site plans, (iv) Floor plans, and (v) Elevations. Friday, January 13, 2017 Dear Carmel Board of Zoning Appeals Member We have filed a Development Standards Variance request on behalf of Midtown East Block 3 L.L.C. for the property at 526 S. Rangeline Road, Carmel, IN for the Midtown Flats Project. The final design plan for the Midtown Flats project resulted in a finished floor elevation for the first floor that was seven (7) feet above the sidewalk, where the PUD only allows for two (2) to six (6) feet above the sidewalk. We believe that an increase of one (1) additional foot in the elevation above the sidewalk in orderto accommodate flat sidewalks adjacent to Monon Boulevard per the request of the Carmel Plan Commission due to the proposed grading plan by the Carmel Engineering Department improves the pedestrian experience within the project. We believe the buildings elevations are attractive and will be a good fit for the project.
