HomeMy WebLinkAboutD-2346-17 Vacating ROW Monon and Main Mixed Use DevelopmentSponsor(s): Councilors Worrell and Kimball ORDINANCE D-2346-17 AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA VACATING THE EXISTING PUBLIC RIGHT-OF-WAY KNOWN AS "15" PLATTED ALLEY WITHIN THE IRA MENDENHALL'S ADDITION Synopsis: Vacates an alley within the IRA Mendenhall's Addition to enable construction of the Monon and Main Mixed Use Development. WHEREAS, Monon and Main LLC and 12156 Meridian Associates LLC ("Petitioners"), have filed a Petition for Vacation of Public Right -of -Way (the "Petition") with the City of Carmel, Indiana, pursuant to Indiana Code §36-7-3-12(b), which is attached hereto and' incorporated herein as Exhibit A; WHEREAS, the public right-of-way to be vacated, Alley 15 located within the IRA Mendenhall's Addition, is described in Exhibit B, attached hereto and incorporated herein (the "Right -of -Way"); WHEREAS, the Right -of -Way is located within the Monon and Main Mixed Use Development located at 201 W. Main Street, Carmel, Indiana 46032; WHEREAS, the vacation of the Right -of -Way will allow the Petitioners to commence construction of the buildings within the Main and Monon Mixed Use Development; WHEREAS, the City of Carmel Board of Public Works and Safety voted to recommend the vacation of the Right -of -Way at its meeting on November 16, 2016; WHEREAS, pursuant to IC 36-7-3-12(c), a properly noticed public hearing on proposed vacation of Right -of -Way was held by the Common Council of the City of Carmel, Indiana, on the 6th 1h day of February, 2017; NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of Carmel, Indiana, as follows: Section 1. The foregoing Recitals are fully incorporated herein by this reference. Section 2. The Right -of -Way shall be, and hereby is, vacated and ownership thereof shall revert to the abutting property owners. Section 3. This Ordinance shall be in full force and effect from and after its passage and signing by the Mayor. X:\ORDINANCES\2017\D-2346-17 Monon and Main Alley Vacation of ROW Ordinance w Synopsis.docx APPROVED SMV, PE TITION TO VACATE A PUBLIC WAY LOCATED ENTIRELY WITHIN THE CORPORATE BOUNDARIES OF CARMEL INDIANA Motion and Main LLC and 12156 Meridian Associates LLC, (petitioners) pursuant to Indiana Code §36-7-3-12 do hereby respectfully petition the Common Council of the City of Carmel, Indiana to vacate the existing Public Way known as "15" platted alley within the IRA Mendenhalls's Addition to the City of Carmel, Deed Book 23, Page 81. The Public Way to be vacated is described in Exhibit A attached. 2. In support of this Petition, the Petitioners submit the following: The petitioners submit this request to satisfy its obligations to the Carmel Redevelopment Commission (CRC) to develop the project known as Motion and Main Mixed Use Development located at 201 W. Main Sheet, Carmel, Indiana 46032. The. CRC and Motion and Main LLC are in the final stages of entering into a PROJECT AGREEMENT, whereas Motion and Main LLC will construct a mixed use development consisting of five components including a Parking Garage, Four story office and retain, Fine Dining Restaurant, 7 Townhomes, and a Public Park and Plaza. The pending agreement will also include the City construction of Morton Boulevard a new one lane road running north to south next to the existing Motion Trail. The approved plans will include construction of various parts of the development in the Public Right of Way as described above as the platted Alley. Respectfully the petitioners request the Common Council of the City of Carmel, Indiana to vacate this platted alley that will allow Motion and Main LLC to commence construction of the approved buildings within this area. 3.
