COUNCIL CHAMBERS/CITY HALL/ONE CIVIC SQUARE MEETING CALLED TO ORDER Council President Sue Finkam, Council Members Ronald E. Carter, Laura D. Campbell, H. Bruce Kimball, Jeff Worrell, Anthony Green and Kevin D. Rider. Clerk -Treasurer Christine Pauley, and Deputy Clerk Jacob Quinn were present. Councilor President Finkam called the meeting to order at 6:01 p.m. INVOCATION Executive Pastor Steve Wallen, Genesis Church, pronounced the invocation. Councilor Campbell led the Pledge of Allegiance. RECOGNITION OF CITY EMPLOYEES AND OUTSTANDING CITIZENS There were none. APPROVAL OF MINUTES Councilor Campbell moved to approve minutes from the December 19, 2016 Regular Meeting. Councilor Rider seconded. There was no Council discussion. Council President Finkam called for the vote. Minutes were approved 6-0 (Green abstained). Councilor Rider moved to approve minutes from the December 29, 2016 Special Meeting. Councilor Campbell seconded. There was no Council discussion. Council President Finkam called for the vote. Minutes were approved 5-0 (Green and Campbell abstained). RECOGNITION OF PERSONS WHO WISH TO ADDRESS THE COUNCIL There were none. COUNCIL. MAYORAL AND CLERK -TREASURER COMMENTS/OBSERVATIONS Councilor_ Rider welcomed Councilor Green as the newest member of Council. Councilor Worrell congratulated Chis Lewis who was named Vice -President of the Great American Songbook Foundation. He also thanked the Department of Community Relations for putting on the New Year's Eve fireworks. Councilor Green introduced himself to Council and residents of Carmel. Clerk -Treasurer Pauley welcomed Councilor Green to Council. Council President Finkam announced that Councilor Rider would be chairing the Finance Committee which would include Councilors Worrell and Carter as members, Councilor Kimball will serve as the Land Use Committee chair with Councilors Green and Campbell as members, and Councilor Campbell will be the Chaplain for Council. ACTION ON MAYORAL VETOES There were none. CLAIMS Councilor Campbell moved to approve Payroll in the amount of $1,679,630.50. Councilor Rider seconded. There was no Council discussion. Council President Finkam called for the vote. Payroll was approved 6-0 (Green abstained). Councilor Rider moved to approve General Claims in the amount of $3,863,146.95. Councilor Campbell seconded. There was no Council discussion. Council President Finkam called for the vote. Claims were approved 6-0 (Green abstained). Councilor Rider moved to approve Retirement in the amount of $92,515.72. Councilor Campbell seconded. There was no Council discussion. Council President Finkam called for the vote. Retirement was approved 6-0 (Green abstained). COMMITTEE REPORTS Councilor Rider announced that the Finance, Utilities and Rules Committee had met and had discussed D- 2343-16 and the ordinance remains in committee. Councilor Kimball announced that the Land Use and Special Studies Committee had not met. OTHER REPORTS Corrie Meyer gave the monthly report for the Carmel Redevelopment Commission. Sam Burgess, Indiana Landmarks, gave a report for the Carmel Historic Preservation Commission. OLD BUSINESS Council President Finkam announced the Third Reading of Ordinance D-2338-16; An Ordinance of the Common Council of the City of Carmel, Indiana, Amending Chapter 7, Article 3, Section 7-27 of the Carmel City Code. This item remains in the Land Use and Special Studies Committee. Council President Finkam announced the Second Reading of Ordinance D-2339-16; An Ordinance of the Common Council of the City of Carmel, Indiana, Adding Subsections (58) and (59) to Chapter 8, Article 5, Section 8-47(a) of the Carmel City Code. Councilor Rider presented the item to Council. Councilor Rider moved to approve Ordinance D-2339-16. Councilor Worrell seconded. There was no 2 Council discussion. Council President Finkam called for the vote. Ordinance D-2339-16 was approved 6- 0 (Green abstained). Council President Finkam announced the Second Reading of Ordinance D-2340-16; An Ordinance of the Common Council of the City of Carmel, Indiana, Amending Chapter 3, Article 1, Division 2, Sections 3-25 and 3-30 of the Carmel City Code. Councilor Rider reported that the ordinance is returning from the Finance, Utilities and Rules Committee with a positive 3-0 recommendation and proposed amendments. Ashley Ulbricht, City Attorney, addressed Council regarding the ordinance and proposed changes made in committee. Councilor Rider moved to amend Ordinance D-2340-16 by striking Pro Tempore anywhere in the ordinance, by amending line 55 to read Determine