COUNCIL CHAMBERS/CITY HALL/ONE CIVIC SQUARE MEETING CALLED TO ORDER Council President Sue Finkam; Council Members: Ronald E. Carter, Anthony Green H. Bruce Kimball, Kevin D. Rider, Jeff Worrell, and Deputy Clerk Jacob Quinn were present. Councilor Laura D. Campbell was not present Council President Finkam called the meeting to order at 6:01 p.m. INVOCATION Rev. Dr. Shelly Wood, Orchard Park Presbyterian Church, delivered the Invocation. Councilor Green led the Pledge of Allegiance. RECOGNITION OF CITY EMPLOYEES AND OUTSTANDING CITIZENS Nancy Heck, Director of the Department of Community Relations, presented and accepted awards for the City of Carmel as part of the 2016 Philo Festival of Media Arts Awards sponsored by the Alliance for Community Media. Chief Dave Haboush, Carmel Fire Department, recognized Firefighter/Paramedic Rick Viehe as 21.5 years of serving the City of Carmel. APPROVAL OF MINUTES Councilor Rider moved to approve minutes from the February 6, 2017 Regular Meeting. Councilor Kimball seconded. There was no Council discussion. Council President Finkam called for the vote. Minutes were approved 6-0. RECOGNITION OF PERSONS WHO WISH TO ADDRESS THE COUNCIL Miranda Frausto, Carmel Promise Project, spoke in favor of adopting the climate resolution. Jose Ortuzar, Carmel Promise Project, spoke in favor of adopting the climate resolution. Benjamin Rayhill, Carmel Promise Project, spoke in favor of adopting the climate resolution. Alex Workman, Carmel Promise Project, spoke in favor of adopting the climate resolution. 'I Jodh Pulleta, Carmel Promise Project, spoke in favor of adopting the climate resolution. Natalie Workman, Carmel Promise Project, spoke in favor of adopting the climate resolution. COUNCIL AND MAYORAL COMMENTS/OBSERVATIONS Councilor Kimball mentioned the redesign of a portion of the Monon Trail. Council President Finkam mentioned that she is hosting a road construction meeting for Northeast residents on February 23ra ACTION ON MAYORAL VETOES There were none. CLAIMS Councilor Rider moved to approve Payroll in the amount of $1,651,537.23. Councilor Kimball seconded. There was no Council discussion. Council President Finkam called for the vote. Payroll was approved 6- 0. Councilor Rider moved to approve General Claims in the amount of $6,131,571.02. Councilor Green seconded. There was no Council discussion. Council President Firikam called for the vote. Claims were approved 6-0. Councilor Rider moved to acknowledge Wire Transfers in the amount of $4,646,658.10 Councilor Green seconded. There was no Council discussion. Council President Finkam called for the vote. Motion to acknowledge was approved 6-0. COMMITTEE REPORTS Councilor Rider announced that the Finance, Utilities and Rules Committee had not met. Councilor Kimball announced that the Land Use and Special Studies Committee had not met. OTHER REPORTS Bob Swaney, Director of the Carmel Clay Public Library, gave the annual report to Council. OLD BUSINESS Council President Finkam announced the Second Reading of Ordinance D-2345-17; An Ordinance of the Common Council of the City of Carmel, Indiana, Reallocating Certain 2017 Appropriations. Councilor Rider addressed Council regarding the issue. Councilor Rider moved to approve Ordinance D- 2345-17. Councilor Carter seconded. There was no Council discussion. Council President Finkam called for the vote. Ordinance D-2345-16 was approved 6-0. PUBLIC HEARINGS Council President Finkam announced the First Reading of Ordinance D-2350-17; An Ordinance of the Common Council of the City of Carmel, Indiana, Authorizing and Approving an Additional Appropriation of Funds from the Operating Balance of the General Fund to the Clerk -Treasurer's Budget. Councilor Rider moved to introduce. Councilor Carter seconded. Councilor Rider presented the item to Council. Council President Finkam opened the public hearing at 6:37 p.m. Seeing no one who wished to address Council, Council President Finkam closed the public hearing at 6:37:30 p.m. Council President Finkam held the item over to the next meeting and did not refer it to committee. Council President Finkam announced the First Reading of Ordinance D-2351-17; An Ordinance of the Common Council of the City of Carmel, Indiana, Authorizing and Approving an Additional Appropriation of Funds from the Operating Balance of the General Fund to the Carmel Fire Department Budget. Councilor Rider moved to introduce. Councilor Carter seconded. Chief Dave Haboush presented the item to Council. Council President Finkam opened the public hearing at 6:42 p.m. Seeing no one who wished to address Council, Council President Finkam closed the public hearing at 6:42:30 p.m. There was brief council discussion. Councilor Rider moved to suspend the rules and act on the item this evening. Councilor Carter seconded. There was no Council discussion. Council President Finkam called for the vote. The motion to suspend was approved 6-0. Councilor Rider moved to approve Ordinance D-2351-17. Councilor Carter seconded. There was no Council discussion. Council President Finkam called for the vote. Ordinance D-2351-17 was approved 6-0. NEW BUSINESS Council President Finkam announced the First Reading of Ordinance D-2348-17; An Ordinance of the Common Council of the City of Carmel, Indiana, Authorizing the Issuance of One or More Series of City of Carmel, Indiana Taxable Economic Development Lease Rental Revenue Bonds (Midtown West Project), Lending the Proceeds Thereof to the Borrower Thereof, Approving a