Variance: Use: add bank ATM as permitted use in OM/SFA District.
FINDINGS OF FACT – USE VARIANCE
1. The approval of this variance will not be contrary to the public interest, due to the existence of special
condition(s) such that enforcement of the zoning ordinance will result in unnecessary hardship because:
The proposed use is necessary to complete a proposed multifamily-retail mixed-use development to be
constructed on the parcel located adjacent to the east of the subject real estate. The adjacent
parcel is within the Old Meridian-Mixed Use zoning district which permits such development.
Because the zoning of the adjacent parcel, as a part of the Old Meridian Overlay District, was done without the
benefit of a development plan, the mixed use zoning district did not allow for sufficient area to complete the
mixed use development that is being constructed and which is in furtherance of the intended redevelopment of
the Old Meridian Street corridor.
2. The approval of this variance will not be injurious to the public health, safety, morals and general welfare of
the community because:
The proposed ATM use on the subject site is a reasonable extension of the permitted
development on the adjacent parcel in the Old Meridian-Mixed Use zoning district and the proposed
use is well within the intent of adopted land use plan policies for the Old Meridian Street corridor.
3. The use and value of the area adjacent to the property included in the variance will not be affected in a
substantially adverse manner because:
The proposed use and development is designed to be compatible with existing and proposed
development surrounding the site.
4. The need for the variance arises from a natural condition peculiar to the subject property because:
The applicable zoning district was established without regard to property ownership or to the relationship with
the development occurring in the adjacent mixed-use zoning district.
5. The approval of this variance does not substantially interfere with the Carmel/Clay Comprehensive Plan
because:
The proposed use is anticipated by plan policies for the Old Meridian District and the subject property and
represents a reasonable extension and continuation of the land use classification to the east.
DECISION
IT IS THEREFORE the decision of the Carmel/Clay Board of Zoning Appeals that Use Variance Docket No. 17010007 UV is
granted, subject to any conditions stated in the minutes of this Board, which are incorporated herein by reference and made
a part hereof.

Huntington Bank is seeking a use variance to add “ATM” (automated teller machine) as a
permitted use in the OM/SFA District at The Olivia on Main. (20G.05.01 A & Appendix A:
Schedule of Uses)

STATEMENT IN SUPPORT OF VARIANCE
Use: ATM
The requested variance is necessary in order to complete a proposed mixed-use
(multifamily-retail) development that is permitted within the Old Meridian-Mixed Use zoning
district and that is located adjacent to the east of the subject proposed ATM location. The
establishment of the mixed use zoning classification for the eastern portion of the subject real
estate was done without the benefit of a development plan. The mixed-use project was granted
the necessary zoning approvals in order to accommodate the proposed development in both the
Old Meridian Mixed-Use and Single Family Attached districts in furtherance of the
redevelopment of the Old Meridian Street corridor as contemplated by the overlay ordinance.
The addition of the proposed ATM project on the subject site is an essential component of the
overall mixed-use project and necessary for the proper development of the mixed use parcel in
furtherance of the intent of the land use plan policies for the Old Meridian Street corridor.