who may sit in any seats other than those set aside for the public during any Council meeting, on line 70 strike Administration and inset Utilities, and on line 71 strike Annexation and Economic Development Committee and insert Special Studies Committee and inserting Version C in whole. Councilor Carter seconded. There was no Council discussion. Council. President Finkam called for the vote. The motion to amend was approved 6-0 (Green abstained). Councilor Rider moved to approve Ordinance D-2340-16 As Amended. Councilor Carter seconded. There was no Council discussion. Council President Finkam called for the vote. Ordinance D-2340-16 As Amended was approved 6-0 (Green abstained). Council President Finkam announced the Second Reading of Ordinance D-2342-16; An Ordinance of the Common Council of the City of Carmel, Indiana, Adding Chapter 2, Article 2, Section 2-24 to the Carmel City Code. Jon Oberlander, Assistant City Attorney, presented the Finance, Utilities and Rules Committee Version A that came back with a positive 3-0 recommendation. Councilor Worrell moved motion to amend Ordinance D-2342-16 by inserting Version A in whole and further amending by inserting on line 118f A member of the Audit Committee may not be a City contractor, or an owner, officer, or employee of a City contractor. An Audit Committee member may not be a City bondholder, strike co- on line 40, and strike or on line 62. Councilor Rider seconded. There was brief Council discussion. Council President Finkam called for the vote. The motion to amend was approved 6-0 (Green abstained). Councilor Rider moved to approve Ordinance D-2342-16 As Amended. Councilor Campbell seconded. There was no Council discussion. Council President Finkam called for the vote. Ordinance D- 2342-16 As Amended was approved 6-0 (Green abstained). Council President Finkam announced the Second Reading of Ordinance D-2343-16; An Ordinance of the Common Council of the City of Carmel, Indiana, Adding Chapter 6, Article 5, Division III, Section 6- 100 to the Carmel City Code; Sponsor(s): Councilor(s) Carter, Finkam and Worrell. This item remains in the Finance, Utilities and Rules Committee PUBLIC HEARINGS Council President Finkam announced the First Reading of Ordinance Z-621-16; An Ordinance of the Common Council of the City of Carmel, Indiana Establishing the Clay Corner Planned Unit Development District. Jim Shinaver, Nelson & Frankenberger, presented the item to Council. Council President Finkam opened the Public Hearing at 6:43 p.m. Jill Meisenheimer, Carmel Citizens for Responsible Zoning, expressed concerns regarding the density for the project. Dee Fox addressed the Council in opposition to the project based on the proposed location. Thomas Roller, whose property abuts the proposed project site, spoke in opposition to the project as it projects to lower his home value. Furthermore, there is currently no screening in place between the project site and his property. Council President Finkam closed the Public Hearing at 6:54. Councilor Finkam referred Ordinance Z- 621-16 to the Land Use and Special Studies Committee. NEW BUSINESS Council President Finkam announced the First Reading of Ordinance D-2344-17; An Ordinance of the Common Council of the City of Carmel, Indiana, Enacting and Adopting a Supplement to the Code of Ordinances of the City of Carmel, Indiana. Councilor Rider moved to introduce. Councilor Campbell seconded. Doug Haney, Corporation Counsel, addressed Council. Councilor Rider moved to suspend the rules and act on this tonight. Councilor Worrell seconded. There was no Council discussion. Council President Finkam called for the vote. The motion was approved 6-0 (Green abstained). Councilor Rider moved to approve Ordinance D-2344-17. Councilor Worrell seconded. There was no Council discussion. Council President Finkam called for the vote. Ordinance D-2344-17was approved 6-0 (Green abstained). OTHER BUSINESS City Council Appointments Carmel Ethics Board (Terms Expire 1/1/18 and 1/1/19, two year terms); Two appointments. Item remains tabled. Approval of 2017 Council Meeting Dates. Councilor Rider moved to approve. Councilor Carter seconded. There was no Council discussion. Council President Finkam called for the vote. Meeting dates for 2017 were approved 7-0. Councilor Carter moved to nominate Councilor Rider to be Vice -President of the Common Council. Councilor Kimball seconded. Councilor Worrell moved to close nominations. Councilor Carter seconded. Councilor Rider was elected Vice -President by acclamation. ANNOUNCEMENTS There were none.