Lease Between the City of Carmel Midtown Building Corporation, As Lessor, and the City of Carmel Redevelopment Commission and Midtown Capital Partners, LLC or an Affiliate Thereof, As Co -Lessees, and Authorizing and Approving Other Actions Related Thereto. Councilor Worrell moved to introduce. Councilor Kimball seconded. Bruce Donaldson, Barnes and Thornburg, presented the item to Council. Corrie Meyer, Director of the Carmel Redevelopment Commission, addressed Council. There was extensive Council discussion. Council President Finkam referred the item to the Finance, Utilities and Rules Committee Council President Finkam announced the First Reading of Ordinance D-2349-17; An Ordinance of the Common Council of the City of Carmel, Indiana, Authorizing the Issuance of the City of Carmel, Indiana Economic Development Revenue Bonds, Series 2017 (Monon apartment L.L.C. Project), and Authorizing and Approving Other Actions in Respect Thereto. Councilor Worrell moved to introduce. Councilor Rider seconded. Bruce Donaldson presented the item to Council. Council President Finkam referred the item to the Finance, Utilities and Rules Committee Council President Finkam announced the First Reading of Ordinance D-2352-17; An Ordinance of the Common Council of the City of Carmel, Indiana, Amending Chapter 2, Article 4, Section 2-102 of the Carmel City Code. Councilor Worrell moved to introduce. Councilor Rider seconded. Councilor Worrell presented the item to Council. Corrie Meyer addressed Council. There was brief council discussion. Councilor Rider stated that he would recuse himself from voting as these donated meals have been purchased from his restaurant in the past. Councilor Worrell moved to suspend the rules and act on the item this evening. Councilor Green seconded. There was no Council discussion. Council President Finkam called for the vote. The motion to suspend failed 5-1 (Carter opposed). Council President Finkam referred the item to the Finance, Utilities and Rules Committee Council President Finkam announced the First Reading of Ordinance D-2353-17; An Ordinance of the Common Council of the City of Carmel, Indiana, Amending Chapter 2, Article 5, Section 2-184(a)(1) of the Carmel City Code. Councilor Rider moved to introduce. Councilor Green seconded. Councilor Carter presented the item to Council. Jon Oberlander, Assistant City Attorney, presented to Council a Scrivener's error and stated that on line 29 Board members serve terms of two years each should not be struck. Councilor Rider moved to suspend the rules and act on the item this evening. Councilor Carter seconded. There was no Council discussion. Council President Finkam called for the vote. The motion tc suspend passed 6-0. Councilor Rider moved to approve Ordinance D-2353-17 As Amended. Councilor Carter seconded. There was no Council discussion. Council President Finkam called for the vote. Ordinance D-2353-17 As Amended was approved 6-0. Council President Finkam announced Resolution CC -02-20-17-01; A Resolution of the Common Council of the City of Carmel, Indiana Approving Certain Matters in Connection with the Old Towne Economic Development Area. Councilor Rider moved to introduce. Councilor Kimball seconded. Bruce Donaldson presented the item to Council. Councilor Rider moved to approve Resolution CC -02-20-17-01. Councilor Kimball seconded. There was no Council discussion. Council President Finkam called for the vote. Resolution CC -02-20-17-01 was approved 6-0. Council President Finkam announced Resolution CC -02-20-17-02; A Resolution of the Common Council of the City of Carmel, Indiana Approving Certain Matters in Connection with the 96th Street/Hazel Dell Parkway Economic Development Area. Councilor Worrell moved to introduce. Councilor Rider seconded. Bruce Donaldson presented the item to Council. Councilor Rider moved to approve Resolution CC -02-20-17-02. Councilor Worrell seconded. There was no Council discussion. Council President Finkam called for the vote. Resolution CC -02-20-17-02 was approved 6-0. Council President Finkam announced Resolution CC -02-20-17-03; A Resolution of the Common Council of the City of Carmel, Indiana Approving Certain Matters in Connection with the Old Meridian Economic Development Area. Councilor Rider moved to introduce. Councilor Worrell seconded. Bruce Donaldson presented the item to Council. Councilor Rider moved to approve Resolution CC -02-20-17-03. Councilor Worrell seconded. There was no Council discussion. Council President Finkam called for the vote. Resolution CC -02-20-17-03 was approved 6-0. Councillor Rider moved to add Resolution CC -02-20-17-04 to the agenda under Other Business. Councillor Carter seconded. There was no Council discussion. Council President Finkam called for the vote. The motion was approved 6-0. OTHER BUSINESS Council President Finkam announced the Resolution CC -02-20-17-04; A Resolution of the Common Council of the City of Carmel, Indiana, Regarding Climate Resilience & Recovery. Councilor Worrell moved to introduce. Councilor Carter seconded. Lesley Webb, President of the Carmel Green Initiative, presented the item to Council. There was brief Council discussion. Councilor Rider moved to approve Resolution CC -02-20-17-04. Councilor Worrell seconded. There was no Council discussion. Council President Finkam called for the vote. Resolution CC -02-20-17-04 was approved 6-0. 2 1 1 Carmel Ethics Board (Terms Expire 1/1/18 and 1/1/19, two year terms); Two appointments. Item Remains Tabled.
